Adjourn ['30 P l 5 Vol. _._._ -- g• Commissioners Court Agenda 19 January 2010 Page 3 PUBLIC COMMENTS Public Comment during the Commission Meeting may be for all matters, both on and off the agenda, and be limited to four minutes per person. Persons are invited to submit comments in writing on the agenda items and/or attend and make comment at the Commission meeting. Members of the public are reminded that the Brazos County Commissioners Court is a Constitutional Court, with both judicial and legislative powers, created under Article V, Section I and Section 18 of the Texas Constitution. As a Constitutional Court, the Brazos County Commissioners Court also possesses the power to issue a Contempt of Court Citation under Section 81.024 of the Texas Local Government Code. Accordingly, members of the public in attendance at any Regular, Special and/or Emergency meeting of the Court shall conduct themselves with proper respect and decorum in speaking to, and/or addressing the Court; in participating in public discussions before the Court; and in all actions in the presence of the Court. Those members of the public who are inappropriately attired and /or who do not conduct themselves in an orderly and appropriate manner will be ordered to leave the meeting. Refusal to abide by the Court's Order and /or continued disruption of the meeting may result in a Contempt of Court Citation. It is not the intention of the Brazos County Commissioners Court to provide a public forum for the demeaning of any individual or group. Neither is it the intention of the Court to allow a member (or members) of the public to insult the honesty and/or integrity of the Court, as a body, or any member or members of the Court, or County employees, individually or collectively. Accordingly, profane, insulting or threatening language directed toward the Court and/or any person in the Court's presence and/or racial, ethnic or gender slurs or epithets will not be tolerated. Violation of these rules may result in the following sanctions I . cancellation of a speakers time; 2. removal from the Commissioners Court; 3. a Contempt Citation; and/or 4. such other and/or criminal sanctions as may be authorized under the Constitution, Statutes and Codes of the State of Texas. The County Commissioners Court can deliberate or take action only if a matter has been listed on an agenda properly posted prior to the meeting. During the public comment period, speakers may address matters not listed on the published agenda. The Open Meeting Law does not expressly prohibit responses to public comments by the Commissioners Court. However, responses from the County Judge or Commissioners to unlisted public comment topics could become deliberation on a matter without notice to the public. To ensure the public has notice of all matters the Commissioners Court will consider, the County Judge and/or Commissioners may choose not to respond to public comments, except to correct factual inaccuracies, recite existing policy in response to an inquiry or to ask that a matter be listed on a future agenda. See Texas Open Meetings Act §551.042. The County Administration Building is wheelchair accessible. Handicap parking spaces are available. I !! /`.l COMMISSIONERS' COURT REGULAR MEETING JANUARY 19, 2010 A regular meeting of the Commissioners' Court of Brazos County, Texas was held in the Commissioners Courtroom in the Brazos County Administration Building, 200 South Texas Avenue, in Bryan, Brazos County, Texas, beginning at 6:00 p.m. on Tuesday, January 19, 2010 with the following members of the Court present: Randy Sims, County Judge, Presiding; Lloyd Wassermann, Commissioner of Precinct 1; Duane Peters, Commissioner of Precinct 2; Kenny Mallard, Commissioner of Precinct 3; Irma Cauley, Commissioner of Precinct 4; Karen McQueen, County Clerk, Absent. The attached sheet contains the names of the citizens and officials that were in attendance. Commissioner Peters gave the invocation and led the pledge of allegiance. There was no citizen input /and or concerns. The first matter before the Court was Budget Amendment #09/10 -14.1 through 14.3, that would reallocate funds for the County Court at Law #1, Health & Life Fund; transfer funds from Contingency to Sheriff's Office -Jail Division. On motion by Commissioner Cauley, seconded by Commissioner Peters, the Vol 130 Page IT) ) Commissioners Court meeting January 19, 2010 2 Court voted unanimously to approve the budget amendment as submitted, a copy of which is attached. The Court proceeded to consider the change of status of employees as submitted on the attached Personnel Action Requests. On motion by Commissioner Wassermann, seconded by Commissioner Peters, the Court voted unanimously to approve the change of status as submitted. The next matter before the Court was consideration of a payment authorization in the amount of $47,320 to Milam County for the housing of inmates for December 2009. A purchase order was not obtained in advance. On motion by Commissioner Peters, seconded by Commissioner Mallard, the Court voted unanimously to approve the payment authorization. The Court next considered the following Claims as submitted by the County Treasurer for payment: 7070074 through 7070346 on motion by Commissioner Peters, seconded by