9. Appointment of Commissioner Duane Peters to the Board of Directors for the Brazos
Valley Council of Government; replacing the late Carey Cauley, Jr. This term is
effective immediately through 30 September 2010.
10. Acceptance of the resignation of Colleen Jennings Batchelor from the Brazos County
Historical Commission, effective immediately
It. Data Access Agreement for the Office of the Attorney General of Texas to have access
to AbleTerm, the County's criminal computer system, for information to be used for
child support enforcement purposes only.
12. Tax Refund Applications for the following:

13. Capital Requisition 00024903 in the amount of $23,845.00 to Cummins Southern
Plains, LLC to purchase a generator for the Road & Bridge Department.

15. Permission to renew bid #2007-35, Pharmacy Services, with Contract Pharmacy

16. Request from OSR Water Supply Corporation to construct 2000 feet of 2-inch PVC

17. Request for permission to enter private property of Jeffrey Bailey, Jr. located off Kuder
Road to clear fence line for sight distance for the health, safety and welfare of the
general public. Site is located in Precinct 4.
18. Final Plat of Bewley Addition - Phase One, Lot 1, Block 1, 2.768 acres, 0.132 acres
right of way dedication, S. W. Robertson League, A-202, (City of College Station ETJ)
Brazos County, Texas. Site is located in Precinct 1.

PUBLIC COMMENTS
Public Comment during the Commission Meeting may be for all matters, both on and off the agenda, and be limited to
four minutes per person. Persons are invited to submit comments in writing on the agenda items and/or attend and make
comment at the Commission meeting. Members of the public are reminded that the Brazos County Commissioners
Court is a Constitutional Court, with both judicial and legislative powers, created under Article V, Section I and Section
18 of the Texas Constitution. As a Constitutional Court, the Brazos County Commissioners Court also possesses the
power to issue a Contempt of Court Citation under Section 81.024 of the Texas Local Government Code. Accordingly,
members of the public in attendance at any Regular, Special and/or Emergency meeting of the Court shall conduct
themselves with proper respect and decorum in speaking to, and/or addressing the Court; in participating in public
discussions before the Court; and in all actions in the presence of the Court. Those members of the public who are
inappropriately attired and/or who do not conduct themselves in an orderly and appropriate manner will be ordered to
leave the meeting. Refusal to abide by the Court's Order and/or continued disruption of the meeting may result in a
Contempt of Court Citation.
It is not the intention of the Brazos County Commissioners Court to provide a public forum for the demeaning of any
individual or group. Neither is it the intention of the Court to allow a member (or members) of the public to insult the
honesty and/or integrity of the Court, as a body, or any member or members of the Court, or County employees,
individually or collectively. Accordingly, profane, insulting or threatening language directed toward the Court and/or
any person in the Court's presence and/or racial, ethnic or gender slurs or epithets will not be tolerated. Violation of
these rules may result in the following sanctions:
1. cancellation of a speaker's time;
2. removal from the Commissioners Court;
3. a Contempt Citation; and/or
4. such other and/or criminal sanctions as may be authorized
under the Constitution, Statutes and Codes of the State of Texas.
The County Commissioners Court can deliberate or take action only if a matter has been listed on an agenda properly
posted prior to the meeting. During the public comment period, speakers may address matters not listed on the published
agenda. The Open Meeting Law does not expressly prohibit responses to public comments by the Commissioners Court.
However, responses from the County Judge or Commissioners to unlisted public comment topics could become
deliberation on a matter without notice to the public. To ensure the public has notice of all matters the Commissioners
Court will consider, the County Judge and/or Commissioners may choose not to respond to public comments, except to
correct factual inaccuracies, recite existing policy in response to an inquiry or to ask that a matter be listed on a future
agenda. See Texas Open Meetings Act §551.042.
The County Administration Building is wheelchair accessible. Handicap parking spaces are available. Any request for sign

