16. Request from Verizon Communications to construct 150 ft. of 100 pair buried cable
and a 45 ft. road bore in the right of way of Walnut Road at a minimum depth of 36
inches. Site is located in Precinct 1.
17. Final Plat ofAggieland Business Park, Lots IA -1, IA-2, IB -1 and 1B -2, Block 1, 6.842
acres, being a replat of Aggieland Business Park Lot I & 1B, Block 1, 6.842 acres, J.
H. Jones survey, A -26, recorded in volume 8930, page 158 (official records of Brazos
County), with exception to correct a title block error on the mylar. Site is located in
Precinct 1.
18. Non - profit Organization Application for Brazos County inmate work crew labor for the
Kurten Community Center.
19. Request from the Tax Office for waiver of the Brazos County travel policy regarding
room rate reimbursement of $85.00 per night for the Effective Tax Rate Work Group
meeting on 6/22/2010; there was no host hotel and the suggested hotel's rate was
$115.00, which is the current State rate.
20. Payment Authorization in the amount of $2,812.50 to Price, Proctor & Associates, LLP
for services as an expert witness in the capital murder trial St. v. John Darrell Thuesen.
A purchase order was not obtained in advance.

21. Acknowledgement of Purchase Order #10003561 in the amount of $8,650.00 to N -Line
Maintenance to provide and maintain barracades to close the right, east -bound lane to
traffic on William Joel Bryan Parkway, providing a buffer around the north wall of the
Courthouse.

PUBLIC COMMENTS
Public Comment during the Commission Meeting may be for all matters, both on and off the agenda, and be limited to
four minutes per person. Persons are invited to submit comments in writing on the agenda items and/or attend and make
comment at the Commission meeting. Members of the public are reminded that the Brazos County Commissioners
Court is a Constitutional Court, with both judicial and legislative powers, created under Article V, Section 1 and Section
18 of the Texas Constitution. As a Constitutional Court, the Brazos County Commissioners Court also possesses the
power to issue a Contempt of Court Citation under Section 81.024 of the Texas Local Government Code. Accordingly,
members of the public in attendance at any Regular, Special and /or Emergency meeting of the Court shall conduct
themselves with proper respect and decorum in speaking to, and/or addressing the Court; in participating in public
discussions before the Court; and in all actions in the presence of the Court. Those members of the public who are
inappropriately attired and/or who do not conduct themselves in an orderly and appropriate manner will be ordered to
leave the meeting. Refusal to abide by the Court's Order and/or continued disruption of the meeting may result in a
Contempt of Court Citation.
It is not the intention of the Brazos County Commissioners Court to provide a public forum for the demeaning of any
individual or group. Neither is it the intention of the Court to allow a member (or members) of the public to insult the
honesty and/or integrity of the Court, as a body, or any member or members of the Court, or County employees,
individually or collectively. Accordingly, profane, insulting or threatening language directed toward the Court and/or
any person in the Court's presence and/or racial, ethnic or gender slurs or epithets will not be tolerated. Violation of
these rules may result in the following sanctions:
1. cancelation of a speaker's time;
2. removal from the Commissioners Court;
3. a Contempt Citation; and/or
4. such other and /or criminal sanctions as may be authorized
under the Constitution, Statutes and Codes of the State of Texas.
The County Commissioners Court can deliberate or take action only if a matter has been listed on an agenda properly
posted prior to the meeting. During the public comment period, speakers may address matters not listed on the published
agenda. The Open Meeting Law does not expressly prohibit responses to public comments by the Commissioners Court.
However, responses from the County Judge or Commissioners to unlisted public comment topics could become
deliberation on a matter without notice to the public. To ensure the public has notice of all matters the Commissioners
Court will consider, the County Judge and /or Commissioners may choose not to respond to public comments, except to
correct factual inaccuracies, recite existing policy in response to an inquiry or to ask that a matter be listed on a future
agenda. See Texas Open Meetings Act §551.042.
The County Administration Building is wheelchair accessible. Handicap parking spaces are available. Any request for sign

