Commissioners Court Agenda 6 July 2010 Page 3 PUBLIC COMMENTS Public Comment during the Commission Meeting may be for all matters, both on and off the agenda, and be limited to four minutes per person. Persons are invited to submit comments in writing on the agenda items and/or attend and make comment at the Commission meeting. Members of the public we reminded that the Brazos County Commissioners Court is a Constitutional Court, with both judicial and legislative powers, created under Article V, Section 1 and Section 18 of the Texas Constitution. As a Constitutional Court, the Brazos County Commissioners Court also possesses the power to issue a Contempt of Court Citation under Section 81.024 of the Texas Local Government Code. Accordingly, members of the public in attendance at any Regular, Special and/or Emergency meeting of the Court shall conduct themselves with proper respect and decorum in speaking to, and/or addressing the Court; in participating in public discussions before the Court; and in all actions in the presence of the Court. Those members of the public who are inappropriately attired and/or who do not conduct themselves in an orderly and appropriate manner will be ordered to leave the meeting. Refusal to abide by the Court's Order and/or continued disruption of the meeting may result in a Contempt of Court Citation. It is not the intention of the Brazos County Commissioners Court to provide a public forum for the demeaning of any individual or group. Neither is it the intention of the Court to allow a member (or members) of the public to insult the honesty and/or integrity of the Court, as a body, or any member or members of the Court, or County employees, individually or collectively. Accordingly, profane, insulting or threatening language directed toward the Court and/or any person in the Court's presence and/or racial, ethnic or gender slurs or epithets will not be tolerated. Violation of these rules may result in the following sanctions: 1. cancellation of a speaker's time; 2. removal from the Commissioners Court; 3. a Contempt Citation; and/or 4. such other and/or criminal sanctions as may be authorized under the Constitution, Statutes and Codes of the State of Texas. The County Commissioners Court can deliberate or take action only if a matter has been listed on an agenda properly posted prior to the meeting. During the public comment period, speakers may address matters not listed on the published agenda. The Open Meeting Law does not expressly prohibit responses to public comments by the Commissioners Court. However, responses from the County Judge or Commissioners to unlisted public comment topics could become deliberation on a matter without notice to the public. To ensure the public has notice of all matters the Commissioners Court will consider, the County Judge and/or Commissioners may choose not to respond to public comments, except to correct factual inaccuracies, recite existing policy in response to an inquiry or to ask that a matter be listed on a future agenda. See Texas Open Meetings Act §551.042. The County Administration Building is wheelchair accessible. Handicap parking spaces are available. Voi. 2 PQ• COMMISSIONERS' COURT REGULAR MEETING JULY 6. 2010 A regular meeting of the Commissioners' Court of Brazos County, Texas was held in the Brazos County Commissioners Courtroom in the Administration Building, 200 South Texas Avenue, in Bryan, Brazos County, Texas, beginning at 9:00 a.m. on Tuesday, July 6, 2010 with the following members of the Court present: Randy Sims, County Judge, Absent; Lloyd Wassermann, Commissioner of Precinct 1; Duane Peters, Commissioner of Precinct 2, Presiding; Kenny Mallard, Commissioner of Precinct 3; Irma Cauley, Commissioner of Precinct 4; Karen McQueen, County Clerk. The attached sheets contain the names of the citizens and officials that were in attendance. Commissioner Cauley gave the invocation and then led the pledge of allegiance. There was no citizen input /and or concerns. The Court next considered Budget Amendment #09/10 -38.1 through 38.2 that would reallocate funds for the 272°" District Court; transfer funds from Contingency to 272nd District Court. On motion by Commissioner Mallard, seconded by Commissioner Cauley, the Court voted unanimously to approve the budget Vol 1'35 Page Commissioners Court meeting July 6, 2010 2 amendments as submitted. A copy of the amendment is attached. The Court proceeded to consider the change of status of employees as submitted on the attached Personnel Action Requests. On motion by Commissioner Wassermann, seconded by Commissioner Cauley, the Court voted unanimously to approve the changes as submitted. The Court next considered the following Claims as submitted by the County Treasurer for payment: 7076139 through 7076377 On motion by Commissioner Cauley, seconded by Commissioner Wassermann, the Court voted unanimously to approve the Claims as submitted. The next matter before the Court was the ratification of the Brazos County Sheriff's Office grant application to the Department of Justice Community Oriented Policing Services (COPS) Technology Program. The grant will provide 100 percent funding for salary and benefits for 3 years for a newly established full time civilian position. There is no local match requirement. Commissioner Cauley asked the Sheriff to give the Court more information at which he explained the terms of the