REGULAR MEETING
JULY 14, 2009
A regular meeting of the Commissioners' Court of Brazos
County, Texas was held in the Brazos County Commissioners
Courtroom in the Administration Building, 200 South Texas
Avenue, in Bryan, Brazos County, Texas, beginning at 9:00 a.m.
on Tuesday, July 14, 2009 with the following members of the
Court present:
Randy Sims, County Judge, Presiding;
Lloyd Wassermann, Commissioner of Precinct 1;
Duane Peters, Commissioner of Precinct 2;
Kenny Mallard, Commissioner of Precinct 3;
Irma Cauley, Commissioner of Precinct 4;
Karen McQueen, County Clerk.
The attached sheet contains the names of the citizens and
officials that were in attendance.
Commissioner Mallard gave the invocation and then led the
pledge of allegiance.
Under citizen input/and or concerns, the following spoke:
Sheriff Chris Kirk
a) Stated that the contract for the CIRA program was
awarded last week to McLain Advanced Technologies.
The Court next considered ratification of Budget
Amendment #08/09-40.1 that transferred funds from Contingency
to General Capital Improvement Funds for the emergency

purchase of a fire panel for the jail. The purchase and
amendment were authorized during the emergency meeting held
July 8, 2009. On motion by Commissioner Cauley, seconded by
Commissioner Peters, the Court voted unanimously to ratify the
budget amendment as submitted. A copy each amendment is
attached.
The Court next considered Budget Amendment #08/09-41.1
through 41.2, which would transfer funds to Justice of the
Peace, Precinct 4 from Contingency, and reallocate funds for
District Clerk-Jury Services. On motion by Commissioner
Cauley, seconded by Commissioner Peters, the Court voted
unanimously to approve the budget amendment as submitted, a
copy is attached hereto.
The Court proceeded to consider the change of status of
employees as submitted on the attached Personnel Action
Requests. On motion by Commissioner Wassermann, seconded by
Commissioner Peters, the Court voted unanimously to approve
the changes as submitted.
The Court next considered the following Claims as
submitted by the County Treasurer for payment:

On motion by Commissioner Peters, seconded by Commissioner
Wassermann, the Court voted unanimously to approve the Claims
as submitted.
The Court next considered adopting a Resolution for an
interim study of under valuation of oil and gas properties.
In 2007 the Texas Legislature adopted a severance tax based
interpretation of the Texas Tax Code, Sec. 23.175 and found
that it has results in the under valuation of oil and gas
property to the detriment of all other taxpayers. On motion by
Commissioner Mallard, seconded by Commissioner Cauley, the
Court voted unanimously to adopt Resolution #09-007 requesting
that Lt. Governor Dewhurst and Speaker Straus include a study
and evaluation of the effect of Texas Tax Code Sec. 23.175 on
all Texas taxpayers in their charges for interim studies by
the Senate and House, respectively.
The next matter before the Court was the reappointment of
individuals to serve on the Board of Directors for the Brazos
Valley Council of Governments. On motion by Commissioner
Cauley, seconded by Commissioner Peters, the Court voted
unanimously to appoint the following individuals to serve on
the Board of Directors for the Brazos Valley Council of
Governments:
Jason Bienski beginning 10-01-2008 through 09-30-2011

The Court next considered the appointment of an
individual to serve on the Board of Directors for the Brazos
Valley Council of Governments. On motion by Commissioner
Wassermann, seconded by Commissioner Cauley, the Court voted
unanimously to appoint Commissioner Duane Peters to serve on
the Board of Directors for the Brazos Valley Council of
Governments. Commissioner Peters replaces the late Carey
Cauley, Jr. and his term is effective immediately through
September 30, 2010.
The Court next considered a letter of resignation from
the Brazos County Historical Commission submitted by Colleen
Jennings Batchelor. Mrs. Batchelor is resigning due to her
recent appointment as Justice of the Peace, Precinct 4. On
motion by Commissioner Cauley, seconded by Commissioner
Peters, the Court voted unanimously to accept Mrs. Batchelor's
resignation.
The next matter before the Court was consideration of a
request submitted by the Office of the Attorney General to
access information in AbleTerm, the County's criminal justice
computer system. The information retrieved from AbleTerm is
to be used for child support enforcement purposes only. On
motion by the County Judge, seconded by Commissioner Cauley,

the Court voted unanimously to approve the request. A copy is
attached.
The next matter for consideration was approval of tax
refund applications from the following individuals and/or
companies:
a. Jimmie G. Hawley, over payment $64.53
b. Jeffrey Alan Morris, over payment $23.16
c. Janet M. Loveless, over payment $8.65
On motion by Commissioner Peters, seconded by Commissioner
Wassermann, the Court voted unanimously to approve the tax
refund applications.
The Court next considered approval of a Capital Purchase
requisition #00024903 to Cummins Southern Plains, LLC for a
generator for the Road & Bridge Department. The total cost of
the item will be $23,845.00. On motion by Commissioner
Cauley, seconded by Commissioner Peters, the Court voted
unanimously to approve the capital requisition.
The Court proceeded to consider another Capital Purchase.
This one, requisition #00024869 is to John Deere Company, Inc.
for the purchase of a tractor and loader for the Expo Center.
Total cost is $28,910.68. Commissioner Mallard brought up a
previous conversation in which it was discussed that Road and
Bridge would repair equipment for others. Richard Vance,
County Engineer said it would depend on what is wrong and how
quickly they needed the equipment back. On motion by

