VOL 149 PAGE all COMMISSIONERS' COURT REGULAR MEETING SEPTEMBER 30, 2003 A regular meeting of the Commissioners' Court of Brazos County, Texas was held in the Brazos County Commissioners Courtroom in the Courthouse in Bryan, Brazos County, Texas, beginning at 9:00 a.m. on Tuesday, September 30, 2003 with the following members of the Court present: Randy Sims, County Judge, Presiding; Tony Jones, Commissioner of Precinct 1; Duane Peters, Commissioner of Precinct 2; Kenny Mallard, Commissioner of Precinct 3; Carey Cauley, Jr., Commissioner of Precinct 4; Karen McQueen, County Clerk. The attached sheet contains the names of the citizens and officials that were in attendance. Commissioner Cauley gave the invocation and led the pledge of allegiance. There was no citizen input/and or concerns On motion by Commissioner Peters, seconded by Commissioner Cauley, the Court voted unanimously to receive, approve and order filed as submitted the Treasurer's report for August 2003. A copy of which is attached to and made a part of these minutes. The Court next considered the reclassification of a Secretary position in the County Attorney's office. VOL y€r PAGE ai a Commissioners Court meeting September 30, 2003 2 Commissioner Cauley moved to approve the reclassification. Commissioner Mallard seconded the motion. After some very lengthy discussion, Commissioner Jones moved to table discussion until the County Attorney provided additional information. Commissioner Peters seconded the motion and it passed unanimously. The Court next considered the following Claims as submitted by the County Treasurer for payment: 20046190 through 20046401 On motion by Commissioner Peters, seconded by Commissioner Mallard, the Court voted unanimously to approve the Claims as submitted. On motion by Commissioner Cauley, seconded by Commissioner Peters, the Court voted unanimously to authorize the County Judge to. execute a Tax Resale Deed to the following individuals: Richard Manley and Sindy Manley - Lot 23, Lakewood Estates Subdivision, Brazos County, Texas. The next matter before the Court was the designation of the day of the week and location for Commissioners Court to convene in regular session each month during the next fiscal year. The County Judge moved to convene in regular session each Tuesday at 9:00 a.m. with the exception of the third VOL 4 ff PAGE a 3 Commissioners Court meeting September 30, 2003 3 Tuesday of each month in which the meeting will be held at 6:30 p.m. at the Brazos Center. The motion was seconded by Commissioner Peters. The Court voted unanimously to approve the designation of meeting date and time and also approved the cancellation of the October 7t° Commissioners Court meeting. The next matter before the Court was approval of the proposed Departmental Discretionary Expenditure Account policy. On motion by the County Judge, seconded by Commissioner Peters, the Court voted unanimously to approve the proposed Discretionary Expenditure Account policy. A copy is attached. The Court next considered approval of the proposed Procedures for Merit Pay. The County Judge moved to approve the procedures. Commissioner Cauley seconded the motion. After a very long discussion Commissioner Peters moved to table consideration. Commissioner Mallard seconded the motion. The Sheriff pointed out that if you go by these guidelines, a person could be promoted but receives a pay reduction. The County Auditor replied that the merit funds would stay with the position and become the entry-level salary. Commissioners Jones, Peters, Mallard and the County Judge voted "Aye". Commissioner Cauley abstained. The motion carried. There will a workshop, Friday, October 3, 2003. VOL a PAGE ;U4 Commissioners Court meeting September 30, 2003 q The Court then went back to item #5 that was the reclassification of a Secretary position in the County Attorney's office. The County Attorney brought back information that the District Attorney had a comparable secretary classified at a Group 15. On motion by Commissioner Jones, seconded by Commissioner Mallard, the Court voted unanimously to remove this item from the table. Then on motion by Commissioner Jones, seconded by Commissioner Cauley, the Court voted unanimously to amend the first motion to approve the position at a Group 15 rather than a Group 17. The Court next considered approval of the Salary Schedule for FY 2004. On motion by Commissioner Jones, seconded by Commissioner Peters, the Court voted unanimously to approve the Salary Schedule. A copy is attached. The next matter before the Court was the approval of the Brazos County payroll for FY 2004. On motion by Commissioner Mallard, seconded by Commissioner Cauley, the Court voted unanimously to approve the payroll in the amount of $29,017,000.00. The Court next considered Adopting an Order directing the money that otherwise would be deposited in a salary fund be deposited in the general fund of Brazos County. On motion by VOL ~t PAGE a s Commissioners Court meeting September 30, 2003 5 the County Judge, seconded by Commissioner Cauley, the Court voted unanimously to adopt the Order. The Court proceeded to consider the change of status of employees as submitted on the attached Personnel Action Requests. On motion by Commissioner Cauley, seconded by Commissioner Peters, the Court voted unanimously to approve