to provide power for the repeater at the Jail addition. This project_ is required for the
jailors to use radios in the newly expanded jail.

18, Contract with Madison Construction Company for repairs to the Brazos County
Courthouse needed to preserve the property of the County, preserve and protect the public
health or safety of the residents of the County. These repairs are necessary because of
unforeseen damage to public property.
19. Requisition 400029578 in the amount of $34,021.50 to CDW Government Inc. for the
Voice over IP (VoIP) telephone system to be installed as part of the Jail expansion
project.

PUBLIC COMMENTS
Public Comment during the Commission Meeting maybe for all matters, both on and off the agenda, and be limited to four
minutes per person. Persons are invited to submit comments ,in writing on the agenda items and/or attend and make continent
at the Commission meeting. Members of the public are reminded that the Brazos County Commissioners. Court is a
Constitutional Court, with both judicial mid legislative powers; created under Article V, Section 1 and Section 18 of the
Texas Constitution.. As a Constitutional Court, the Brazos County Commissioners Court also possesses the power to issue a
Contempt of Court Citation under Section81.024 of the Texas Local Government Code. Accordingly, members of the public .
in attendance at any Regular, Special and/or Emergency meeting of the Court shall conduct themselves with proper respect
and decorum in speaking to, and/or addressing the Court; in participating in public discussions before the Court; and in all
actions in the presence of the Court. Those members of the public who are inappropriately attired and/or who do not
conduct themselves in an orderly and appropriate manner will be ordered to leave the meeting. Refusal to abide by the
Court's Order and/or continued disruption of the meeting may result in a Contempt of Court Citation.
It is not the intention of the Brazos County Commissioners Court to provide :a public forum for the.. demeaning of any
individual or group. Neither is it the intention of the Court to allow a member (or members) of the public to insult the
honesty and/or integrity of the Court, as a body, . or any member or members of the Court, or County employees, individually
or collectively. Accordingly, profane, insulting or threatening language directed toward the Court and/or any person in the
Court's presence and/or racial, ethnic or gender slurs or epithets will not be tolerated. Violation of these rules may result in
the following sanctions:
I, cancellation of a speaker's time;
2. removal from the Commissioners Court;
3. a Contempt Citation; and/or
4. such other and/or criminal sanctions as may be authorized
under the Constitution, Statutes and Codes of the State of Texas.
The County Commissioners Court can deliberate or take action only if a matter has been listed on an agenda properly posted
prior to the meeting: During the public comment period, speakers may address matters not listed on the published agenda.
The Open Meeting Law does not expressly prohibit responses to public comments by the Commissioners Court. However,
responses from the County Judge or Commissioners to unlisted public comment topics could become deliberation on a
matter without notice to the public. To ensure the public has notice of all matters the Commissioners Court will consider;
the County Judge and/or Commissioners may choose not to respond to public comments, except to correct factual
inaccuracies, recite existing policy in response to an inquiry or to ask that a matter be listed .on a future agenda. See Texas
Open Meetings Act §551.042.
The County Administration Building is wheelchair accessible. Handicap parking spaces are available. Any request for

REGULAR MEETING
JUNE 15, 2010
A regular meeting of the Commissioners' Court of Brazos
County, Texas was held in the Commissioners Courtroom in the
Brazos County Administration Building, 200 South Texas Avenue,
in Bryan, Brazos County, Texas, beginning at 6:00 p.m. on
Tuesday, June 15, 2010 with the following members of the Court
present:
Randy Sims, County Judge, Presiding;
Lloyd Wassermann, Commissioner of Precinct 1;
Duane Peters, Commissioner of Precinct 2;
Kenny Mallard, Commissioner of Precinct 3;
Irma Cauley, Commissioner of Precinct 4;
Karen McQueen, County Clerk, Absent.
The attached sheet contains the names of the citizens and
officials that were in attendance.
Commissioner Peters gave the invocation and led the
pledge of allegiance.
There was no citizen input /and or concerns.
The Court heard a presentation of the quarterly
delinquent tax report presented by Shelburne Veselka,
representative of McCreary, Veselka, Bragg & Allen, P.C.

