BRAZOS COUNTY COMMISSIONERS COURT
WORKSHOP SESSION
THE COMMISSIONERS COURT OF BRAZOS COUNTY WILL MEET IN A
WORKSHOP SESSION ON TUESDAY 11 MAY 2010 AT 2:00 P.M. IN THE
COMMISSIONERS COURTROOM OF THE COUNTY ADMINISTRATION
BUILDING, 200 SOUTH TEXAS AVENUE, SUITE 106, BRYAN, TEXAS.

2. Discussion with representative(s) from The Texas Association of Counties regarding
deductions for exempt Brazos County employees.
3. Adjourn

COMMISSIONERS' COURT
WORKSHOP SESSION
MAY 11, 2010
The Commissioners' Court of Brazos County, Texas met in a
Workshop Session in the Commissioners' Courtroom in the Brazos
County Administration Building in Bryan, Brazos County, Texas,
beginning at 2:00 p.m. on Tuesday, May 11, 2010 with the
following members of the Court present:
Randy Sims, County Judge, Presiding;
Lloyd Wassermann, Commissioner of Precinct 1;
Duane Peters, Commissioner of Precinct 2;
Kenny Mallard, Commissioner of Precinct 3;
Irma Cauley, Commissioner of Precinct 4;
Karen McQueen, County Clerk, Absent.
Attached is a list of the citizens and officials in
attendance.
The Commissioner's Court met to discuss with the
representative from the Texas Association of Counties
deductions for exempt Brazos County employees.
Mary Ann Saenz, Human Resources expert from the Texas
Association of Counties (TAC) addressed the issues. She
discussed Fair Labor Standards Act and what the Court's
options were in regard to exempt employees. She pointed out
that elected officials are exempt from the Fair Labor
Standards. She told the Court that Polk and Comal Counties
have a flexible hours policy that allows exempt employees that

have worked over 8 hours in one day to use those hours at a
later date. This is akin to a comp hour bank.
Amy Bates, representing the Auditor's office noted that
although the law does not prohibit this, it makes the exempt
employees like hourly workers.
Ms. Saenz went on to say that the Department of Labor
looks harshly at deducting partial days. If this is the wish
of the Court then it would be better to have a flex time bank.