only the regular personnel changes as submitted. Then on motion by the County Judge, seconded by Commissioner Peters, the Court voted unanimously to table all changes of status involving merit increases. The Court next considered renewal of the Software Support Agreement with SunGard Pentamation for the Informix Software for FY 2004. On motion by Commissioner Cauley, seconded by Commissioner Peters, the Court voted unanimously to approve the renewal of the agreement at a cost of $8,272.00. The next matter before the Court was the renewal of the Software Maintenance Agreement for FY 2004 with The Software Group (TSG) for Universe database licenses. On motion by Commissioner Cauley, seconded by Commissioner Peters, the Court voted unanimously to approve the renewal of the agreement at a cost of $13,717.48. VOL 114,y PAGE Commissioners' Court meeting September 30, 2003 6 The Court next considered the renewal of the Printer Service Agreement for FY 2004 with Peak Technologies. On motion by Commissioner Cauley, seconded by Commissioner Peters, the Court voted unanimously to approve the renewal of the agreement at a cost of $1,462.68. The Court next considered the renewal of the Novell Master License Agreement for FY 2004. On motion by Commissioner Cauley, seconded by Commissioner Peters, the Court voted unanimously to approve the renewal of the agreement at a cost of $19,968.76. The Court next considered approval of contract for FY 2004 with the following agencies: a. Boys & Girls Clubs of Brazos Valley b. Brazos Family Medicine Residency a maximum of $100,000 C. Keep Brazos Beautiful, Inc. $16,500 d. Brazos Maternal & Child Health Clinic $70,000 e. Retired & Senior Volunteer Program $2,500 f. Brazos County Soil & Water District $5,500 g. Dispute Resolution Center $5,000 h. Rape Crisis Center $18,000 i. Brazos Valley Community Action Agency, Inc. (Dental Clinic) On motion by Commissioner Peters, seconded by Commissioner Cauley, the Court voted unanimously to approve contracts A through I. A copy of each is attached. Pat Howard, Purchasing Agent, made the following recommendations: Primary Vendor: Young Contractors Secondary Vendor: Texcon On motion by Commissioner Jones, seconded by Commissioner Mallard, the Court voted unanimously to accept the recommendations of the Purchasing Agent and award the contract as noted. A copy of the bid tabulation is attached. b. Bid No. 2003-048, Culverts, various types Becky Stephens, Senior Buyer made the following recommendations: Wilson Culverts - items 1-11, 13-22, & 24-32 Progress Supply - items 12-14 & 37-39 Contech Construction - item 23 On motion by Commissioner Jones, seconded by Commissioner Peters, the Court voted unanimously to accept the recommendations of the Senior Buyer and award the contract as noted. The Court next considered acceptance of the Wellborn Supply Utility District's cost estimate of $8,073.00 to relocate approximately 600 feet of water line in the new Jones-Butler Road (I&GN Rd.) right of way in Precinct 1. On motion by Commissioner Jones, seconded by Commissioner Cauley, the Court voted unanimously to accept the Wellborn Supply Utility District's cost estimate of $8,073.00 for relocation of water line along Jones-Butler Road. The Court next considered the request from Verizon to construct two road bores and approximately 567 feet of buried communications cable installations in the right- of-way of Cain Road to accommodate the new Jones-Butler Road (I&GN) construction. The site is located in Precinct 1. The County Engineer stated that all appeared to be in order and recommended approval. On motion by Commissioner Jones, seconded by Commissioner Peters, the Court voted unanimously to approve the request by Verizon and authorized the installation. On motion by Commissioner Jones, seconded by Commissioner Cauley, the Court voted unanimously to accept the Brazos Utility Service's cost estimate relocation of sewer lines along Jones-Butler Road. The Court next considered the request from Wickson Creek Special Utility District to construct a road bore for waterline installation in the right-of-way of Boatcallie Road approximately 0.3 mile from its intersection with FM 974. The site is located in Precinct 2. The County Engineer stated that all appeared to be in order and recommended approval. On motion by Commissioner Peters, seconded by Commissioner Cauley, the Court voted unanimously to approve the request from Wickson Creek Special Utility District and authorized the installation. The Court next considered acceptance of a Warranty Deed for the purchase of three (3) acres to be used by Road & bridge for inventory of materials and parking of equipment. The site is in Precinct 1. On motion by VOL to PAGE aao Commissioners' Court meeting September 30, 2003 10 Commissioner Jones, seconded by Commissioner Peters, the Court voted unanimously to authorize the County Judge to accept on behalf of Brazos County a Warranty Deed from Edsel Jones. Funding will come from the right-of-way acquisition line item in the Road and Bridge budget. The next matter before the Court was the authorization for use of Contingency to complete County Court at Law No. 2 renovations. There are six (6) items at a cost of $2,210.00. On motion by Commissioner Jones, seconded by Commissioner Mallard, the Court voted unanimously to approve the use of Project