The Court next considered approval of the minutes of the
Commissioners' Court meetings held in May 2010 on the
following dates:
Regular Meetings - 4th, 11tH 18th 25th
Workshop Session - 11th
On motion by Commissioner Cauley, seconded by Commissioner
Peters, the Court voted unanimously to approve the minutes as
submitted.
The next matter for consideration was approval of tax
refund applications from the following individuals and /or
companies:
a) Coye Mac & Gail Williams, over Payment $16.88
b) Thomas Dixon, over Payment $30.53
c) Antonio T. Gonzalez, over payment $8.67
d) Citifinancial Mortgage, over payment $21.27
e) Joe W. or Kathy Winters, over payment $104.52
f) Arthur H. & Naomi Ruth Huff, over payment $50.12
g) Harris Apartment Account, over payment $1,446.58
h) John & Ruth Drescher, over payment $25.27
On motion by Commissioner Wassermann, seconded by Commissioner
Cauley, the Court voted unanimously to approve the tax refund
applications.
The Court next considered a payment authorization in the
amount of $568.00 to Texas Communications for repair to radios
for Jail Administration. A purchase order was not obtained in
advance. On motion by Commissioner Cauley, seconded by

Commissioner Peters, the Court voted unanimously to approve
the payment authorization.
The next matter for consideration was a requisition in
the amount of $336.23 to Uline for the purchase of a Pallet
Hand Truck for the Brazos County Jail Expansion. On motion by
Commissioner Peters, seconded by Commissioner Mallard, the
Court voted unanimously to approve the requisition.
The Court proceeded to consider the a requisition in the
amount of $1,924.50 to Lowes, Inc. for the purchase of twenty
five (25) steel, free standing, shelving units for the Brazos
County Jail Expansion. On motion by Commissioner Cauley,
seconded by Commissioner Peters, the Court voted unanimously
to approve the requisition.
The Court next considered requisition 400029559 in the
amount of $750.00 to provide and install six (6) circuits in a
power supply box and two (2) circuits in a quad outlet box in
order for the Millican Radio tower to receive power for the
BVWACS Project. On motion by Commissioner Peters, seconded by
Commissioner Mallard, the Court voted unanimously to approve
the requisition.
The next matter for consideration was a capital
requisition in the amount of $1,255 to Britt Rice Electric for
electrical wiring to provide power for the repeater at the

jail addition. This is necessitated due to the subcontractor
for the communications portion of the contract does not have a
licensed electrician on staff. On motion by Commissioner
Cauley, seconded by Commissioner Peters, the Court voted
unanimously to approve the requisition.
The Court next considered Bid 2010 -25, 12 Inch Rip Rap.
Charles Wendt, Assistant Purchasing Agent, made the following
recommendations:
Primary:

Loaded Only - Superior Crushed Stone
Loaded & Hauled - Austin Crushed Stone
On motion by Commissioner Wassermann, seconded by Commissioner
Peters, the Court voted unanimously to accept the
recommendation of the Assistant Purchasing Agent and award the
contract as noted above. A copy of the bid tabulation is
attached.
The next matter for consideration was Bid 2010 -36,
Asphalt, Oil & Emulsion. Charles Wendt, Assistant Purchasing
Agent made the following recommendations:
Primary: CRS -2 & SS- 1 -Ergon Asphalt
Secondary: CRS -2 & SS- 1- Cleveland Asphalt

On motion by Commissioner Cauley, seconded by Commissioner
Wassermann, the Court voted unanimously to award the bid as
noted above. It was noted that another vendor was the low
bidder but with a history of documented poor performance the
vender was not awarded the bid.
The Court next considered the request from Wickson Creek
Special Utility District to place a 3 inch encasement with 2
inch waterline across the right -of -way of 3001 Thurman Road.
The site is located in Precinct 2. The County Engineer stated
that all appeared to be in order and recommended approval. On
motion by Commissioner Peters, seconded by Commissioner
Wassermann, the Court voted unanimously to approve the request
from Wickson Creek Special Utility District, authorize the
installation and to include the correction to the agenda. The
agenda should have stated encasement rather than easement. A
copy of the request is attached hereto.
The Court next considered the request from Wickson Creek
Special Utility District to place a 1=� inch encasement with 1
inch waterline across the right -of -way of Treebrook Lane. The
site is located in Precinct 3. The County Engineer stated
that all appeared to be in order and recommended approval. On
motion by Commissioner Mallard, seconded by Commissioner
Cauley, the Court voted unanimously to approve the request

from Wickson Creek Special Utility District and authorized the
installation. A copy of the request is attached hereto.
The Court next considered a request form the City of
Bryan to construct storm sewer culverts (RCP) in the right -of-
way of Foster Road in Precinct 4. On motion by Commissioner
Cauley, seconded by Commissioner Wassermann, the Court voted
unanimously to approve the request. A copy is attached.
The Court next considered approval of the Preliminary
Plat for West 28th Addition, 1.07 Acres along with a request to
allow a variance of the 10 foot utility easement, and variance
to the 25 foot setback line. The site is in Precinct 4.
Richard Vance, County Engineer, stated that he had reviewed
the plat and offered the following comment:
1) Variance to the requirements of a 10 foot Public
Utility Easement around the perimeter of the
subdivision -not enough usable land space
available, existing structures within the rear 20
feet of the property. The property is currently
served by all utilities from the front. A 20
foot easement along 28th Street will service all
existing and future residential structures.
On motion by. Commissioner Cauley, seconded by Commissioner
Peters, the Court voted unanimously to approve the preliminary
plat for West 28th Addition, 1.07 Acres along with a request to
allow a variance of the 10 foot utility easement, and variance
to the 25 foot setback line as submitted.