Commissioner Peters, seconded by Commissioner Wassermann, the
Court voted unanimously to approve the requisition.
The next matter before the Court was consideration of a
request from Charles Wendt, Assistant Purchasing Agent, asking
that the Court renew bid #2007-35, Pharmacy Services with
Contract Pharmacy Service, Inc. There is no increase in the
rates. On motion by Commissioner Cauley, seconded by
Commissioner Peters, the Court voted unanimously to approve
the request. The new bid number is 2009-42R.
The Court next considered the request from OSR Water
Supply Corporation to construct 2,000 feet of 2 inch PVC water
line in the right-of-way of Mumford Road. The site is located
in Precinct 4. The County Engineer stated that all appeared
to be in order and recommended approval. On motion by
Commissioner Cauley, seconded by Commissioner Peters, the
Court voted unanimously to approve the request from OSR Water
Supply Corporation and authorized the installation. A copy of
the request is attached hereto.
The Court next considered authorizing work outside of
county rights-of-way for the health, safety and welfare of the
general public. The Road and Bridge Department requested
permission to enter the private property of Jeffrey Bailey,
Jr. on Kuder Road in Precinct 4 to clear the fence line for

sight distance. On motion by Commissioner Cauley, seconded by
Commissioner Peters, the Court voted unanimously to authorize
the work.
The Court next considered approval of the Final Plat of
Bewley Addition Phase One, Lot 1, Block 1, 2.768 Acres Right
of Way Dedication in Precinct 1. Richard Vance, County
Engineer, stated that he had reviewed the plat and all
appeared to be in order. On motion by Commissioner Wassermann,
seconded by Commissioner Cauley, the Court voted unanimously
to approve the final plat of Bewley Addition Phase One, Lot 1,
Block 1, 2.768 Acres Right of Way Dedication as submitted.
The Court next considered approval of the Final Plat of
Saddle Creek Subdivision Phase 3 and Phase 5 in Precinct 1.
Richard Vance, County Engineer, stated that he had reviewed
the plat and offered this clarification:
Phase 3: 10.953 Acres; 7 Lots, Block 4, Lots 26-27,
Block 6, Lots 22-25 and 128
Phase 5: 27.794 Acres' 19 Lots, Block 2, Lots 75-77,
Block 4, Lots 58-60, Block 6, Lots 125-127
and Lots 145-148, Block 7 Lots 108-113
On motion by Commissioner Wassermann, seconded by Commissioner
Cauley, the Court voted unanimously to approve the final plat
of Saddle Creek Subdivision Phase 3 and Phase 5 with the
addition of the clarification noted above.

The next matter before the Court was consideration of a
payment authorization in the amount of $3,189.49 to Wilton's
Office Works for furniture purchased by the MPO on P.O.
#08004389 but not delivered until after FY08 and the purchase
order had been closed. On motion by Commissioner Cauley,
seconded by Commissioner Peters, the Court voted unanimously
to approve the payment authorization.
The Court considered a request from Justice of the Peace,
Precinct 2, Place 1 to pay for a microwave from Lowe's with
funds from their DDEA funds. The amount of the purchase is
$309.96. On motion by Commissioner Cauley, seconded by
Commissioner Peters, the Court voted unanimously to approve
the payment.
There were no announcements of interest items and
possible future agenda topics.
Under citizen input and/or concerns, the following
spoke:
Sheriff Chris Kirk
a) There were 527 inmates in jail, 61 are out
of county, 44 have monitors and 33 are
pending for monitors.
b) He updated the Court on the issues with the
jail inspection. The fire panel is being
installed and should be fully functional
today. As to the deficiencies with
staffing, he explained but did not make
excuses for them. All occurred at night.