Contingency to complete all six (6) items for the renovations for County Court at Law II. The Court next considered approval of the minutes of the Commissioners' Court meetings held in July 2003 on the following dates: Regular Meetings - 1st, $th 15tH 22nd 29tH Public Hearing - 15th On motion by Commissioner Mallard, seconded by Commissioner Cauley, the Court voted unanimously to approve the minutes as submitted. The entire idea of the DDEA is to encourage the elected officials and department heads to be entrepreneurial in their approach to both budgeting and managing of their department. Each department has been provided "seed money" based on the formula of $200 per each full time equivalent position in the department. For example a department with 6 full time employees (including the elected official) and one three quarter time employee would be calculated at $200 X 6.75 = $1,350. Elected officials and department heads would be able to spend from their DDEA account with limited approval requirements, through the use of budget amendments (transfers to another classification). The DDEA account may not be used to charge expenditures against. All expenditures must comply with county policy and procedures and with the classification system established by the County Auditor. The initial year seed money is the only money that the Commissioner's Court intends to provide for the DDEA. The individual accounts in each department may be increased in several ways: 1. The department may wish to reduce another area of appropriation and transfer the residual into the DDEA. 2. The department may create a revenue initiative that develops a new source of cash flow for the County. 3. The department may initiate a management decision that results in reduced cost to the County. 4. The department may elect to eliminate a position, and excess funds would flow into the department's DDEA. All resulting savings would be shared with the taxpayers on a 50/50 basis. Half of all savings would be credited back to the department's DDEA. The other half would flow through to the fund balance for use in future years. The DDEA is not a use it or lose it program. Any unused balance as c4ulated at the end of the fiscal year will be brought over to the following fiscal year. The DDEA is a full discretionary account. However, it may not be used to provide salary increases. The value of the expenditure savings will only be calculated on the controllable expenditures. The DDEA will not be available to the County Judge nor the County Auditor. (hereinafter "Provider"), located at 504 East 27'b Street, Bryan, Texas 77803 RECITALS: WHEREAS, the County is obligated to provide for the health and safely of its citizens; and WHEREAS, the County is responsible to a degree for the support of the County's poor; and WHEREAS, the residents of Brazos County are not served by a public hospital or hospital district; and WHEREAS, the County, pursuant to the Indigent Health Care and Treatment Act, Health and Safety Code, § 61.001 et seq. (the "Act"), is authorized to provide certain Dental Services to the County's indigent population, including but not limited to dental care, laboratory and x-ray services and physician services; and WHEREAS, the County, pursuant to the Act, has authority to contract with a private facility for the provision of such services; and WHEREAS, the Provider, has established a clinic to provide such services to the County's indigent and poor residents; and WHEREAS, the parties hereto believe that a Contract for services between them can be mutually beneficial. NOW THEREFOR KNOWN ALL MEN BY THESE PRESENTS that for and in consideration of the mutual benefits herein described, the parties agree as follows: TERM This Contract shall commence on the I" day of October, 2003 and terminate on the 30`s day of September, 2004 (the "Contract Term"). This Contract may be canceled by either party hereto upon sixty-(60) days written notice as provided herein. Make a determination, based upon County approved standards, that the applicant qualifies for Dental Services hereunder. 4. Maintain this Contract. 5. Maintain data files on clients and the Dental Services provided thereto. 6. Respond to all and any inquires by the County regarding the Clinic and it's services. 7. Assist the County with information needed for audit purposes. 8. Provide the County with quarterly financial statements. 9. Provide the County with any and all certified audits of Provider and the management letter prepared in connection therewith. 10. Provide financial statements evidencing how County funds are spent. Provide the Court with statistics evidencing the number of Brazos County residents Using the Provider's Services and the percentage Brazos County residents comprise of the total population using Provider's Services. RESPONSIBILITY OF COUN'T'Y The County shall be responsible for the following duties and requirements: 1. Fund its monetary commitment as stated herein. 2. Conduct a review of the Provider's performance in providing the Dental Services and Administrative Services to be provided hereunder in order to assess County's continued participation in the funding of the Provider and to verify Provider's compliance with the terms of this contract. 