Bryan, Texas 77603 - Fax: (979) 361-.503 COMMISSIONERS' COURT SPECIAL MEETING SEPTEMBER 21, 2009 A special meeting of the Commissioners' Court of Brazos County, Texas was held in Commissioners Courtroom in the County Administration Building, 200 South Texas Avenue, in Bryan, Brazos County, Texas, beginning at 9:00 a.m. on Monday, September 21, 2009 with the following members of the court present: Randy Sims, County Judge, Presiding; Lloyd Wassermann, Commissioner of Precinct 1; Duane Peters, Commissioner of Precinct 2; Kenny Mallard, Commissioner of Precinct 3; Irma Cauley, Commissioner of Precinct 4; Karen McQueen, County Clerk. The attached sheet contains the names of the citizens and officials that were in attendance. The County Judge called the meeting to order and then proceeded to consider adoption of the budget for the fiscal year ending September 30, 2010. The Court then considered the following possible amendments to the proposed budget: 1. General Capital Improvement and General Fund: Brazos Center To eliminate $5,490 funding for the TS Gator appropriated for the Brazos Center in the General Capital Improvement Fund. On motion by Commissioner Cauley, seconded by Vol f a6 Page I I j, Commissioners Court meeting September 21, 2009 2 Commissioner Peters, the Court voted unanimously to approve the amendment. 2. Ag Extension to reduce telephone-Cellular from $2,250 to zero. On motion by Commissioner Cauley, seconded by Commissioner Peters, the Court voted unanimously to approve the amendment. 3. County Fire Protection. To reduce College Station EMS Protection budget allocation by $28,568 from $302,099 to $273,531. On motion by Commissioner Peters, seconded by Commissioner Wassermann, the Court voted unanimously to approve the amendment. 4. Grant Fund: HAVA Grant to increase the budget by $4,041 for a maintenance agreement and an increase of $765 for the purchase of computer hardware for the Elections division. On motion by Commissioner Peters, seconded by Commissioner Cauley, the Court voted unanimously to the budget amendment. 5. Community Support to correct the amount appropriated for MHMR increasing the funding by $14,500. On motion by Commissioner Wassermann, Vol la!5 Page 1-7,3 Commissioners Court meeting September 21, 2009 3 seconded by Commissioner Cauley, the Court voted unanimously to approve the budge amendment. 6. Community Support to add $90,500 to fund the Next Generation Park loan for 2010 that was not included. On motion by Commissioner Peters, seconded by Commissioner Mallard, the Court voted unanimously to approve the budget amendment. 7. Indigent Health Care to increase Indigent Health Care by $419,300 to appropriate 80 of general fund expenditures as required. On motion by Commissioner Cauley, seconded by Commissioner Peters, the Court voted unanimously to approve the budget amendment. 8. Community Support to reduce the funding for the Brazos County Historical Commission from $5,000 to $500. The $500 is to be used for postage only. On motion by the County Judge, seconded by Commissioner Peters, the Court voted unanimously to approve the amendment. 9. General Capital Improvement and General Fund Sheriff Office Jail to eliminate the $13,500 set aside for 60 gallon Steam Kettle replacement in Vol I a r;> Page ) 14 Commissioners Court meeting September 21, 2009 4 the Sheriff's Office: Jail Division and to add $5,000 for an ice maker. On motion by Commissioner Wassermann, seconded by Commissioner Peters, the Court voted unanimously to approve the budget amendment. 10. Hotel Occupancy Tax Fund to add $25,000 for the Convention and Visitors Bureau. On motion by Commissioner Peters, seconded by Commissioner Cauley, the Court voted unanimously to approve the budget amendment. 11. District Clerk Archival Fund to add and increase the budget by the addition of a District Clerk Archival Fund by $7,000. On motion by Commissioner Peters, seconded by Commissioner Cauley, the Court voted unanimously to approve the budget amendment. 12. County Clerk Archival Fund to add and increase the budget by the addition of a County Clerk Archival Fund by $160,000. On motion by Commissioner Cauley, seconded by Commissioner Peters, the Court voted unanimously to approve the budget amendment. 