Adjourn VOLE PAGE 113 Commissioners Court Agenda 21 July 2009 Page 4 PUBLIC COMMENTS Public Comment during the Commission Meeting may be for all matters, both on and off the agenda, and be limited to four minutes per person. Persons are invited to submit comments in writing on the agenda items and/or attend and make comment at the Commission meeting. Members of the public are reminded that the Brazos County Commissioners Court is a Constitutional Court, with both judicial and legislative powers, created under Article V, Section 1 and Section 18 of the Texas Constitution. As a Constitutional Court, the Brazos County Commissioners Court also possesses the power to issue a Contempt of Court Citation under Section 81.024 of the Texas Local Government Code. Accordingly, members of the public in attendance at any Regular, Special and/or Emergency meeting of the Court shall conduct themselves with proper respect and decorum in speaking to, and/or addressing the Court; in participating in public discussions before the Court; and in all actions in the presence of the Court. Those members of the public who are inappropriately attired and/or who do not conduct themselves in an orderly and appropriate manner will be ordered to leave the meeting. Refusal to abide by the Court's Order and/or continued disruption of the meeting may result in a Contempt of Court Citation. It is not the intention of the Brazos County Commissioners Court to provide a public forum for the demeaning of any individual or group. Neither is it the intention of the Court to allow a member (or members) of the public to insult the honesty and/or integrity of the Court, as a body, or any member or members of the Court, or County employees, individually or collectively. Accordingly, profane, insulting or threatening language directed toward the Court and/or any person in the Court's presence and/or racial, ethnic or gender slurs or epithets will not be tolerated. Violation of these rules may result in the following sanctions: 1. cancellation of a speaker's time; 2. removal from the Commissioners Court; 3. a Contempt Citation; and/or 4. such other and/or criminal sanctions as may be authorized under the Constitution, Statutes and Codes of the State of Texas. The County Commissioners Court can deliberate or take action only if a matter has been listed on an agenda properly posted prior to the meeting. During the public comment period, speakers may address matters not listed on the published agenda. The Open Meeting Law does not expressly prohibit responses to public comments by the Commissioners Court. However, responses from the County Judge or Commissioners to unlisted public comment topics could become deliberation on a matter without notice to the public. To ensure the public has notice of all matters the Commissioners Court will consider, the County Judge and/or Commissioners may choose not to respond to public comments, except to correct factual inaccuracies, recite existing policy in response to an inquiry or to ask that a matter be listed on a future agenda. See Texas Open Meetings Act §551.042. The County Administration Building is wheelchair accessible. Handicap parking spaces are available. VOt a~3?AGE ,L~ COMMISSIONERS' COURT REGULAR MEETING JULY 21, 2009 A regular meeting of the Commissioners' Court of Brazos County, Texas was held in the Commissioners Courtroom in the Brazos County Administration Building, 200 South Texas Avenue, in Bryan, Brazos County, Texas, beginning at 6:00 p.m. on Tuesday, July 21, 2009 with the following members of the Court present: Randy Sims, County Judge, Presiding; Lloyd Wassermann, Commissioner of Precinct 1; Duane Peters, Commissioner of Precinct 2; Kenny Mallard, Commissioner of Precinct 3; Irma Cauley, Commissioner of Precinct 4; Karen McQueen, County Clerk, Absent. The attached sheets contain the names of the citizens and officials that were in attendance. Commissioner Cauley gave the invocation and led the pledge of allegiance. There was no citizen input/and or concerns. The first matter before the Court was Budget Amendment #08/09-42.1 through 42.8, that would reallocate funds for the Constable, Precinct 3, Justice of the Peace, Precinct 4, Juvenile Services:TJPC-G-Prog Sanct 123, Metropolitan Planning Organization, Building Maintenance, Magistrate; transfer funds Vol ~;O Page 115 Commissioners Court meeting July 21, 2009 2 from Contingency and Sheriff Office DDEA to the Sheriff's Office, from Contingency to Court Support Costs:Auxillary Courts Project. On motion by Commissioner Peters, seconded by Commissioner Cauley, the Court voted unanimously to approve the budget amendment as submitted, a copy of which is attached. The Court proceeded to consider the change of status of employees as submitted on the attached Personnel Action Requests. On motion by Commissioner Wassermann, seconded by Commissioner Peters, the Court voted unanimously to approve the change of status as submitted. The Court next considered the following Claims as submitted by the County Treasurer for payment: 7064100 through 7064337 On motion by Commissioner Cauley, seconded by commissioner Peters, the Court voted unanimously to approve the Claims as submitted. The next matter before the Court was the acceptance of the resignation of David Coleman from the Local Workforce Development Board as the Public Employment representative. On motion by Commissioner Cauley, seconded by Commissioner Wassermann, the Court voted unanimously to amend the agenda to