3. Approve standards for eligibility for Dental Services hereunder. RECORD RETENTION The Provider shall be responsible for record keeping on all Dental Services provided to those individuals using its services and all financial records of the clinic. The Provider agrees to maintain and make available for inspection by the County upon request consistent with personal privacy and subject to the limitations of state law, any and all records the County determines, in its sole discretion, to be necessary for the Court to justify its continued participation in supporting the Provider with funding and to verify compliance with the terms of this Contract. Such records shall be retained for at least four (4) years from the date the Dental Services was provided. These records shall be made available for inspection and audit by the County if it so desires. DISCRIMINATION The provider shall not discriminate against any employee or applicant for employment because of race, color, religion, sex, or national origin. The Provider shall take affirmative action to ensure that applicants who are employed are treated during employment, without regard to their race, color, religion, sex, or national origin. Such action shall include, but not be limited to, the following: employment, upgrading, demotion, or transfer; recruitment advertising; layoff or termination; rate of pay or other forms of compensation; and selection for training, including apprenticeship. The Provider agrees to post in conspicuous places, available to employees and applicants for employment, notices setting for provisions of this non-discrimination clause. Page 3 of5 VOL 4SX PAGE a3 INDEMNITY The Provider agrees to indemnify the County for and hold it harmless from and against all suits, claims, demands, liabilities or actions resulting or alleged to result from the breach, Violation or non-performance of the Dental and Administrative Services stated herein and for any damage to any person resulting from any act or omission or negligence on the part of Provider. INSURANCE The parties hereto agree that the Provider is an independent contractor and not an agent of the County and that Provider shall maintain at its own expense, adequate liability insurance to insure against damages and liabilities which may arise due to the duties and obligations contacted for herein. COUNTY INVOLVEMENT The County and Provider state that to the best of their knowledge, no officer, agent or employee of the County who exercises any function or responsibility in connection with the carrying out of this Contract or the service to which it relates, has personal interest, direct or indirect, in this Contract. GOVERNING LAW This Contract shall be executed in and shall be governed by the laws of the State of Texas. STATE OF TEXAS § COUNTY OF BRAZOS § This is an Agreement by and between the COUNTY OF BRAZOS (hereinafter referred to as "COUNTY") and KEEP BRAZOS BEAUTIFUL, INC. (hereinafter referred to as ("Keep Brazos Beautiful") a non-profit organization for the improvement of Brazos County. WHEREAS, Keep Brazos Beautiful is a volunteer environmental educational organization dedicated to contributing to the economic vitality, safety, health and quality of life in Brazos County through programs that educate & empower citizens to take responsibility for controlling litter, recycling, minimizing waste and beautifying and improving their surroundings; and NOW, THEREFORE, FOR AND IN CONSIDERATION of mutual promises recited herein, the parties agree as follows: 1. Keep Brazos Beautiful shall provide services to the COUNTY as follows: A. Assist in the coordination and publicity for the yearly Christmas tree recycling, telephone book recycling events, act as a clearinghouse for information from area residents on recycling, and provide information concerning Citizen Collection Stations in rural Brazos County, on their website and as requested. B. Educate the community on the need to recycle and to buy recycled products through the use displays, public speaking engagements, and "Texas Recycles Day" events. C. Organize and train area teachers on the importance of litter, abatement, recycling, re-use, and buying recycled products, provide classroom presentations in area schools, Children's Museum of the Brazos Valley, maintain a lending library to assist teachers in teaching litter control, and recycling. c D. Promote all "Adopt-a-Road Programs in the county through public outreach in printed materials, and website. E. Perform an annual "Litter Index" survey of the Brazos County and provide the scores to the Commissioners Court. F. Promote a "Memorial TREES Program" to plant trees in Brazos County. G. Organize volunteers to assist in cleaning illegal dumps in Brazos County VOL '0 PAGE A4A 2. Keep Brazos Beautiful will be funded by the COUNTY in the amount of Fifteen Thousand Dollars ($15,000) from the COUNTY 2003-2004 Fiscal Year funds to be used for salaries and operating expenses. Keep Brazos Beautiful will be funded by the COUNTY in the amount of One Thousand Five Hundred Dollars ($1,500) for personal protection equipment and supplies for use by volunteers cleaning illegal dump sites in County right-of-ways and waterways. 3. Keep Brazos Beautiful shall maintain fiscal records and supporting documentation in the form of canceled checks, payroll records, invoices, and/or other documentation required for all expenditures of funds made under this agreement. 