COMMISSIONERS' COURT
REGULAR MEETING
JUNE 29, 2010
A regular meeting of the Commissioners' Court of Brazos
County, Texas was held in the Brazos County Commissioners
Courtroom in the Administration Building, 200 South Texas
Avenue, in Bryan, Brazos County, Texas, beginning at 9 :00 a.m.
on Tuesday, June 29, 2010 with the following members of the
Court present:
Randy Sims, County Judge, Presiding;
Lloyd Wassermann, Commissioner of Precinct 1;
Duane Peters, Commissioner of Precinct 2;
Kenny Mallard, Commissioner of Precinct 3;
Irma Cauley, Commissioner of Precinct 4;
Karen McQueen, County Clerk.
The attached sheets contain the names of the citizens and
officials that were in attendance.
Commissioner Mallard gave the invocation and then led the
pledge of allegiance.
There was no citizen input /and or concerns.
The Court next considered Budget Amendment #09/10 -37.1
through 37.14 that would reallocate funds for the Tax Office,
Sheriff's Office -SIU, Ag Extension, Juvenile Services- TJPC -C
Commitment Reduction, Jail Expansion 2007, Constable, Precinct
4; transfer funds from JP Technology Contingency to Justice of

the Peace, Precinct 4, to Capital Improvement Fund (4), Court
Support Cost; record donation to Juvenile Services (2). On
motion by Commissioner Cauley, seconded by Commissioner
Peters, the Court voted unanimously to approve the budget
amendment as submitted. A copy each amendment is attached.
The Court proceeded to consider the change of status of
employees as submitted on the attached Personnel Action
Requests. On motion by Commissioner Wassermann, seconded by
Commissioner Peters, the Court voted unanimously to approve
the changes as submitted.
The Court next considered the following Claims as
submitted by the County Treasurer for payment:

On motion by Commissioner' Peters, seconded by Commissioner
Wassermann, the Court voted unanimously to approve the Claims
as submitted.
The next matter for consideration was Order 10 -010
dividing one election precinct and combining another election
precinct. The City of College Station approved Ordinance
43248 annexing 59.74 acres of land located in Voting Precincts
2a and 84 on June 10, 2010. Section 42.007 states "A
commissioners court may not establish a county election
precinct containing territory inside a city with a population

if 10,000 or more and unincorporated territory outside the
city." Section 42.008 of the Texas election Code provides for
combining election precincts. Therefore, on motion by
Commissioner Wassermann, seconded by Commissioner Mallard, the
Court voted unanimously to the following:
a. Election Precinct 2a be divided and then
combined with Election Precinct 80
b. Election Precinct 80 be extended to follow the
new City of College Station city limit lines
and vote at the current polling location;
C. Election Precinct 84 be abolished and made part
of Election Precinct 2b to follow the new City
of College Station city limit lines and vote at
the current polling location;
and that submission be made to the Assistant Attorney General,
Civil Rights Division, Voting Section, Department of Justice,
Washington D.C. requesting the preclearance of the Order
pursuant to Section 5 of the Federal Voting Rights Act. A copy
is attached.
The Court next considered a request from the County
Auditor for guidance from the Court concerning an outstanding
balance of $104.11 with Wal -Mart. After reviewing all
statements back to 2004 it still cannot be determined where
the remaining outstanding balance comes from. On motion by the
County Judge, seconded by Commissioner Cauley, the Court voted
unanimously to pay the balance from Non - Departmental.

The next matter for consideration was approval of tax
refund applications from the following individuals and /or
companies:
a. American Home Mortgage c/o Sterling National Corp.,
over payment $414.43
b. Bonnie T. Hugghins Norton, over payment $33.28
On motion by Commissioner Cauley, seconded by Commissioner
Peters, the Court voted unanimously to approve the tax refund
applications.
The Court proceeded to consider a requisition in the
amount of $82,540.00 to Wilton's Office Works for the purchase
of furniture for the north wing project to temporarily move
departments to the County Administration Building during the
courthouse renovations. On motion by Commissioner Peters,
seconded by Commissioner Wassermann, the Court voted
unanimously to approve the requisition.
The next matter for consideration was a requisition in
the amount of $3,741.00 to Britt Rice Electric to have
electrical work run through the vestibules for the MSC touch
screen pads for the Jail Expansion Project. On motion by
Commissioner Cauley, seconded by Commissioner Peters, the
Court voted unanimously to approve the requisition.
The Court next considered a requisition in the amount of
$2,529.09 to Wilton's Office Works for furniture for