reflect that Dale Robertson rather than David Coleman has Vol _1R3 Page ,(!0 Commissioners Court meeting July 21, 2009 3 resigned. Then on motion by Commissioner Cauley, seconded by Commissioner Mallard, the Court voted unanimously to accept the resignation of Dale Robertson from the Local Workforce Development Board as the Public Employment representative. The resignation is effective immediately. The next matter before the Court was the appointment of an individual to serve on the Local Workforce Development Board to fill the vacancy created by the resignation of Dale Robertson. On motion by Commissioner Peters, seconded by Commissioner Cauley, the Court voted unanimously to appoint Ramona Malone to the Local Workforce Development Board as the Public Employment representative. Ms. Malone will fill the position for three (3) years. The Court next considered the appointment of an individual to serve as liaison to the Brazos Valley Museum of Natural History. On motion by the County Judge, seconded by Commissioner Peters, the Court voted unanimously to appoint Commissioner Irma Cauley to serve as liaison to the Brazos Valley Museum of Natural History. The next matter before the Court was an order Relocating the Main Early Voting Polling Place. The main early voting polling place currently located at the Brazos County Courthouse, 300 East 26th Street, Bryan, Texas must be moved Vol 03 Page 117 Commissioners Court meeting July 21, 2009 4 because of construction and renovations of the building. The Court is desirous of relocating the main early voting polling place from the Courthouse to the Brazos County Administration Building located at 200 South Texas Avenue, Bryan, Texas which is two (2) blocks south of the current main early voting polling place, the Brazos County Courthouse. On motion by Commissioner Peters, seconded by the County Judge, the Court voted unanimously to relocate the main early voting polling place located in the Brazos County Courthouse, 300 East 26th Street, Bryan, Texas to the Brazos County Administration Building, 200 South Texas Avenue, Bryan, Texas and that submission be made to the Assistant Attorney General, Civil Rights Division, Voting Section, Department of Justice, Washington D. C. requesting the pre-clearance of this Order pursuant to Section 5 of the Federal Voting Rights Act. A copy is attached. The next matter before the Court was the appointment of Democratic Presiding and Alternate Judges for the period of one (1) year, ending on July 31, 2010. On motion by Commissioner Cauley, seconded by Commissioner Peters, the Court voted unanimously to appoint the individuals named on the attached sheets as presiding judge and alternate judge for the current voting year. Vol 1a3 Page 419 Commissioners Court meeting July 21, 2009 5 The next matter before the Court was the appointment of Republican Presiding and Alternate Judges for the period of one (1) year, ending on July 31, 2010. On motion by Commissioner Peters, seconded by Commissioner Mallard, the Court voted unanimously to appoint the individuals named on the attached sheets as presiding judge and alternate judge for the current voting year. The Court next considered the renewal of a commercial lease agreement between the City of Bryan as Landlord and Brazos County and Brazos County Special Investigations unit F/K/A Brazos County Clear Team as tenant. On motion by Commissioner Cauley, seconded by Commissioner Peters, the Court voted unanimously to renew the commercial lease agreement for one year commencing October 1, 2009 through September 30, 2010 and authorized the County Judge to execute the document. A copy is attached. The next matter before the Court was the renewal of a lease agreement with Brazos County Emergency Service District #1 for office space in the Millican Fire Department Building. The property, located at 3030 Wingfall Street, Millican, Texas houses a remote location of the Sheriff's Office. On motion by Commissioner Cauley, seconded by Commissioner Peters, the Court voted unanimously to approve the renewal of the lease agreement Vol W Page 119 Commissioners Court meeting July 21, 2009 6 for office space for one year commencing October 1, 2009 through September 30, 2010 at a cost of $100 per month and authorized the County Judge to execute the document. A copy is attached. The Court next considered a request from the Texas Department of Transportation for a supplemental payment of $13,724.57 in addition to funds already contributed for a highway project on FM 158 from FM 1179 to State Highway 30. Commissioner Peters moved to approve. Commissioner Mallard seconded the motion. Commissioners Wassermann, Peters, Mallard and Cauley voted "Aye". The County Judge voted "No". The motion carried. The next matter for consideration was approval of tax refund applications from the following individuals and/or companies: a) Capital Title of Texas, Over Payment $43.79 b) Learon Dove Mack, Over Payment $83.54 c) Wade Supply, over payment $ 36.42 d) William K. & Debra Ellis, over payment $1,247.86 e) Javad & Soraya R. The next matter before the Court was consideration of requisition numbers 00024959 for $3,071.88, 00024987 for $2,000.00 and 00024989 for $4,020.39 to Anixter, Inc. for the new Data Center Project to ensure that the data for Brazos County can be backed up efficiently. On motion by Commissioner Cauley, seconded by Commissioner Peters, the Court voted unanimously to approve the requisitions. The Court next considered approval of