To make arrangements, please call (979) 361-4102 Office of the County Judge • 200 South Texas Ave. 0 Suite 332 • Bryan, Taxes 77803 • Fax: (979) 361.4503 COMMISSIONERS' COURT SPECIAL MEETING JUNE 1, 2009 A special meeting of the Commissioners' Court of Brazos County, Texas was held in Commissioners Courtroom in the County Administration Building, 200 South Texas Avenue, in Bryan, Brazos County, Texas, beginning at 9:00 a.m. on Monday, June 1, 2009 with the following members of the Court present: Randy Sims, County Judge, Absent; Lloyd Wassermann, Commissioner of Precinct 1; Duane Peters, Commissioner of Precinct 2, Presiding; Kenny Mallard, Commissioner of Precinct 3; Carey Cauley, Jr., Commissioner of Precinct 4, Deceased; Karen McQueen, County Clerk, Absent. The attached sheet contains the names of the citizens and officials that were in attendance. Commissioner Peters called the meeting to order and then proceeded to consider the settlement of eminent domain action, 502-CC, Brazos County v. Joe Marino in the County Civil Court at Law No. 2, Brazos County, Texas. On motion by Commissioner Mallard, seconded by Commissioner Wassermann, the Court voted unanimously to approve the Rule 11 Agreement in which the County will pay Mr. Marino $220,000 for the property. A copy of the Rule 11 Agreement is attached. Brazos county will pay Joe Marino the sum cf $220,000.00 for tha fee simple mineral and water 2. Sel_er will reserve the oil, gas, rights, but will retain V& surface rights. 3. Brazos county will indemnify and hold harmless Joe Marino nor any and all liability for ea'7lronmental hazards or conditions on the property. 4. Brazos County will have access to the property aeon apprcval of the agreement by the County Cc=issionera. 5.