Grant. Commissioner Peters questioned page 19 stating that the position be retained after 3 years and be paid from the General Fund. The Sheriff stated the grant Vol 13 5 Page Commissioners Court meeting July 6, 2010 3 specifically says no match required and no requirement to maintain the position even though he would hope it would be. The Sheriff explained that the Chief Deputy had filled out the grant application but unfortunately he was out today. The Sheriff said he thought that Chief Wilson had copied it from the previous grant. On motion by Commissioner Cauley, seconded by Commissioner Mallard, the Court voted unanimously to ratify the grant application. The next matter for consideration was approval of tax refund applications from the following individuals and /or companies: a. Sandra G. Todd, over payment $7.00 b. Michael R. & Patricia A. Collins, over payment $137.29 c. Karla & Frederick Noble, over payment $20.00 d. G &W Electric, over payment $243.87 On motion by Commissioner Wassermann, seconded by Commissioner Cauley, the Court voted unanimously to approve the tax refund applications. On motion by Commissioner Cauley, seconded by Commissioner Peters, the Court voted unanimously to receive, approve and order filed as submitted the Treasurer's report for May 2010. A copy is attached to and made a part of these minutes. The Court proceeded to consider the establishment of a Selection Committee to evaluate and recommend Justice software Vol (3� Page (.e Commissioners Court meeting July 6, 2010 to replace TSG /AbleTerm II On motion by Commissioner Wassermann, seconded by Commissioner Mallard, the Court voted unanimously to appoint the following individuals to serve on the committee: a. Charles Wendt, Assistant Purchasing Agent The next matter before the Court was to consider adopting of Order #10 -011 establishing spending guidelines pursuant to §130.908 of the Texas Local Government Code which limits the spending of County and Precinct Officers that may not be re- nominated or have chosen not to seek re- election. Commissioner Cauley made the following motion, to set the budget of the incumbent elected officials at the monthly sum of 1 /12t" of their present yearly budget excluding salaries and benefits. Also, there is the matter of procedure since October 2010 will start the new fiscal year and the incumbents' budget we are setting will take effect in November 2010. So as part of this motion, I also add that the Budget Vol 135 Page '7 Commissioners Court meeting July 6, 2010 5 officer, Purchasing Agent and the Auditor work together to establish a procedure on handling FY 2011 requisitions and expenditures to effectuate the budget we have set for our incumbent elected officials. To begin in November after the Court has canvassed the General Election. Commissioner Mallard seconded the motion and it carried unanimously. A copy of the Order is attached. The next matter for consideration was approval for the Purchasing Agent to advertise Bid 2010 -40, Pharmaceuticals for Indigent Inmates. Commissioner Wassermann moved to approve. Commissioner Cauley seconded the motion. Commissioner Peters asked that "after 9- 26 -09" be added to the last page after average wholesale price because of a lawsuit and regulations after 9 -26 -09 and he also asked the Purchasing department to add a signature line to the last page for the County Judge. Commissioners Cauley and Wassermann then amended their motion and second to include the items requested by Commissioner Peters. The motion carried unanimously. The Court next considered the request from Camino Forty Seven, LLC to construct approximately 316 feet of concrete sidewalk in the right -of -way of Jones Road. The site is located in Precinct 4. The sidewalk structure will be maintained by the City of Bryan. The County Engineer stated Vol 1.35 Page 9 Commissioners Court meeting July 6, 2010 6 that all appeared to be in order and recommended approval. On motion by Commissioner Cauley, seconded by Commissioner Mallard, the Court voted unanimously to approve the request from Camino Forty Seven and authorized the installation. A copy of the request is attached hereto. The Court next considered acceptance of a Special Warranty Deed for right -of -way on Leonard Road in Precinct 4. On motion by Commissioner Cauley, seconded by Commissioner Wassermann, the Court voted unanimously to authorize the County Judge to accept on behalf of Brazos County a Special Warranty Deed from Cassandra Marie Anderson and Gerald Wayne Anderson on the bridge replacement project at Thompson Creek on Leonard Road. Wssermann, Peters, and Cauley voted "Aye" Mallard abstained. The motion carried. N Commissioner authorization. Commissioners Commissioner The next matter for consideration was another payment authorization. This one to EAN Holdings, Enterprise Rent -A- Car. While attending a conference in California an Assistant District Attorney had to rent a car. Purchase Orders were done for the hotel and airfare but not for the car rental. On motion by Commissioner Peters, seconded by Commissioner Wassermann, the Court voted unanimously to approve the payment authorization. Under announcement of interest items and possible future agenda topics the following spoke: Eric Caldwell a) Announced that the Sheriff's Administration Building has now been on Voice Over IP for a week and to date is not aware of any issues. They did turn off