Adjourn Vol. 131 Pg. 930/_ Commissioners Court Agenda 23 February 2010 Page 4 PUBLIC COMMENTS Public Comment during the Commission Meeting may be for all matters, both on and off the agenda, and be limited to four minutes per person. Persons are invited to submit comments in writing on the agenda items and/or attend and make comment at the Commission meeting. , Members of the public are reminded that the Brazos County Commissioners Court is a Constitutional Court, with both judicial and legislative powers, created under Article V, Section 1 and Section 18 of the Texas Constitution. As a Constitutional Court, the Brazos County Commissioners Court also possesses the power to issue a Contempt of Court Citation under Section 81.024 of the Texas Local Government Code. Accordingly, members of the public in attendance at any Regular, Special and/or Emergency meeting of the Court shall conduct themselves with proper respect and decorum in speaking to, and/or addressing the Court; in participating in public discussions before the Court; and in all actions in the presence of the Court. Those members of the public who are inappropriately attired and/or who do not conduct themselves in an orderly and appropriate manner will be ordered to leave the meeting. Refusal to abide by the Court's Order and/or continued disruption of the meeting may result in a Contempt of Court Citation. It is not the intention of the Brazos County Commissioners Court to provide a public forum for the demeaning of any individual or group. Neither is it the intention of the Court to allow a member (or members) of the public to insult the honesty and/or integrity of the Court, as a body, or any member or members of the Court, or County employees, individually or collectively. Accordingly, profane, insulting or threatening language directed toward the Court and/or any person in the Coui3's presence and/or racial, ethnic or gender slurs or epithets will not be tolerated. Violation of these rules may result in the following sanctions: 1. cancellation of a speaker's time; 2. removal from the Commissioners Court; 3. a Contempt Citation; and/or 4. such other and/or criminal sanctions as may be authorized under the Constitution, Statutes and Codes of the State of Texas. The County Commissioners Court can deliberate or take action only if a matter has been listed on an agenda properly posted prior to the meeting. During the public comment period, speakers may address matters not listed on the published agenda. The Open Meeting Law does not expressly prohibit responses to public comments by the Commissioners Court. However, responses from the County Judge or Commissioners to unlisted public comment topics could become deliberation on a matter without notice to the public. To ensure the public has notice of all matters the Commissioners Court will consider, the County Judge and/or Commissioners may choose not to respond to public comments, except to correct factual inaccuracies, recite existing policy in response to an inquiry or to ask that a matter be listed on a future agenda. See Texas Open Meetings Act §551.042. The County Administration Building is wheelchair accessible. Handicap parking spaces are available. COMMISSIONERS' COURT REGULAR MEETING FEBRUARY 23, 2010 A regular meeting of the Commissioners' Court of Brazos County, Texas was held in the Brazos County Commissioners Courtroom in the Administration Building, 200 South Texas Avenue, in Bryan, Brazos County, Texas, beginning at 9:00 a.m. on Tuesday, February 23, 2010 with the following members of the Court present: Randy Sims, County Judge, Presiding; Lloyd Wassermann, Commissioner of Precinct 1; Duane Peters, Commissioner of Precinct 2; Kenny Mallard, Commissioner of Precinct 3; Irma Cauley, Commissioner of Precinct 4; Karen McQueen, County Clerk. The attached sheets contain the names of the citizens and officials that were in attendance. Commissioner Peters gave the invocation and then led the pledge of allegiance. There was no citizen input /and or concerns. The first matter before the Court was a report by Brazos Transit District on the parking garage. John McBeth spoke saying that they will be starting the parking garage in two weeks which will put it at March 8, 2010. For problems, he asked that people call the dedicated hotline at 778 -4510. Vol I3/ Page :24) Commissioners Court meeting February 23, 2010 2 The Court next considered Budget Amendment #09/10 -19.1 through 19.3 that would reallocate funds for Primary Elections, County Clerk- Elections, District Clerk Administration and Collections. On motion by Commissioner Peters, seconded by Commissioner Wassermann, the Court voted unanimously to approve the budget amendment as submitted. A copy each amendment is attached. The Court next considered the revised job descriptions for the following positions in the District Clerk's Office: a) Clerk III, Class 1709, Position 8; b) Clerk III, Class 1709, Position 2; c) Clerk III, Class 1709, Position 9; d) Clerk 1560 /hr, Class 1717, Position 1; e) Clerk 1560 /hr, Class 1717, Position 2; f) Clerk II, Class 1707, Position 2; g) Assistant Director of Collections, Class 1727, Position 1; h) Clerk I- Collections, Class 1729, Position 2. On motion by Commissioner Peters, seconded by Commissioner Wassermann, the Court voted unanimously to approve the revised job descriptions as submitted. Commissioner Cauley moved to approve the reclassification request. Commissioner Mallard seconded the motion. Commissioners Wassermann, Peters, Mallard and Cauley voted "Aye ". The County Judge voted "No ". The request for reclassification passed. The Court next considered revised job descriptions for the following positions in the Information Technology Department: a. Project Manager b. Assistant Network Administrator on motion by Commissioner Cauley, seconded by Commissioner Peters, the Court voted unanimously to approve the revisded job descriptions. The Court proceeded to consider the change of status of employees as submitted on the attached Personnel Action Vol t 3) Page a'13 Commissioners Court meeting February 23, 2010 4 Requests. On motion by Commissioner