requisition numbers 00024963, 00024967, 00024971, 00024972, 00024973, 00024984, and 00024986 to Dell Marketing LP for the new Data Center Project. Total cost of these requisitions will be $156,321.29. On motion by Commissioner Cauley, seconded by Commissioner Peters, the Court voted unanimously to approve all previously listed requisitions. The Court next considered the approval of requisition numbers 00024976 for $19,533.80, and 00024977 for $20,193.00 to Sequel Data Systems, Inc. for the New Data Center Project that was approved for the IT Department. On motion by Commissioner Peters, seconded by Commissioner Cauley, the Court voted unanimously to approve the requisitions. On motion by Commissioner Cauley, seconded by Commissioner Peters, the Court voted unanimously to approve the requisition. The next matter before the Court was consideration of a requisition in the amount of $846.00 to Carpet Handlers & Supplies, Inc. for materials and installation of the baseboard at the 29th Street Court. On motion by the County Judge, seconded by Commissioner Peters, the Court voted unanimously to approve the requisition. The Court next considered an Exemption from Competitive Bidding Requirements of Local Government Code, Section 262.024(a)(4). On motion by Commissioner Wassermann, seconded by Commissioner Peters, the Court voted unanimously to exempt Specialty Engineering from the Competitive Bidding Requirements and approved payments for the 2008-2009 fiscal year. The Court next considered awarding Bid No. 2009-43, Two Station ADA Combo Shower Restroom 18 foot x 6 foot Trailers. Pat Howard, Purchasing Agent, recommended acceptance of the bid submitted by Comforts of Homes. On motion by Commissioner Mallard, seconded by Commissioner Peters, the Court voted unanimously to accept the recommendation of the Purchasing Vol I A3 Page 12A Commissioners Court meeting July 21, 2009 9 Agent and award the contract to Comforts of Home. A copy of the bid tabulation is attached. The next matter before the Court was the appointment of individuals to serve as members of the Steering Committee for the Exposition Center expansion. On motion by Commissioner Wassermann, seconded by Commissioner Mallard, the Court voted unanimously to appoint the following individuals to serve on the committee: Judge Randy Sims Commissioner Duane Peters Barron Hobbs Tom Quarles Gary Arnold Irene Jett Jim McCord Jim Singleton Non Voting Charles Wendt Non Voting Pat Howard Non Voting The Court next considered adopting Resolution 09-008 Adopting a Regional Watershed Storm Water Education Strategy. This is necessitated due to population growth, residential and industrial development that have resulted in changes to the landscape leading to storm water quality and quantity concerns throughout the Brazos Basin. The Court fully supports the development and implementation of a regional watershed storm water education strategy. On motion by Commissioner Wassermann, seconded by Commissioner Peters, the Court voted unanimously to adopt Resolution 09-008. A copy is attached. Landlord is the owner of land and improvements commonly known and numbered as 216 W. 26'" Street, Bryan, Texas and legally described as follows (the "Building"): A tract of land lying and being situated in Brazos County, State of Texas, containing 0.33 acres, more or less, and more particularly described as follows, to wit: Lot number nine (9) in Block number one hundred and nineteen (119) in the City of Bryan, according to the map of the said City recorded in Book H, of the deed records of Brazos County, Texas, and also all that part of the alley lying north of said Lot No. 9 and described as follows to wit: Beginning at the N.W. comer of said Lot No. 9 in Block 119; thence with the N. line of the Lot a distance of 57'/2 feet and comer at the N.E. corner of said Lot No. 9; thence in a northerly direction and at right angles to said first line, a distance of 10 feet and comer; thence in a westerly direction, and parallel to said first line a distance of 57Y2 feet and corner, thence in a southerly direction 10 feet to the place of beginning. The renewal term shall be at the rental set forth below and otherwise upon the same covenants, conditions and provisions as provided in this Lease. Sublease and Assignment. Tenant shall not sublease all or any part of the Leased Premises, or assign this Lease in whole or in part without Landlord's consent and written approval. 5. Repairs. During the Lease Term, Landlord shall make, at Tenant's expense, all necessary routine repairs to the Leased Premises. Routine repairs shall include such items as routine repairs of floors, walls, ceilings, and other parts of the Leased Premises damaged or worn through normal occupancy. 