13. County Clerk Management Fund to add $3,000 to Vol aS Page 1-73 Commissioners Court meeting September 21, 2009 5 Contract Services for moving and reassembling shelving units for storage. On motion by Commissioner Wassermann, seconded by Commissioner Peters, the Court voted unanimously to approve the budget amendment. 14. Veteran's Services to add $100 to the Veteran's Service Department to recognize a donation made during the fiscal year 2009. On motion by the County Judge, seconded by Commissioner Cauley, the Court voted unanimously to approve the budget amendment. 15. HOT Fund: HOT Marketing Reimbursement Division to reclassify the Fair Coordinator title to Fair Manager. On motion by Commissioner Peters, seconded by Commissioner Cauley, the Court voted unanimously to approve the budget amendment. 16. Information Technology Department to reduce Computer Contracts by $20,618 to fund the acquisition of a part time PC Specialist to perform maintenance on all scanners at Group 17, Step 2. On motion by Commissioner Cauley, seconded by Commissioner Peters, the Court voted unanimously to approve the budget amendment. Information Technology Department to increase computer maintenance by $4,869 to provide funding for the scanner maintenance kits to be used to repair scanners. On motion by Commissioner Cauley, seconded by Commissioner Peters, the Court voted unanimously to approve the budget amendment. 18. Building maintenance to reduce the salary of Class Code 0705 Janitor/ Custodian position 1 from Group 7 Step 7 to Group 7 Step 2 with a cost savings of $3,374. On motion by Commissioner Wassermann, seconded by Commissioner Cauley, the Court voted unanimously to approve the budget amendment. 19. Building Maintenance to increase Job Class 0711 Maintenance Tech III Group 21, Step 5 to Group 21, Step 6 to increase to budget by $1,379. On motion by Commissioner Cauley, seconded by Commissioner Peters, the Court voted unanimously to approve the budget amendment. 20. County Attorney to reduce the salary of the First Assistant position class code 0503 position 1 from $90,534 to $87,571 and use the Vol 1 a 6 Page 1 T7 Commissioners Court meeting September 21, 2009 7 $3,548 to increase the Civil Attorney position. Commissioner Wassermann moved to approve, Commissioner Peters seconded the motion. Commissioners Wassermann, Peters, Mallard and the County Judge voted "Aye" Commissioner Cauley voted "No" the motion passed. 21. County Attorney to increase the salary of the Civil Attorney position 2 from $87,571 to $90,534 increasing the budget by $3,548. Commissioner Peters moved to approve the budget amendment. Commissioner Mallard seconded the motion. Commissioners Wassermann, Peters, Mallard and the County Judge voted "Aye". Commissioner Cauley voted "No". The motion carried. 22. County Attorney to increase the County Attorney's State Supplement by $4,012. On motion by Commissioner Peters, seconded by Commissioner Cauley, the Court voted unanimously to approve the budget amendment. 23. District Clerk to add the Juror Payment Clerk Class 1710 position 1 at Group 9, Step 2 total increase is $34,512. On motion by Commissioner Vol a5 Page 1 ~ 3 Commissioners Court meeting September 21, 2009 8 Cauley, seconded by Commissioner Mallard, the Court voted unanimously to approve the budget amendment. 24. Magistrate #2 to decrease the salary and related benefits of Magistrate #2 class code 2206 position 1 from $94,811 to $85,000. Commissioner Peters moved to approve. Commissioner Cauley seconded the motion. Judge J. D. Langley objected to the Magistrates being paid at a different rate saying it would create a conflict with the two positions. He urged the Court to not approve the budget amendment. After considerable discussion Commissioners Peters and Cauley withdrew their motion and second. The County Judge then moved to approve the budget amendment. There was no second so the motion failed. 25. Magistrate #2 to reduce the salary and related benefits of Magistrate #2 Clerk class code 2207 position 1 from Group 18, Step 5 to Group 18, Step 2 to $36,018. On motion by Commissioner Peters, seconded by Commissioner Cauley, the Court voted unanimously to approve the budget Vol l d5 Page 17q Commissioners Court meeting September 21, 2009 9 amendment. 26. Magistrate 42 to reduce the salary and related benefits of Magistrate 2 Bailiff class code 2208 position 1 from Group 15, step 5 to Group 15, Step 2 to $31,069. on motion by Commissioner Peters, seconded by Commissioner Cauley, the Court voted unanimously to approve the budget amendment. 