Call to Order. 2. Review of Brazos County Order 09-012 requiring the application of the provisions of Subchapter P, Chapter 233, Local Government Code relating to residential building code standards, and the effects of implementing this Order. 3. Consider possible revisions to Order 09-012. 4. Adjourn. The County Administration Building is handicap accessible. Handicap parking spaces are available. Office of the County Judge 200 South Texas Ave. Suite 332 Bryan, Texas 77803 Fax: (979) 361-4503 QA COMMISSIONERS' COURT WORKSHOP SESSION SEPTEMBER 15, 2009 The Commissioners' Court of Brazos County, Texas met in a Workshop Session in the Commissioners' Courtroom in the Brazos County Administration Building in Bryan, Brazos County, Texas, beginning at 9:00 a.m. on Tuesday, August 15, 2009 with the following members of the Court present: Randy Sims, County Judge, Presiding; Lloyd Wassermann, Commissioner of Precinct 1, Absent; Duane Peters, Commissioner of Precinct 2; Kenny Mallard, Commissioner of Precinct 3; Carey Cauley, Jr., Commissioner of Precinct 4; Karen McQueen, County Clerk, Absent. Attached is a list of the citizens and officials in attendance. The Commissioner's Court met to review County Order 09- 012 requiring the application of the provisions of Subchapter F, Chapter 233, Local Government Code relating to residential building code standards, and the effects of implementing this Order. Copies were handed out to the Commissioners and it was noted that there was a typo on #3. It says building but should be builder. The following spoke: Vol ~S Page I3 Commissioners Court meeting September 15, 2009 2 Commissioner Cauley-voiced concern about #2 adding the electrical code. Inspections cost the consumer and she would like to remove the electrical portion Commissioner Peters-doesn't want cost to prevent us from doing what is necessary to protect consumers. Richard Vance, County Engineer-said BTU had an inspection program but is not sure if they still do. Commissioner Cauley- asked Mr. Paul Swig if we have the authority and he says we do have it per HB 2833. Commissioner Peters-said with this implemented, the county just has to keep up with paperwork the independent inspectors used. Gary Arnold, Director of Planning and Traffic- has reviewed the forms they drafted with Court Counsel, Tina Snelling. He asked for guidance from the Court. We went on to ask, other than requiring forms was there anything else? Commissioner Cauley-responded that was it. Commissioner Peters-said the county would probably want to require state certified inspectors. Gary Arnold-replied that this information is asked for on the form. Commissioner Mallard-asked if the county needed to keep up with their licensing expiration? Vol W5 Page qq Commissioners Court meeting September 15, 2009 3 Gary Arnold-asked how the county could do this. Tina Snelling-said that certification is an issue. The County has to set standards. It can be referred to the County Attorney for a Class C Injunction. Richard Vance-said it would be difficult for the Road & Bridge Department to police and keep up with building. They have a hard enough time keeping up with driveways and mailboxes. They have no way of knowing when houses are built. Gary Arnold-said he didn't think he had the authority to hold electricity from being turned on before a form is filled out. Tina Snelling said authority is implied under the Health and Safety Code. The question is does the county want to be pro active or reactive. Commissioner Peters-stated that the Court didn't have to pass anything but that they would want a minimum of standards enforced. The County has the authority for three (3) inspections and so long as it doesn't over load the Road & Bridge Department. Gary Arnold-suggested putting the forms on the website. Commissioner Peters-said he couldn't see the builders getting upset since these standards are less stringent than the cities require. Vol lay Page 95 Commissioners Court meeting September 15, 2009 4 Richard Vance- asked about reports from rural communities on problems with their homes. Commissioner'Cauley-asked who these would be reported to. She said no one seems willing to step up. She suggested placing information on the website or in the newspaper. Count Judge-said he was not sure he wants to do this. Commissioner Mallard-suggested inviting the builders and developers for input from them. Richard Vance-said that this would take some liability off of the builders and place it on some inspectors. County Judge-asked Commissioner Cauley about her concerns over the expense to the consumers building in the county. Commissioner Cauley-replied safety is important and she's ok with this. Megan Lott, Road & Bridge Department- asked if we should keep up with problems with inspectors. The members of the court responded yes. Commissioner Mallard-suggested getting the Information Technology Department to help by scanning the forms. Gary Arnold-said that was what was needed, was the process. Tina Snelling and Gary Arnold-said they would work on refining the forms and developing the process. Vol P5 Page IT(O Commissioners Court meeting September 15, 2009 5 Richard Vance-reminded the Court that they adopted a code for mailboxes and driveways that are ignored by the builders. Commissioner Peters- agreed but with the possibility of filing a Class C criminal charge against the builders there is enforcement. Commissioner Cauley and Tina Snelling-said it can be advertised on the website that a builder has potential criminal charges for not following procedure. Commissioner Cauley-asked that this item be placed on the agenda. TEXAS STATE OF TEXAS § COUNTY OF BRAZOS § ORDER NO. 09-012 REQUIRING THE APPLICATION OF THE PROVISIONS OF SUBCHAPTER F, CHAPTER 233, LOCAL GOVERNMENT CODE RELATING TO RESIDENTIAL BUILDING CODE STANDARDS AN ORDER requiring the Application of the Provisions of Subchapter F, Chapter 233, Local Government Code, relating to Residential Building Code Standards, and providing a penalty. 1. The Commissioners Court of Brazos County, Texas does hereby adopt this Order requiring the application of the provisions of Subchapter F, Chapter 233, Local Government Code, in the unincorporated areas of this County. 2. A builder, subject to the provisions of this Order, shall provide notice to the County on a form prescribed by the County of. a. the location of the new residential construction; b. the approximate date by which the new residential construction will be commenced; and c. agree to follow the 2003 version of the International Residential Code and the 2002 version of the National Electrical Code for any new residential construction before commencing construction. hu ng 3. Not later than the 10`s day after the date of the final inspection, the building shall submit notice of the inspection stating whether or not the inspection showed compliance with the building code standards applicable to that phase of construction in a form required by the County to: a. the following County employee, department or agency: Brazos County & Bride& Bride De~artmene and b. the person for whom the new residential construction is being built, if different from the builder. 4. Failure to provide a notice required under this Order is a Class C Misdemeanor. This Order shall be effective upon its adoption by the Commissioners Court and its publication once in a newspaper of general circulation in the County.