The Court proceeded to consider an Order granting an
exemption to the competitive bidding process under Local
Government Code §262.024. The County Judge moved for approval.
Commissioner Peters seconded the motion. This is necessitated
due to the discovery of a structural problem with the north
wall of the Courthouse building. Bill Ballard explained the
issues. The members of the Court along with Bill Ballard,
Civil Counsel, Fred Patterson, Architect, Glen Chamblee
Curtain Wall Construction Specialist and Glary Jasper,
Structural Engineer discussed the best way to handle the
problem while still following the law and not violating the
Competitive bidding process. Different repair options were
discussed and discarded with most being un- certifiable by a
licensed professional as to the safety of the repair. Glen
Chamblee stated that it was his opinion that the north wall be
repaired as soon as possible. There already being a motion and
a second, the County Judge asked for the vote. The Court
voted unanimously to adopt Order 10 -008. A copy is attached.
The Court next considered adopting Order 10 -009 granting
the award of a contract to Madison Construction for the
replacement of concrete panels along the north face of the
Brazos County Courthouse. This is necessitated for repairs to
the Brazos County Courthouse needed to preserve the property

of the County, preserve and protect the public health or
safety of the residents of the County. The cost of the work.is
approximately $1,000,000.00. Fred Patterson, Architect spoke
on the appearance of the Courthouse. He stated that the
curtain wall is the most attractive, most time efficient and
not out of line on the price. He went on to say that Madison
Construction has recent experience with a curtain wall having
recently replaced the fagade on a building in College Station.
Mike Jones, President of Madison Construction stated that he
did not want to take on the liability of fixing the panels if
an engineer will not certify the job. The members of the
Court along with Mr. Patterson discussed re- welding all
connections which would take anywhere from 5 to 6 months with
major disruption in offices for up to 6 weeks at a time,
whereas the curtain wall will take 90 days to construct.
Commissioner Mallard asked how we know the Architect and
Engineer are giving us fair prices. Commissioner Peters stated
that the curtain wall option seemed most logical. On motion by
Commissioner Peters, seconded by the County Judge, the Court
voted unanimously to adopt Order 10 -009 granting the award of
a contract to Madison Construction for the replacement of
concrete panels along the north wall of the Brazos County

Courthouse with a glass curtain wall and to stabilize the
South, East and West walls.
The next matter for consideration was requisition
#00029578 in the amount of $34,021.50 to CDW Government, Inc.
for the Voice Over IP telephone system to be installed as part
of the jail expansion project. On motion by Commissioner
Peters, seconded by Commissioner Wassermann, the Court voted
unanimously to approve the requisition.
The next matter before the Court was Budget Amendment
#09/10 -35.1 through 35.7 that would reallocate funds for
Constable Precinct 2, Juvenile Services (2); Jail Expansion
(2), transfer funds from General Capital Improvement Fund to a
newly created division, from Contingency to the 272nd District
Court. On motion by Commissioner Peters, seconded by
Commissioner Cauley, the Court voted unanimously to approve
the budget amendment as submitted, a copy of which is
attached.
The Court proceeded to consider the change of status of
employees as submitted on the attached Personnel Action
Requests. On motion by Commissioner Peters, seconded by
Commissioner Wassermann, the Court voted unanimously to
approve the change of status as submitted.

The Court next considered the following Claims as
submitted by the County Treasurer for payment:

On motion by Commissioner Cauley, seconded by Commissioner
Peters, the Court voted unanimously to approve the Claims as
submitted.
The County Judge announced that the court would not meet
in executive session.
There was no action taken on agenda item 24.
There were no announcements of interest items and
possible future agenda topics.

a) Said there were 577 inmates in jail
last night, 566 this morning, 47 were
on electronic monitors, and 47
pending for monitors..
Under Agency /Board /Committee reports by Court members,
the following spoke:
County Judge
a) Announced that the Brazos Valley Veterans
Memorial Board will have a ground breaking
on June 25th on the 60th anniversary of the
Korean War.
There being no further business to come before the
Court, the meeting was adjourned.