27. Justice of the Peace, Precinct 2 Place 2 to decrease the full time Clerk 1 class code 0602 to part time. On motion by Commissioner Peters, seconded by Commissioner Cauley, the Court voted unanimously to approve the budget amendment. 28. Justice of the Peace, Precinct 2 Place 2 to increase the Court Coordinator job class 0610 from Group 14, Step 12 to Group 14, Step 15. On motion by Commissioner Cauley, seconded by Commissioner Wassermann, the Court voted unanimously to approve the budget amendment. 29. Justice of the Peace, Precinct 2, Place 2 to increase the Clerk III job class 0133 from Group 12, Step 10 to Group 12, Step 13. On motion by Commissioner Cauley, seconded by Commissioner Vol I QS Page 180 Commissioners Court meeting September 21, 2009 10 Peters, the Court voted unanimously to approve the budget amendment. 30. Budget Office to add a Budget Analyst position in the Budget office increasing the budget a total of $66,602. On motion by Commissioner Cauley, seconded by Commissioner Peters, the Court voted unanimously to approve the budget amendment. 31. Juvenile Court Referee to increase the salary of the Court Coordinator from a Group 18, Step 2 to a Group 18, Step 7 increasing the budget by $5,651. On motion by Commissioner Peters, seconded by Commissioner Wassermann, the Court voted unanimously to approve the budget amendment. 32. Tax office to add a Voter Registration Coordinator position for a total increase of $32,635. On motion by Commissioner Cauley, seconded by Commissioner Peters, the Court voted unanimously to approve the budget amendment. 33. Sheriff's Office: Jail Division to add three unfunded detention officers in the Jail division to be funded at a later date. Commissioner Vol 105 Page 19) Commissioners Court meeting September 21, 2009 11 Peters asked the Sheriff to be careful of overtime hours saying money would be tight. On motion by Commissioner Cauley, seconded by Commissioner Peters, the Court voted unanimously to approve the budget amendment. 34. Community Support to increase funding for the Research Valley Partnership by $6,713 to equal both of the cities contributions. On motion by Commissioner Mallard, seconded by Commissioner Peters, the Court voted unanimously to approve the budget amendment. 35. Grant Fund: GDEM State Homeland Security to add an additional $2,725 for grant funds for the use of unexpended funds that will be reimbursed by the state. On motion by Commissioner Wassermann, seconded by Commissioner Cauley, the Court voted unanimously to approve the budget amendment. 36. Jail Expansion 2007 fund to reduce the estimated funds for the Jail Expansion 2007 fund by $3,800,000 to reflect the amount left to spend to complete the project. On motion by Commissioner Cauley, seconded by Commissioner Vol )9,5 Page 1 ~J, Commissioners Court meeting September 21, 2009 12 Peters, the Court voted unanimously to approve the budget amendment. At 9:59 the County Judge recessed the meeting for a few minutes to allow the Budget Officers time to calculate the total dollars budgeted for FY 2010. At 10:11 a.m. the County Judge reconvened the meeting and then moved to approve and adopt the Fiscal Year 2009-2010 County Budget in the amount of $183,723,539. The motion was seconded by Commissioner Peters and carried unanimously. A copy of the amendments is attached. The Court next considered adopting Resolution 09- 014 levying a tax rate for Brazos County for the Tax year 2009. The County Judge moved that the property tax rate be increased by the adoption of a tax rate of $.48/$100 (48 cents per $100 of value), which is effectively a 2.094 percent increase in the tax rate. The motion was seconded by Commissioner Peters and carried unanimously. The County Judge then moved that the debt portion of the Brazos County 2009 tax rate be set at $.0834 cents per $100 of value. Commissioner Peters seconded the motion and it carried unanimously. The County Judge moved that the maintenance and Vol 25 Page I3 Commissioners Court meeting September 21, 2009 13 operation portion of the Brazos County 2009 tax rate be set at $.3966 cents per $100 of value. Commissioner Wassermann seconded the motion and it carried unanimously. A copy of the Resolution is attached. There being no further business to come before the Court, the meeting was adjourned.