Commissioners Court. Commissioner Peters moved to approve the
requisition. Commissioner Wassermann seconded the motion.
Commissioners Wassermann, Peters, and Mallard the County Judge
voted "Aye ". Commissioner Cauley abstained. The motion
carried to approve the requisition and that the funding comes
from Contingency.
The next matter for consideration was a requisition in
the amount of $111,703.73 to Wilton's Office Works for the
purchase of furniture for the Brazos County Jail Expansion.
On motion by Commissioner Cauley, seconded by Commissioner
Peters, the Court voted unanimously to approve the
requisition.
The Court next considered a requisition in the amount of
$2,054.45 to Wilton's Office Works for the purchase of
replacement furniture for the office of Constable, Precinct 4.
On motion by Commissioner Cauley, seconded by Commissioner
Peters, the Court voted unanimously to approve the
requisition.
The Court proceeded to consider the renewal of FRP 2008-
31, Innate Telephone System, with Evercom Systems, Inc. a
division of Securus Technologies for a one year term. The
revenue the county receives will remain the same. On motion
by Commissioner Peters, seconded by Commissioner Cauley, the

Court voted unanimously to approve the renewal of the RFP with
the new number of 2010 -34R.
The Court next considered authorizing work outside of
county rights -of -way for the health, safety and welfare of the
general public. The Road and Bridge Department requested
permission to enter the private property of Geraldine Sprague
on South Dowling Road in Precinct 1 to rework a drainage
channel. On motion by Commissioner Wassermann, seconded by
Commissioner Cauley, the Court voted unanimously to authorize
the work.
The Court next considered the request from Verizon
Communications to construct a 150 foot of 100 pair of buried
cable and a 45 foot road bore in the right -of -way of Walnut
Road in Precinct 1. This will allow service for Aggie
Acres /Reveille Road. The County Engineer stated that all
appeared to be in order and recommended approval. On motion
by Commissioner Wassermann, seconded by Commissioner Peters,
the Court voted unanimously to approve the request from
Verizon Communications and authorized the installation. A
copy of the request is attached hereto.
The Court next considered approval of the Final Plat of
Aggieland Business Park, Lots 1A -1, 1A -2, 1B -1 and 1B -2, Block
1, 6.842 Acres, Being a Replat of Aggieland Business Park Lot

1A, & 1B, Block 1, 6.842 Acres located in Precinct 4. Richard
Vance, County Engineer, stated that he had reviewed the plat
and all appeared to be in order. On motion by Commissioner
Cauley, seconded by Commissioner Peters, the Court voted
unanimously to approve the final plat of Aggieland Business
Park, Lots 1A -1, 1A -2, 1B -1 and 1B -2, Block 1, 6.842 Acres,
Being a Replat of Aggieland Business Park Lot 1A, & 1B, Block
1, 6.842 Acres as submitted.
The next matter for consideration was a request from a
non profit organization for an inmate work crew for the Kurten
Community Center. On motion by Commissioner Peters, seconded
by Commissioner Cauley, the Court voted unanimously to approve
the request.
The Court proceeded to consider the request from the Tax
Office for a waiver of the Brazos County Travel Policy

by Commissioner Cauley, seconded by Commissioner Peters, the
Court voted unanimously to approve the payment authorization.
The Court next acknowledged purchase order #10003561 in
the amount of $8,650.00 to N -Line Traffic Maintenance to
provide and maintain barricades to close the right, east bound
lane to traffic on William Joel Bryan Parkway. This will allow
for a buffer zone around the north wall of the Courthouse.
Under announcement of interest items and possible future
agenda topics the following spoke:
Commissioner Mallard
a) Would like to find a way to get
information to all Commissioners like the
issue of the curtain wall without
violating the open meetings act. He
suggested we do as the cities do and
routinely post executive sessions on all
agendas. This will not only allow the
members to be updated on issues but also
allow them to discuss them.
Commissioner Cauley
a)Believes the Court needs a workshop on
open meetings in order to find ways to
communicate.
County Judge
a)Asked his secretary to organize a work shop
session.

Under citizen input and /or concerns, the following
spoke:
Sheriff Chris Kirk
a) There were 594 inmates in jail, 41 have
monitors and 46 are pending for monitors.
b) There was a surprise inspection by a Jail
Inspector this morning. He will let the
Court know the outcome.
85th District Court Judge, J. D. Langley
a) Had a meeting with the contractor last
Wednesday. He received notice that work will
begin on the west wall of the Courthouse as soon
as possible, perhaps even Monday. He has been
looking at the relocation plans. The third
floor will be worked on first. Effective July
12th, the 3613t District Court will move to the
Auditor's old office. They should be there for
three weeks. He chose this date so that the
District Attorney in this space will not be
affected until after the current murder trial.
After this the 272nd District Court will occupy
the space until their space is repaired.
There were no Agency /Board /Committee reports by Court
members.