Commissioner Cauley, the Court voted unanimously to approve the Claims as submitted. The next matter before the Court was a request from Mike Duncum to amend the current TIRZ 22 project and finance plan to include projects and costs associated with the development of the currently vacant land within the existing zone boundary, Vol L30 Page CH Commissioners Court meeting January 19, 2010 3 located to the south of the existing Bryan Towne Center. Commissioner Peters stated that the company is willing to build and then get reimbursed. He said it was a good project. On motion by Commissioner Peters, seconded by Commissioner Mallard, the Court voted unanimously to the Court voted unanimously to approve the amendment to the current TIRZ 22 Project and Finance Plan and authorized the County Judge to execute the document. A copy is attached. The next matter for consideration was a donation agreement between Brazos County and the Brazos Transit District for the donation of two (2) 2000 AeroLite Navastar buses. The County Judge move to approve the agreement. Tina Snelling, Civil Counsel asked the Court to remove this from the agenda to allow time to review. There was no second to the motion so the County Judge withdrew his motion for approval. Then on motion by the County Judge, seconded by Commissioner Cauley, the Court voted unanimously to remove this item from the agenda. The Court next considered a contract with Voices for Children, Inc. for Guardian ad litem services for Fiscal Year 2010. Voices for Children will be paid by the county at a rate of $20 per hour up to but no more than $250 for services of a court appointed Guardian ad litem per child attending court proceedings and /or acting pursuant to court orders. On motion Vol t'50 Page (`JC1 Commissioners Court meeting January 19, 2010 4 by Commissioner Wassermann, seconded by Commissioner Cauley, the Court voted unanimously to approve the contract with Voices for Children and authorized the County Judge to execute the document. A copy is attached. The next matter for consideration was an Agreement between Brazos County and the Dispute Resolution Center - Central Brazos Valley, Inc. (DRC) to provide a maximum of four (4) separate mediation sessions to the Commissioners or designated department of offices of Brazos County during the term of the agreement. Commissioner Mallard asked about free mediation services and if the other offices are utilizing this service. The term of the agreement is from January 1, 2010 through December 31, 2010 and with a cost of $7,500. On motion by Commissioner Cauley, seconded by Commissioner Peters, the Court voted unanimously to approve the Agreement and authorized the County Judge to execute the document. A copy is attached. The County Judge read aloud a Proclamation honoring fourteen (14) individuals for their significant contributions to the Brazos Valley African American Museum. On motion by Commissioner Cauley, seconded by the County Judge, the Court voted unanimously to recognize the following individuals for their significant contribution to the Brazos Valley African American Museum: Vol L 3 o Page L 8 D Commissioners Court meeting January 19, 2010 a. On motion by Commissioner Peters, seconded by Commissioner Cauley, the Court voted unanimously to receive, approve and order filed as submitted the Treasurer's report for November 2009. The next matter for consideration was approval of tax refund applications from the following individuals and /or companies: a) Rosie Mae Davis, over payment $50.00 b) Stephen F. & Jana Crouse, overpayment $30.00 c) Yellow Rose Mobile Home Sales, over payment $131.45 On motion by Commissioner Wassermann, seconded by Commissioner Peters, the Court voted unanimously to approve the tax refund applications. Vol 13 0 Page t 9l Commissioners Court meeting January 19, 2010 The Court next considered awarding Bid 2010 -14, Installation of Cabling at Jail Addition. Charles Wendt, Assistant Purchasing Agent and the Information Technology Department recommended acceptance of the bid submitted by Carroll Systems. On motion by Commissioner Cauley, seconded by Commissioner Peters, the Court voted unanimously to accept the recommendation of the Assistant Purchasing Agent and the Information Technology Department and award the contract to Carroll Systems. A copy is attached. The Court next considered authorizing work outside of county rights -of -way for the health, safety and welfare of the general public. The Road and Bridge Department requested permission to enter the private property of James Sanders' on Kurten Cemetery Road in Precinct 2 to take down a dead tree that could possibly fall across the road. On motion by Commissioner Peters, seconded by Commissioner Wassermann, the Court voted unanimously to authorize the work. The next matter for consideration was a request from Global Geophysical Services to lay seismic cables across the following Brazos County roads: a. Old Bundick b. Old Bundick Crossing c. Williams d. Macey The project is scheduled to begin the second week in February and will take approximately 3 weeks to complete. On motion by Commissioner Peters, seconded by Commissioner Wassermann, the Court voted unanimously to approve the request. A copy of the site map can be viewed at the Road and