6. Alterations and Improvements. Tenant is allowed, at Tenant's expense, to erect securable private fencing around the parking lot to the east of the loading dock. Tenant, at Tenant's expense, shall have the right following Landlord's consent and written approval to remodel, redecorate, and make additions, improvements and replacements of and to all or any part of the Leased Premises from time to time as Tenant may deem desirable, provided the same are made in a workmanlike manner and utilizing good quality materials. Tenant shall have the right to place and install personal property, trade fixtures, equipment and other temporary installations in and upon the Leased Premises, and fasten the same to the premises. All personal property, equipment, machinery, trade fixtures and temporary installations, whether acquired by Tenant at the commencement of the Lease Term or placed or installed on the Leased Premises by Tenant thereafter, shall remain Tenant's property free and clear of any claim by Landlord. Tenant shall have the right to remove the same at any time during the term of this Lease provided that all damage to the Leased Premises caused by such removal shall be repaired by Tenant at Tenant's expense. If the Leased Premises or any other part of the Building is damaged by fire or other casualty resulting from any act or negligence of Tenant or any of Tenant's agents, employees or invitees, rent shall not be diminished or abated while such damages are under repair, and Tenant shall be responsible for the costs of repair not covered by insurance, B. Landlord shall maintain fire and extended coverage insurance on the Building and the Leased Premises in such amounts as Landlord shall deem appropriate. Tenant shall be responsible, at its expense, for fire and extended coverage insurance on all of its personal property, including removable trade fixtures, located in the Leased Premises. Landlord shall not be required to maintain insurance against thefts within the Leased Premises or the Building. 9. Utilities. Landlord shall pay charges for water, sewer, gas, and electricity. The telephone and other services and utilities used by Tenant on the Leased Premises during the term of this Lease shall be paid by Tenant unless otherwise expressly agreed in writing by Landlord. Tenant acknowledges that the Leased Premises are designed to provide standard office use electrical facilities and standard office lighting. Tenant shall not use any equipment or devices that utilize excessive electrical energy or which may, in Landlord's reasonable opinion, overload the wiring or interfere with electrical services to other tenants. 10. Signs. No signs will be permitted without the Landlords consent and written approval. Tenant shall repair all damage to the Leased Premises resulting from the removal of signs installed by Tenant. 11. Entry. The provisions of this Lease shall extend to and be binding upon Landlord and Tenant and their respective legal representatives, successors and assigns. 23. Consent. REF: Request to Approve Lease Agreement with Brazos County Emergency Service District #I I have explored the opportunity to use the office space in the Millican Fire Department Building as a remote office for sheriffs deputies. I met with Brazos County Emergency Services District #1 officials, Charlie Robertson and Lynn Elliott both have agreed that they would support allowing the Sheriffs Office to use the office space. They have agreed to provide the office space, access to a telephone line and the DSL internet connection. In the discussion, they indicated that they would like the Sheriff s Office to share in the utility expenses. Charlie Robertson advised me that it would amount to $100 per month. They are willing to waive that expense untitthe next county budget period. I believe that this would be a great benefit for the Sheriffs Office and the citizens of South Brazos County. It would allow deputies working the South end of the county an opportunity to remain in their zone while they prepare their reports at this office. This will improve our response time to calls for service in the South zone, will increase our presence in the Millican area and could save some fuel costs by reducing the number of trips to our main office. Attached you will find a Lease Agreement that once signed would allow sheriff's deputies to use the office space at the fire station in Millican. Tina Snelling had prepared the document and reviewed changes on behalf of Brazos County. OF BRAZOSCOUNTY BRYAN, TEXAS RESOLUTION ADOPTING A REGIONAL WATERSHED STORMWATER EDUCATION STRATEGY WHEREAS, population growth, residential and industrial development, and the resulting changes to the landscape have led to stormwater quality and quantity concerns throughout the Brazos Basin; and WHEREAS, these impacts cannot be entirely avoided or eliminated but can be minimized; and WHEREAS, it is currently recognized that control of stormwater quantity and quality is most effectively implemented when people and organizations understand the related causes and consequences of polluted stormwater runoff and flooding, and the actions they can take to control these; and WHEREAS, the need arises not only from the regulatory requirements of EPA NPDES Phase II Stormwater rules, but also from the recognition that local decision makers, citizens and elected officials will require more than a rudimentary grasp of stormwater pollution and flooding concerns in order to make effective decisions that will have a positive impact on stormwater issues; and WHEREAS, the development and implementation of effective, outcomes-based stormwater education and outreach programs will meet the related federal stormwater pollution control requirements and those of the communities they serve; NOW, THEREFORE BE IT RESOLVED that Brazos County fully supports the development and implementation of a regional watershed stormwater education strategy. Efforts will be overseen by the Brazos Clean Water and their respective municipal and county representatives. This approach seeks to coordinate use of local resources and expertise to achieve economy of scale by jointly addressing common needs of the cities and counties and provide uniformity in educational message to enhance learning.