ORDER. DIVIDINGr ONE ELECTION PRECINCT AND
COMBINING INTO ANOTHER ELECTION PRECINCT
WHEREAS, the City of College Station approved Ordinance #3248 annexing
59.74 acres of land located in Voting Precincts 2a and 84 on June 10, 2010; and
WHEREAS, the new boundary lines of the City of College Station do not follow
the existing election precinct lines created by Brazos County; and
WHEREAS, Section 42.007 states "A commissioners court may not establish a
county election precinct containing territory inside a city with a population or 10,000 or
more and unincorporated territory outside the city'; and
WHEREAS, the Commissioner's Court is desirous of complying with the City of
College Station city limit lines, and the Texas Election Code; and
WHEREAS, compliance with the Texas Election Code requires the division of
one (1) voting precinct and combining the annexed portion into another voting precinct;
WHEREAS, Section 42.008 (1) of the Texas Election Code provides for
combining election precincts;
NOW THEREFORE BE IT RESOLVED BY THE COMMISSIONERS
COURT OF BRAZOS COUNTY, TEXAS, that
Pursuant to Section 42.007 of the Texas Election Code that:
1. Election Precinct 2a be divided and be combined with Election Precinct 80;
2. Election Precinct 80 be extended to follow the new City of College Station
city limit lines and vote at the current polling location;

3. Election Precinct 84 be abolished and made part of Election Precinct 2b to
follow the new City of College Station city limit lines and vote at the current
polling location ;
4. That submission be made to the Assistant Attorney General, Civil Rights

the preclearance of this Order pursuant to Section 5 of the Federal Voting
Rights Act.

ITEM: Request from Verizon Communications to construct 150 ft of 100 pair buried cable and a
45 fl road bore in the right of way of Walnut Road at a minimum depth of 36 inches. Site is located
in Precinct 1.
SOURCE OF FUNDS: N/A
PRESENTATION: Service for Aggie Acres/Reveille Rd.
REQUIREMENTS:
1) No work will be permitted between front slope and/or back slope.
2) All installation(s) shall be constructed in designated utility easements, if applicable. If no utility
easement exists, the installation(s) shall be 1) within 3 -5' of and parallel to the right -of -way line
and/or 2) in the case of a road bore, perpendicular to the right -of -way line,
3) If clearing of brush, trees and other obstruction is necessary, it shall be the Applicant's responsibility to
do so and to remove all cleared brush, trees etc, from county right -of -way.
4) Ditch line shall be compacted to 90% standard density ASTM -Test Method No. D-698; test shall be
conducted by an independent geotechnical testing firm; copies of all test results shall be furnished to
the office of the Brazos County Engineer.
5) Construction shall be in strict conformance to the latest Texas Manual of Uniform Traffic Control
Devices for Streets and Highways, published by the Texas Department of Transportation, and all other
State and Federal laws governing utility construction.

ATTENTION COUNTY JUDGE:
Formal notice is hereby given that GTE SOUTHWEST INC. d /b /a VERIZON
SOUTHWEST will construct a communication line within the right -of -way of a
County Road in Brazos County, Texas as follows:
Verizon will place approx. 150' of 100 pair buried cable in the north R.O.W. of
Walnut Rd. beginning at L- 307 /Pd. 1 -6X and go in an easterly direction for 150'
to Reveille Rd. where we will bore under Walnut Rd. to the conduit that has been
placed in the Aggie Acres subdivision in the P.U.E. for us to place our cable in
throughout the subdivision.The cable will be 5' inside the north R.O.W. at a
depth of 36 ".
The location and description of this line and associated appurtenances is
more fully shown by four (4) copies of drawings attached to this notice. The line
will be constructed and maintained on the County Road right -of -way in
accordance with governing laws.
Notwithstanding any other provision contained herein, it is expressly
understood that the tender of this notice by the Verizon Southwest Incorporated
does not constitute a waiver, surrender, abandonment or impairment of any
property rights, franchise, easement, license, authority, permission, privilege or
right now granted by law or may be granted in the future and any provision or
provisions so construed shall be null and void.
Construction of this line will begin on or after July 12,2010.