Bridge Department on Highway 21 West. There were no announcements of interest items and possible future agenda topics. Under citizen input and /or concerns the following spoke: Chief Deputy Mike Wilson a) There are 509 inmates in jail, 31 are in out of county jails, 53 are on electronic monitoring and 37 are pending for electronic monitoring. Under Agency /Board /Committee reports by Court members, the following spoke: Commissioner Mallard a) Reported on the Brazos Ground Water Group meeting that both he and Commissioner Peters attended. Scope of Work — TIF Infrastructure CenterPoint —186 Acre Commercial Development Project Summary CenterPoint is a 186 acre multi -use planned development located along State Highway 6 Bypass in the City of Bryan. The project is being developed by The Duncum Group. Briar Creek is located on the northern boundary of the site and Carters Creek is located along the eastern boundary. The Target anchored Bryan Town Center shopping center being developed by Lauth Property Group is located to the north of the site. The proposed CenterPoint project plans to extend Wildflower Drive from the Bryan Town Center project to the south through the site and ultimately connecting with the proposed Oak Hill Drive which will extend to the State Highway 6 Bypass frontage road. The proposed Oak Hill Drive alignment has been set to allow for a future connection to the residential subdivision to the east and a potential bridge crossing over State Highway 6 Bypass to the west. The proposed Master Plan illustrates that approximately 30 Lots can be accommodated on the site with a mixture of retail, restaurants, hotels, office, and multi - family uses. These uses can provide over 500,000 square feet of space that will generate both property and sales tax for the community. The proposed plan calls for filling in a portion of the floodplain area located on the 186 acre property. The floodway line shown on the plans is the line provided by Mitchell & Morgan as part of their floodway study for the City in 2008. Similar to what was done for Bryan Towne Center; two lakes are proposed within the floodway that are intended to provide a source of fill material for the site and also help provide a means for additional flood relief and aesthetic interest for the property. The floodway area which totals approximately 68 acres is intended to be conveyed to the City, which can be used as greenway system for the City in the future. In addition, a 950 foot segment of Oak Hill Drive is proposed with a roundabout at the intersection of Wildflower Drive. The roundabout is placed such that a future connection to the subdivision to the east can be completed by the City. A small unnamed tributary bisects the center of the site from Highway 6 Bypass. A box culvert is proposed to convey the drainage from Highway 6 Bypass across Wildflower Drive to the east of the public road. Storm drainage from the public streets will be collected in curb inlets and piped to the adjacent creek network. The northern proposed lake is intended to fill the future development site located east of Wildflower Drive, while the southern lake is intended to fill the area around the existing oil well. Vol. 13 0 P9 ------ Scope of Work — TIF Infrastructure CenterPoint — 186 Acre Commercial Development Water Main Construction The proposed water main network is intended to tie into the existing 12" water mains located along State Highway 6 Bypass and along Wildflower Drive at Bryan Towne Center. From the connection points a proposed 12" water main will run along Wildflower Drive, Oak Hill Drive, and the frontage of Highway 6 Bypass. By extending the water main in this fashion, the system will be "looped" and should provide adequate pressure and flows for future users. In accordance with local standards, a total of 17 fire hydrants are proposed along the main extension. Future users will then be able to service the water main once individual sites are developed. Utility Construction In order to provide adequate service to future users, accommodations for utility construction are proposed. Electrical conduit is proposed along the public roads to provide site lighting and future electrical demand. It is intended that Bryan Texas Utilities (BTU) will pull the primary wiring and set the street light poles similar to what was done at the Bryan Towne Center project. Extending the natural gas service along the public roads is proposed off of the existing gas main located along State Highway 6 Bypass. A sanitary sewer main and manhole is proposed to extend across Wildflower Drive to service the future development lot east of Wildflower. This sanitary extension is proposed so that future development of this lot does not damage the proposed Wildflower Drive extension after it is completed. It is assumed that the future users west of Wildflower Drive can connect to the existing sanitary sewer as future development plans dictate. Amenities An allowance was provided for park amenities that could be used for walking trails, benches, or signage along the future greenway park located within the floodway area. The City could use these funds as deemed appropriate. General Certificate Vol. 130 pg ) 50 SPECIAL ROAD USE INDEMNITY AGREEMENT AND PERMIT THE STATE OF TEXAS KNOWN ALL MEN