the intercom feature at the Sheriff's request. They were able to free up handsets and expansions cards on the Nortel Telephone system. Bill Bowers, who is in charge of the phone system, has been notified. The handsets will now be used for those employees who will be temporarily relocated in the County Administration Building while the Courthouse is being remodeled. The Sheriff had commented on the incredible sound quality of the IP system. Vol 13D Page /0 Commissioners Court meeting July 6, 2010 b) He requested replacement of 172 PC's in the next fiscal year budget. There are 80 employees to be relocated. Some of their PC's are on the replacement list. He is asking that they bring their old PC's with them to their temporary location. Before they return to the Courthouse they will get replacements. He discussed how this would work and told the Court that he would submit a plan. Under citizen input and /or concerns, the following spoke: Sheriff Chris Kirk a) There were 589 inmates in jail, 45 have monitors and 44 are pending for monitors. b) The Jail passed the surprise inspection and it went well. He commended Carlos Guitron, Director of Building Maintenance for his work on a generator Tuesday evening. This allowed the jail to pass inspection. There were no Agency /Board /Committee reports by Court members. 8 There being no further business to come before the Court, the meeting was adjourned. GRANT REQUEST: The Brazos County Sheriff's Office grant request is in the amount of $199,917, to include : $162,917 for 3 years of salary & benefits for one full time civilian Crime Scene Technician. Also, the grant request includes $37,000 for training and specialized equipment to support the position. The Sheriffs Office works closely with community groups and private intities to gain insight and then develop and implement plans to ensure public safety and welfare and to prevent crime. The Sheriffs Office has implemented many programs to educate residents about crime and safety issues within the community. If approved, money from the grant will provide technology, manpower and other resources to be utilized as a means to effectively gather, preserve and analyze evidence. Currently, due to limited resources, agency investigaters must complete investigations and also act as crime analysts for their cases and cases of other investigators. This is problematic, as each investigator maintains an overwhelming case load, while providing extensive analytic support for other investigator's cases. With proper funding, the Sheriffs Office will be able to free up investigative personnel to work more cases, interact and support other agency crime units and provide valuable technological assistance to other law enforcement entities and intelligence units. Case loads will be reduced and criminals will be brought to justice quicker as more arrests wil be made in a timely fashion. Through more sofisticated crime analysis and database applications, the Sheriffs Office will be able to enhance and or create new capabilities that will increase the sharing of crime data and intelligence information, which in turn, benefits other law enforcement agencies, both locally and statewide. This position cannot be funded through any other source, due to significant budget constraints. Money from the grant, will be used to employ and train the technician and to provide necessary equipment for that employee's use. Some equipment needed will be a computer along with necessary software for visual analysis and database applications. It will also be necessary to provide the technician with a cell phone and portable radio. After completing training, the technician will be able to respond directly to crime scenes. At the scene, he or she will provide technical support, gather and preserve evidence and after transporting it to our lab, analyze and store it. The technician will be able to testify in court concerning techniques and processes used to obtain evidence from the crime scene. This position will be a huge asset to the agency. It will free up the criminal investigators from those types of duties and allow them a great deal more time to do investgative work. This will greatly benefit the community by allowing more indepth and effective investigations. It will help prosecutors, who prefer to have one person testifying about the technical, evidentiary issues involved in a case, rather than hear testimony of several individuals that might unintentionally provide contradictory testimony. It will also reduce the possibility of error, by reducing the number of people involved in an investigation. Due to economic issues, no additional funding is available for government operations. Most particularly, it was clarified in the recent budget hearing, funding for any added personnel will, in all likelyhood, not be possible. There is great concern about a reduced tax base due to unemployment rates rising, which in turn, means less money for the county to operate on. Part of the grant funding would pay the salary of the employee for three years. Some grant money will be used to train the technician on managing evidence at a crime scene and gathering, preserving and analyzing evidentiary items as necessary. This employee would also testify in court on criminal cases. Some money would be used to obtain necessary equipment for the technician to include; a computer, software for visual analysis and database