Wassermann, seconded by Commissioner Cauley, the Court voted unanimously to approve the changes as submitted. The Court next considered the following Claims as submitted by the County Treasurer for payment: 7071327 through 7071540 On motion by Commissioner Peters, seconded by Commissioner Mallard, the Court voted unanimously to approve the Claims as submitted. The next matter before the Court was consideration of the reappointment of an individual as a Board of Trustee member of the Mental Health Mental Retardation Authority of Brazos Valley Authority of Brazos Valley. On motion by Commissioner Cauley, seconded by Commissioner Peters, the Court voted unanimously to reappoint Ronny Jackson to serve as a Board of Trustee member of the Mental Health Mental Retardation Authority of Brazos Valley Authority of Brazos Valley for a term beginning March 1, 2010 through February 29, 2012. The Court next considered the Agreement with the Lions 71 Breakfast Club Corporation for the operation and maintenance of the Brazos County Exposition Complex Concession. On motion by the County Judge, seconded by Commissioner Cauley, the Court voted unanimously to table consideration. Vol 131 Page 2-4 4 Commissioners Court meeting February 23, 2010 5 The next matter before the Court was consideration of a request from the Sheriff's Office -Jail Division for funding of three (3) Detention Officers for the opening and proper staffing of the Low Risk Facility. On motion by Commissioner Cauley, seconded by Commissioner Peters, the Court voted unanimously to approve the request. The Court next considered a request from the Sheriff's Office -Jail Division for the creation of an additional jail detention officer and funding. Wayne Dicky, Jail Administrator clarified that this is position 85. On motion by Commissioner Peters, seconded by Commissioner Mallard, the Court voted unanimously to approve the request. The next matter for consideration was a request from the Commissioners' Office seeking approval for out of state travel for Commissioner Irma Cauley to travel to Washington D.C. to attend the NACo Legislative Conference 2010 during the week of March 5 through the 10, 2010. On motion by Commissioner Mallard, seconded by Commissioner Peters, the Court voted unanimously to grant the request from the County Commissioners Office and approved payment of out of state travel expense for Commissioner Irma Cauley. It was noted that any deficit in the Commissioner's travel budget would be paid by the Commissioner. Vol l 3 ) Page A45 Commissioners Court meeting February 23, 2010 6 The next matter for consideration by the Court was a request submitted by Wayne Dicky, Jail Administrator seeking approval for out of state travel for himself to travel to Portland, Oregon to attend a the American Jail Association Conference May 22 -27, 2010. On motion by Commissioner Wassermann, seconded by Commissioner Peters, the Court voted unanimously to grant the request from the Jail Administrator and approved payment of out of state travel expense for Mr. Wayne Dicky. The Court next considered a revised job description for the Administrative Assistant position in the County Judge's Office. On motion by the County Judge, seconded by Commissioner Peters, the Court voted unanimously to approve the revised job description. The next matter for consideration was approval of tax refund applications from the following individuals and /or companies: a. Saul B. Castanon, over payment $7.15 b. Rupak Kumar & Niketani Mahapatra, over payment $889.76 c. George Lang, over payment $50.42 d. Estate of James E. Tatum, over payment $234.23 e. Bryan /College Station Habitat for Humanity, over payment $5.08 On motion by Commissioner Cauley, seconded by Commissioner Peters, the Court voted unanimously to approve the tax refund applications. Vol 13 Page a� Commissioners Court meeting February 23, 2010 7 The Court next considered approval of requisition #00028058 in the amount of $22,000.00 to the Texas Department of Criminal Justice for the purchase of a water tank for a water truck. On motion by Commissioner Wassermann, seconded by Commissioner Cauley, the Court voted unanimously to approve the requisition. The next matter for consideration was the renewal of the following bids: a) Bid 2009 -01, Hot Mix Asphalt, with Knife River Corporation -South Charles Wendt, Assistant Purchasing Agent recommended renewal of the bid with the new bid number of 2010 - 28R. b) Bid 2009 -25, Fence Building, with Hovorak Fence Construction Leslie Williams Senior Buyer, recommended renewal of the bid with the new bid number of 2010- 10 -20R On motion by Commissioner Wassermann, seconded by Commissioner Cauley, the Court voted unanimously to approve the renewal of both bids. The Court next considered acceptance of a Special Warranty Deed for right -of -way on Old Reliance Road in Precinct 2. On motion by Commissioner Peters, seconded by Commissioner Wassermann, the Court voted unanimously to authorize the County Judge to accept on behalf of Brazos Vol l 3 1 Page aq j Commissioners Court meeting February 23, 2010 8 County a Special Warranty Deed from Emma Lorene Law Carroll for the expansion and improvements to Old Reliance Road. The Court next considered acceptance of a Special Warranty Deed for right -of -way on Old Reliance Road in Precinct 2. On motion by Commissioner Peters, seconded by Commissioner Wassermann, the Court voted unanimously to authorize the County Judge to accept on behalf of Brazos County a Special Warranty Deed from Wilburn C. Coe Trust A for the expansion and improvements to Old Reliance Road. Prepares Court packets for all members of the Commissioners Court, and prepares the Court's permanent file for each Court date. Attends Commissioners Court meetings and provides reference assistance for files and documents. Writes resolutions, proclamations for the County Judge and Commissioners Court. Distributes Court documents to the appropriate office(s) after they have received Commissioners Court approval. Attends Attorney General of Texas conferences on the Public Information Act, and other continuing education opportunities.
