IN THE COMMISSIONERS COURTROOM OF THE COUNTY ADMINISTRATION BUILDING, 200 SOUTH TEXAS AVE., SUITE 106, BRYAN, TEXAS. 1. Call to Order. 2. Proposed revisions to the rules and regulations for culverts and driveways on County roads. 3. Proposed revision to the rules and regulations for brick/stone mailboxes. 4. Adjourn. Office of the County Judge • 300 Eal 'tit. • Suite 114 • .- qap, Texas 77803 • Fax: (979) 361 -4503 Vol. b P O< `Y d°, COMMISSIONERS' COURT WORKSHOP SESSION NOVEMBER 10, 2009 The Commissioners' Court of Brazos County, Texas met in a Workshop Session in the Commissioners' Courtroom in the Brazos County Administration Building in Bryan, Brazos County, Texas, beginning at 10:00 a.m. on Tuesday, November 10, 2009 with the following members of the Court present: Randy Sims, County Judge, Presiding; Lloyd Wassermann, Commissioner of Precinct 1; Duane Peters, Commissioner of Precinct 2; Kenny Mallard, Commissioner of Precinct 3; Carey Cauley, Jr., Commissioner of Precinct 4; Karen McQueen, County Clerk, Absent. Attached is a list of the citizens and officials in attendance. The Commissioner's Court met to discuss two items. The first was revisions to the rules and regulations for culverts and driveways on County roads. Commissioner Wassermann started by pointing out the proposed changes. Commissioner Mallard asked how we would enforce these. Commissioner Wassermann replied that as the violations are detected, letters will be sent out. Commissioner Mallard asked legal Counsel, Bill Ballard what liability the County would have. Mr. Ballard replied that the landowner would be Vol Jar Page 0)43 Commissioners Court Workshop November 10, 2009 2 primarily responsible because they were the ones violating the ordinance. The county, he said, had immunity. That doesn't mean we can't get sued. Katie Conner, County Auditor questioned if the Road and Bridge Department would be collecting fees. Gary Arnold, Planning Director for the Road and Bridge Department asked if the County Clerk could collect the fees and file the permits. Katie Conner, County Auditor said procedures my need to change if the Road and Bridge Department collects money. They have been robbed several times in the past. Ms. Conner then went on to suggest a flat fee for removing driveways rather than actual costs and can be re- evaluated annually. The Court then proceeded to consider the proposed revision to the rules and regulations for brick /stone mailboxes. Commissioner Wassermann suggested that any brick /stone mailboxes along a road where the speed limit exceeds 35 mph be removed. Commissioner Peters said the Court also needs to take a look at the mailbox posts the county has been providing. According to the TxDOT safety video he watched the county could be in non - compliance. Commissioner Mallard suggested going with what the state mandates. Vol i ax Page a y Commissioners Court Workshop November 10, 2009 3 There was lengthy discussion on how to enforce regulations concerning mailboxes in the right -of -way. Commissioner Peters stated that the county needed to replace the mailbox posts to get back into compliance before asking the homeowners to change their mailboxes. Gary Arnold, Planning Director for the Road and Bridge Department suggested amending the Subdivision and Development Regulations to state that the Road and Bridge Department will install mailboxes. If the homeowner puts up the mailbox the Road and Bridge Department will remove it.
