IN THE COMMISSIONERS COURTROOM OF THE COUNTY ADMINISTRATION BUILDING, 200 SOUTH TEXAS AVENUE, SUITE 106, BRYAN, TEXAS. THE COURT WILL HEAR COMMENTS ON THE REVISED BRAZOS COUNTY ANIMAL CONTROL ORDINANCE, WHICH IS AVAILABLE FOR PUBLIC REVIEW ON THE COUNTY'S WEBSITE AT http : / /www.ca.brazos.ttus. ALL INTERESTED PERSONS ARE INVITED TO ATTEND SAID HEARING AND PRESENT THEIR CAUSE, IF ANY, FOR OR AGAINST THE REVISED BRAZOS COUNTY ANIMAL CONTROL ORDINANCE. I COMMISSIONERS' COURT PUBLIC HEARING NOVEMBER 17, 2009 The Commissioners' Court of Brazos County, Texas held a Public Hearing in the Commissioners Courtroom of the Brazos County Administration Building in Bryan, Brazos County, Texas, beginning at 6:30 p.m. on Tuesday, November 17, 2009, with the following members of the Court present: Randy Sims, County Judge, Absent; Lloyd Wassermann, Commissioner of Precinct 1; Duane Peters, Commissioner of Precinct 2, Presiding; Kenny Mallard, Commissioner of Precinct 3; Irma Cauley, Commissioner of Precinct 4; Karen McQueen, County Clerk, Absent. Attached is a list of the citizens and officials in attendance. The purpose of the hearing is to hear commentary on the revised Brazos County Animal Control Ordinance. Commissioner Wassermann began by giving a history of the animal control ordinance pointing out the following: Section 1.4 Municipal Ordinance supersedes. The County cannot enforce all that the cities are doing. Although they would like to they just can't do it. Section 2.16 Definition of farm livestock - Address Dangerous Dogs Section 9.1 Standard Care Vol Iaq Page a_ He then opened the floor for questions. Della Carroll asked about chaining a dog whereupon she was informed by Commissioner Wassermann that it was not included up to this point. They were still looking at that situation and will get with animal control. Ms. Carroll asked about dogs riding loose in the back of a truck. That is addressed in Section 13 Leash Law. Commissioner Wassermann then addressed a handout on the things Animal Control would like changed. For example: Section: 8.1 Animal at large, generally stray animals. Commissioner Wassermann asked Animal Control to defend their position. The Commissioner thinks that the wording needs a drastic change. The Sheriff address concerns that his department would be overburdened chasing ever animal not on a leash. He needed clarification on what a stray is. Chris Fraley, Sheriff Deputy spoke requesting a word change where the owner takes responsibility dealing with his /her animal and not burdening the Animal Shelter. There was much discussion on the term nuisance. Commissioner Peters discussed the wording of a complaint that triggers a nuisance complaint. He said he'd look at the wording. The Sheriff liked the idea of a complaint process. Vol 1 a Page 3 There was considerable discussion about Animal Control Officers having to witness nuisance acts but this is necessary for a criminal citation. Commissioner Wassermann stated that this was not a final document and it can still be modified. Bill Jeanes asked about having microchips but no collars. Animal control officers replied that they have a reader. Sharon Anderson wanted language in the ordinance that a chip would count as a tag and asked about also requiring a county tag. Mike Wheeler asked about Section 5.1 and 5.2 that deal with Rabies Vaccination and a Certificate of Vaccination. Della Caroll asked Animal Control if her dog were chasing cattle can they shoot it whereupon the officers replied that yes they could. She then asked about suing and winning in Court. These were two different matters being criminal and civil. But if it is a criminal matter, the owner has the right to shoot. Sandra Dozier asked about fees and Commissioner Wassermann replied that the fees would be the ones that are in place right now. Charlie Ellis was concerned with any ordinance that doesn't discuss the outcome of impoundment. He commented the Shelter is too quick to euthanize. He is very concerned about Vol lag Page 4 the high rate of euthanasia in our current shelter. Commissioner Peters said this hearing deals with animal control in the county but Mr. Ellis's concerns would be addressed in the contract with the Animal Shelter. Mike Southerland with the City of Bryan said there was a discrepancy in Section 8.3 with Bryan on the number of days an animal would be impounded. He thinks the Court needs to identify or define this more clearly. Commissioner Wassermann thanked all those in attendance for their interest. There being no further comment, Commissioner Peters declared the Public hearing closed.