BY THESE COUNTY OF BRAZOS PRESENTS The undersigned, hereinafter called Applicant, enters into and makes this agreement with the Commissioners Court of Brazos County, Texas, pursuant to Article 623.018 of the Texas Transportation Code, in order to obtain a permit to use public roads and bridges in Brazos County, Texas, for vehicles or combinations of vehicles that have gross weight greater than thirty thousand (30,000) pounds or a weight greater than ten thousand (10,000) pounds carried on any one axle. I VEHICLES means any vehicles, tractor or combination of vehicles, with our without loads, that have a gross weight greater than thirty thousand (30,000) pounds or a weight greater than ten thousand (10,000) pounds carried on any one axle, and includes any such vehicles operated by Applicant or its agents, employees, servants or independent contractors in the course of Applicant's business. II It is understood and agreed that the provisions of this agreement apply to Applicant's vehicles operation on any Brazos County road, whether with or without a permit. Applicant hereby agrees that it is its responsibility and obligation to determine (1) the weight limits for any roads traveled by Applicant's vehicles and (2) the strength and design sufficiency of the roads and bridges and culverts on the roads to carry and withstand the weight of Applicant's vehicles traveling on the roads. loll Applicant hereby agrees to report any such damage immediately to the County Commissioner of the precinct where the damage occurred. To immediately repair any such damage to the satisfaction of said Commissioner and to keep such damaged road open to the traveling public eye at all times. If Applicant fails to repair any such damages in the described manner upon five (5) days written notice to Applicant at the address shown on this agreement, Applicant shall pay Brazos County for the actual cost of repairing any such damages as specified by the County Commissioner in whose precinct the damages occurred. VOL a- Applicant hereby agrees that his failure to either repair any such damaged or pay the cost of repairing any such damages as described, within thirty (30) days after billing to Applicant at the address shown on this agreement, shall be grounds for the Brazos County Commissioners Court to revoke Applicant's permit hereunder without hearing, and to immediately file suit for such damages. Applicant hereby agrees that venue for any such suit lies in Brazos County, Texas. IV. Any violation of this "Special Road Use Indemnity Agreement and Permit" by undersigned Applicant, its employees, or anyone action on its behalf, may result in its temporary suspension by the County Commissioner of the precinct in which the road agreement applies. In the event of such temporary suspension, the Commissioners Court shall, at its next regularly scheduled meeting, and after notice to the undersigned Applicant, determine whether to reinstate, or revoke this road use agreement and permit. V. Applicant hereby agrees that once a permit has been suspended or if Applicant operates vehicles on county roads without a permit, damages are not an adequate remedy at law for the enforcement of Brazos County's rights, and the Brazos County may maintain an action for injunctive relief to prohibit Applicant's vehicles from using any Brazos County roads without a permit. Applicant further agrees that Brazos County shall be held harmless for any actual, incidental, consequential or other damages Applicant may suffer as a result of any action of Brazos County involving any such injunctive relief. Applicant hereby agrees that no action or inaction by Brazos County shall be considered an election of its rights and remedies, and Brazos County is free to seek all remedies available at law or inequity to enforce its legal rights or the terms of this agreement. W To insure performance of this Agreement, the Applicant hereby agrees to do one of the following: 1. Post a surety bond in the amount of $1,000,000.00 valid for 12 months. 2. Post a surety bond in an amount to be set by the Commissioner in whose precinct the Applicant will be operation (but not less that $40,000.00), valid for 90 days. 3. Provide a commercial umbrella liability insurance policy in the amount of at least $1,000,000.00 valid for 12 months. All surety bonds and umbrella liability insurance policies shall meet the requirements as set out in Exhibit No. 1 attached hereto; and shall be approved by Commissioner Court before any permit is issued under this agreement. E3i =1T 1 1. The bond or insurance policy must be written by an insurance company licensed to do business in the State of Texas. 2. The bond to be set by the Commissioner(s) whose precinct the Applicant will be Operating shall be sufficient to guarantee the payment of any damage to a road or bridge as a consequence of the road use, but no less than $40,000.00. 3. The bond amount must also be sufficient to cover all damages which might be incurred during the tern of the bond. 3. The bond shall be payable to Brazos County, Texas 4. The bond shall be conditioned that the applicant will pay Brazos Count, Texas for any damages that might be sustained to any county roads or bridges because of the movement of applicant's vehicles on such roads or bridges.