applications, a cell phone, a portable radio and other items needed to carry out the duties and responsibilities of the position. This agency currently has a lab and evidence storage facilities that will allow the technician to conduct thorough lab testing. By having the capability to do lab testing on site, it will reduce turn around time on many criminal investigations. Currently, the Sheriffs Office must rely a great deal on the state crime lab for the testing of evidence. The crime scene technician will provide assistance to investigators and prosecutors. Having such a position, will free up criminal investigators, who are currently required to handle these additional duties. It would then allow criminal investigators to concentrate more on pending investigations and to initiate new investigations. With a technician in place, investigators will be able to investigate cases more thoroughly and reduce the chances of errors occurring. In the long run, investigations will be completed more quickly and workloads decreased. The Criminal Investigation Division will then be able to spend time concentrating on problematic crime trends and arrest more criminals, which in turn, will result in an overall reduction of crime in the community. Vol. 135 Pg, 39 SECTION 11: PROJECT DESCRIPTION (NARRATIVE) Please include in your application an in -depth narrative response detailing your proposed project. A. Problem Identification [Responses are limited to a maximum of 3, 000 characters.] Currently, the Brazos County Sheriffs Office has five criminal investigators and one supervisor on staff. County personnel are responsible for all criminal investigations in Brazos County that do not occur within the corporate limits of the cities of Bryan or College Station. The Criminal Investigation Division, works closely with other investigative agencies and county patrol personnel. Case loads are overwhelming and the backlog of cases continues to grow. In addition, investigators must act as their own evidence technicians; gathering and preserving evidence, analyzing evidence recovered and testifying in court regarding scientific evidentiary issues. Each investigator, not only works independently on their own cases, but must be ready to assist other investigators at a minutes notice. This creates problems with the efficiency of operations. Cases are set aside for lengthy periods of time and investigators are required to prioritize. Getting cases to court in a timely fashion becomes a critical issue. Because of the many distractions, concerns arise about the potential for errors or omissions that may mean the difference in bringing a case to a successful conclusion. B. Project Goals /Objectives [Responses are limited to a maxim am of 3,000 characters] The overall objective of the Sheriffs Office is to employ a civilian crime scene technician. This technician would be trained to provide technical support to the Criminal Investigation Division. The technician would be capable of responding to and providing crime scene analysis, would gather and preserve evidence, would ensure proper and secure retention of evidence, would conduct evidence analysis, would provide expert testimony in court and would maintain a crime analysis database that would provide current, up to date information regarding trends in criminal behavior. This would serve as a substantial benefit, by providing critical intelligence to other local and state law enforcement agencies. C. Building Relationships and Solving Problems D. Implementation Plan [Responses are limited to a maximum of 3,000 characters.] [Responses are limited to a maximum of 3.000 characters.] Upon receiving grant funding, the Sheriffs Office would immediately establish guidelines and criteria, outlining the requirements for the new Crime Scene Technician position. A process would be put into place to identify a qualified individual to fill the position. Upon hiring the new technician, training would commence. Along with proper training in scientific and technical processes, the new employee would be trained in proper procedures and issues concerning laws and policies. Equipment would also need to be purchased, that would support the functions of the position; this would include, a computer, software that would integrate visual analysis and database applications while having the capablity of identifying and storing information regarding trends and patterns of criminal behavior. Other items to be purchased would be communications equipment, such as a cell phone and portable radio. E. The new crime scene technician, would be required to go through a probationary period, which is a normal practice when hiring new county employees. The technician would be closely supervised during this learning period. Upon completion of the probationary period, the employee will be evaluated annually, as are all county employees. Measures will be taken to regularly monitor the program itself. Supervisory staff will look at work measures, yet to be established, to ascertain effectiveness. Changes will be implemented as necessary. Additionaly, regular reviews will be conducted to make certain the crime scene technician is being utilized in the most efficient manner and that investigators are being more productive and clearing more cases. All issues and developments will be well documented and progress will be measured for quality control purposes. F.