ITEM: Request from Wickson Creek Special Utility District to place 3" encasement with 2"
waterline across the right -of- -way of 3001 Thunman Road. Site is located in Precinct 2.
SOURCE OF FUNDS: N/A
REQUIREMENTS:
1. No work will be permitted between front slope and/or back slope.
2. All installation(s) shall be constructed in designated utility easements, if applicable. If no
utility easement exists, the installation(s) shall be 1) within 3 -5' of and parallel to the right -
of -way line and/or 2) in the case of a road bore, perpendicular to the right -of -way line.
3. If clearing of brush, trees and other obstruction is necessary, it shall be the Applicant's
responsibility to do so and to remove all cleared brush, trees etc. from county right -of -way.
4. Ditch line shall be compacted to 90% standard density ASTM -Test Method No. D-698; test
shall be conducted by an independent geotechnical testing firm; copies of all test results shall
be furnished to the office of the Brazos County Engineer.
5. Construction shall be in strict conformance to the latest Texas Manual of Uniform Traffic
Control Devices for Streets and Iligrhways . published by the Texas Department of
Transportation, and all other State and Federal laws governing utility construction.

Formal notice is hereby given that (applicant) Wickson Creek Special Utility District
proposes to place a (type) waterline within_ across x the right -of -way of
(road) 3001 THURMAN ROAD in Brazos County, Texas as follows: .
The location or description of the proposed installation is more fully shown by 3
copies of the drawings attached to this notice.
I understand and agree that:
1. The County Engineer must be notified 72 hours prior to the beginning
of construction in order that he, or his designated inspector, may
inspect the actual installation.
2. All damage to the roadways and rights -of -way will be repaired to their

The purpose of this drainage letter is to present analysis of the required drainage
infrastructure for the proposed Fosters Lane in Brazos County, Texas. The project will
be located perpendicular to Foster Road, west of Jones Road. This road will provide
paved access for existing residents on Fosters Lane and to the proposed Thompson's
Creek Wastewater Treatment Plant. Fosters Lane will consist of a 30' wide paved rural
section (70' ROW) with an open ditch along the east side of the road, as shown in the
attached plans in Appendix A.
The parameters used for design and the existing conditions of the on -site area are
incorporated to show how the final drainage design will accomplish the desired drainage
objectives of Brazos County and the City of Bryan. Flow calculations are based on the
Rational Method with a minimum time of concentration of 10 minutes. Lag time
calculation is based on the Upland Method. Pipe capacity calculations are based on
Manning's Equation for a 25 -year storm event. A drainage area map is provided as
Exhibit 1. Rational calculations and pipe sizing calculations area provided in Exhibits 2
and 3, respectively.
As shown in Exhibit 1, a large portion of offsite flow (DA1 and DA2) drains to existing
eighteen inch (18 ") and twenty -four inch (24 ") culverts, discharging to the southwest side
of Fosters Road to a tributary of Thompson's Creek. As evidence of the erosion at the
area, existing flow is not entirely contained within the culverts. The proposed Foster
Lane will maintain the location of these culverts, upsizing them to forty -two inch (42")
and forty -eight inch (48 ") culverts. The increase in size and slope of the culverts will
alleviate erosion problems at this intersection.
The increase of size of the culverts at the intersection of Foster Lane and Foster Road
will also keep the road clear from 25 -, 50 -, and 100 -year storm events. Exhibits 4 and 5
show flows to the culverts at this intersection for the 50- and 100 -year storm events,
respectively. Exhibit 6 provides hydraulic grade line (HGL) calculations for the 100 -year
storm event, with a starting HGL at the outfall (0UT1) equal to that of the outfall soffit
elevation (257.08 ft). It was found that the HGL within the culverts never exceeds the
elevation of the intersection (264.0 ft).

Commissioners' Court, as duly put and carried.
WHEREAS, Architects and Engineers have informed the Commissioners' Court that
heavy concrete panels lining the north surface of the Courthouse are not properly anchored and
may become dislodged and a danger to the public health or safety of Brazos County residents ;
and,
WHEREAS, a contract currently exists for the remodel of the Brazos County Courthouse
that did not contemplate this newly discovered danger to the public health or safety of Brazos
County residents; and,
WHEREAS, the Commissioners Court finds that an emergency exists and the exigency
of this circumstance requires the immediate attention to this danger to the public health or safety
of Brazos County residents and the time to competitively bid this work would exceed ninety
days.
THEREFORE, IT IS ORDERED, ADJUDGED AND DECREED by the
Commissioners' Court of Brazos County, Texas, that this Order grant an exemption from the
competitive bidding requirements of Texas Local Government Code §262.023 for the
replacement of panels along the north face of the Brazos County Courthouse in accordance with
Local Govemment Code 262.024(a)(2) an item necessary to preserve or protect the public health
or safety of the residents of the county;