4. Keep Brazos Beautiful shall submit a financial statement to the COUNTY annually. 5. All notices and documentation required to be sent to the COUNTY shall be forwarded to Judge Randy Sims Brazos County Court House 300 E. 26`s St. Suite #114 Bryan, TX 77803 6. It is understood and agreed that the COUNTY'S participation in Keep Brazos Beautiful is limited to the contribution of funds. Either of the parties shall have the right to terminate this Agreement in whole or in part at any time. TERM This contract shall continue in force and effect for a term of twelve (12) months commencing on the I st day of October 2003 and terminating 30th day of September 2004. SERVICES TO BE PERFORMED BY PROVIDER Provider shall provide the following services through trained, salaried staff to pregnant women who qualify for such services pursuant to the guidelines currently implemented for making such determination: interviews, lab work, physical exams, educational information and medicine as needed (herein "Services"). USE OF COUNTY FUNDS Funds to be furnished to Provider as stated herein below shall be used to pay the partial salary of the Director of Provider and the salaries of other staff as described in Enclosure (1) attached hereto and made a part hereof for all purposes. The County and Provider acknowledge that the County's purpose in providing funds hereunder is to provide medical assistance to qualified 1 VOLE PAGE a4`~ applicants and that the funding of salaries for the trained personnel of Provider is designed to accomplish that goal. III. Volunteer placements will be made as appropriate at volunteer workstations throughout the community. All workstations will have a signed Memorandum of Understanding on file with RSVP. IV. Any invention of literacy or artistic production arising out of an assignment shall be the exclusive property of the Volunteer Station and the Volunteer shall have the right to produce additional copies and distribute to the general public. Those services will include, but not be limited to, erosion control, water management, and rural development. This will be carried out by planning and application through informal agreements with land users, or, as required by Federal or State law. An information and recognition program will be used to inform the public. Technical assistance is utilized through a Memo of Understanding between the District and the USDA - Natural Resources Conservation Service. Erosion control will keep the land productive for its various uses for many generations. Sediment resulting from erosion clogs our local streams reducing water carrying capacity and resulting in local flooding. Excessive siltation ruins our local wetlands, and; therefore, reduces a dwindling wildlife habitat. Silt from erosion carries many pollutants directly into our local streams and rivers. Conservation practices consist of erosion control structures, erosion control ponds, gully shaping, diversions, vegetating old fields, proper management of grazing resources. Water management includes recommendations for proper irrigation, flood control, and water quality. Irrigated crops account for 75% of all water used. Proper irrigation saves that resource for tomorrow's uses including domestic consumption. Proper irrigation helps to keep agriculture pollutants from entering underground water supplies. Conservation practices include total evaluation of irrigation systems and application procedures, precision land leveling, and underground pipelines. Water management includes floodplain management. The District's role in Rural Development in Brazos County is in providing fire protection utilizing dry hydrants. Insurance rates outside the city limits can be lowered a great deal; as well as provide a reliable source of water to fight rural fires. Farm ponds provide the water and we plan the dry hydrant system. The District is evaluating the use of artificial wetlands to replace septic tank filter fields. The prospects are very promising, but much work remains to be done before this technology can be implemented. Water quality in rural Brazos County will be greatly enhanced if this method can be used. The Commissioners Court will make available facilities on county property, if such facilities can be located without disrupting other county services. The DRC may, at its discretion, provide additional sessions without charge to the County on a limited basis. All damage to the roadways and rights-of-way will be repaired to their original condition to the satisfaction of the County Engineer. 3. Brazos County reserves the right to require Applicant to relocate or lower any such line at no cost to Brazos County, should same become necessary due to widening or lowering, or other alteration of the roadway or right-of-way. 4. Brazos County will in no way be responsible for any damage which might occur to any existing utility lines in the right-of-way. 5. The line will be constructed and maintained on the County right-of-way in accordance with the Utility Accommodation Policy which was adopted by the Texas Department of Transportation on May 29, 1989. 6. The line or lines will be constructed no less than twenty-four inches (24") lower than the lowest part of the drainage or bar ditch and the drainage is to be considered at least two feet (2') below the center of the roadway. 7.