The inspector is on standby to re-inspect
the jail.
Under Agency/Board/Committee reports by Court members,

a) He informed the Court that they will be
closing on the Marino property today at
4:00 p.m. This will allow space for the
jail expansion.
There being no further business to come before the Court,
the meeting was adjourned.

DATA ACCESS AGREEMENT
Brazos County (the "County") and the Office of the Attorney General ("OAG") have entered into this
Agreement to establish and enforce security controls for the access and use of data obtained, stored, and
maintained by the County for criminal justice purposes and. accessed by the OAG, a Title IV-D Agency,
in support of its duties in the administration of a Child Support Enforcement Strategy. The OAG will
access the data in order to establish and enforce child support orders; there is no law enforcement
component to OAG access and use. This Agreement is entered into by the OAG pursuant to the authority
granted by § 231.002 of the Texas Family Code. In furtherance of this Agreement, the OAG agrees to
abide by all current and hereafter approved rules of the County relating to access and use of this
information. The OAG acknowledges receipt of a copy of Brazos County's Acceptable Use Policy and
related policies that establish the OAG's privileges and obligations. These policies are a part of the terms
and conditions of this Access Agreement and included here as Attachment 1.
Computers having access to the County's data must have the proper software and hardware controls,
implemented under the security of the OAG to prevent data being accessible to any terminals other than
authorized terminals. Furthermore, the OAG must provide for adequate physical security to protect
against unauthorized personnel gaining access to the terminals and stored data. The OAG, through its
supervisors, shall determine which personnel of the OAG shall have access to the data. Employees of the
OAG are prohibited from accessing any system or subsystem or storage medium for which they are not
authorized. Employees are strictly prohibited from altering any data or database of the County. Any time
the OAG suspects that there has been an attempt to gain unauthorized entry into the system, or alteration
or attempted alteration of the data, the Brazos County Information Technology Department shall be
notified immediately. Any printed output of the data that is confidential in nature shall be properly
accounted for and/or disposed of. Access and use of the data of the County is a privilege that may be
revoked at any time for unacceptable use. Failure to observe the guidelines set forth herein, and in the
referenced and incorporated polices of the County can result in anything from a warning to a suspension
or termination of this access. The County may also report any potential violations of the law to the proper
authorities and will cooperate with those authorities in any investigation.
The OAG accepts responsibility for reading and familiarizing itself and its employees with the policies
stated and incorporated herein. If clarification is needed on any of the policies or information, the OAG
will contact the County through its Information Technology Department.

REQUIREMENTS:
I . No work will be permitted between front slope and/or back slope.
2. All installation(s) shall be constructed in designated utility easements, if applicable. If no
utility easement exists, the installation(s) shall be 1) within 3-5' of and parallel to the right-
of-way line and/or 2) in the case of a road bore, perpendicular to the right-of-way line.
3. If clearing of brush, trees and other obstruction is necessary, it shall be the Applicant's
responsibility to do so and to remove all cleared brush, trees etc. from county right-of-way.
4. Ditch line shall be compacted to 90% standard density ASTM-Test Method No. D-698; test
shall be conducted by an independent geotechnical testing firm; copies of all test results shall
be furnished to the office of the Brazos County Engineer.
5. Construction shall be in strict conformance to the latest Texas Manual of Uniform Traffic
Control Devices for Streets and Highways , published by the Texas Department of
Transportation, and all other State and Federal laws governing utility construction.

The location or description of the proposed installation is more fully shown by 3
copies of the drawings attached to this notice.
I understand and agree that:
1. The County Engineer must be notified 72 hours prior to the beginning
of construction in order that he, or his designated inspector, may
inspect the actual installation.
2. All damage to the roadways and rights-of-way will be repaired to their
original condition to the satisfaction of the County Engineer.
3. Brazos County reserves the right to require Applicant to relocate or
lower any such line at no cost to Brazos County, should same
become necessary due to widening or lowering, or other alteration of
the roadway or right-of-way.
4. Brazos County will in no way be responsible for any damage which
might occur to any existing utility lines in the right-of-way.
5. The line will be constructed and maintained on the County right-of-way in
accordance with the Utility Accommodation Policy which was adopted by the
Texas Department of Transportation on May 29, 1989.
6. The line or lines will be constructed no less than twenty-four inches (24")
lower than the lowest part of the drainage or bar ditch and the drainage is to
be considered at least two feet (2') below the center of the roadway.
7. All sites will be barricaded during the construction period.
