Designation of the Brazos Center, in lieu of the Brazos County Expo Center, as a Medical Special Needs (MSN) Shelter during coastal hurricane evacuations. 11. Out of state travel request from the County Clerk for Jaime Hines, Election Coordinator, to attend the 2009 International Association of Clerks, Recorders, Election Officials & Treasurers annual conference (Election Officials Division Education Program) in Spokane, WA on 7-11 July 2009. Travel cost will be paid from the HAVA Education Grant. 12. Out of state travel request from the Expo Complex for Megan Kasperbauer, Event Marketing Coordinator, to attend the Event and Arena Marketing Conference in Colorado Springs, CO on 10-13 June 2009. 13. Tax Refund Applications for the following: a. OPTU Technologies b. Jennifer M. Holley c. Emmanuel & Marilou Velante 14. Approval of a Public Official Bond, effective 1 June 2009. 15. Permission to award RFP 2009-40, Lawn Maintenance Service, to Green Teams, Inc. based on best price. 16. Wickson Creek Special Utility District's cost estimate of $2,000.00 to relocate approximately 500 feet of 3 inch waterline (at the County's request) on Oak Lake Road to accommodate bridge construction. Site is located in Precinct 2. 17. Request from Verizon Communications to construct buried cable installations in the south right of way of Dilly Shaw Tap Road beginning at its intersection with FM 2776 and extending west for a distance of 853 feet. Site is located in Precinct 2. 18. Acceptance of a Dedication Deed from Anthony L. Jones to Brazos County, Texas of a 1.114 acre tract in the W. H. Frazier survey for a public roadway. Site is located in Precinct 1. 19. Acceptance of a Utility Easement from Anthony L. Jones to Brazos County, Texas of two (2) electrical easements in Aggie Acres. Site is located in Precinct 1. 20. Adjourn PUBLIC COMMENTS Public Comment during the Commission Meeting may be for all matters, both on and off the agenda, and be limited to four minutes per person. Persons are invited to submit comments in writing on the agenda items and/or attend and make comment at the Commission meeting. Members of the public are reminded that the Brazos County Commissioners Court is a Constitutional Court, with both judicial and legislative powers, created under Article V, Section 1 and Section 18 of the Texas Constitution. As a Constitutional Court, the Brazos County Commissioners Court also possesses the power to issue a Contempt of Court Citation under Section 81.024 of the Texas Local Government Code. Accordingly, members of the public in attendance at any Regular, Special and/or Emergency meeting of the Court shall conduct themselves with proper respect and decorum in speaking to, and/or addressing the Court; in participating in public discussions before the Court; and in all actions in the presence of the Court. Those members of the public who are inappropriately attired and/or who do not conduct themselves in an orderly and appropriate manner will be ordered to leave the meeting. Refusal to abide by the Court's Order and/or continued disruption of the meeting may result in a Contempt of Court Citation. It is not the intention of the Brazos County Commissioners Court to provide a public forum for the demeaning of any individual or group. Neither is it the intention of the Court to allow a member (or members) of the public to insult the honesty and/or integrity of the Court, as a body, or any member or members of the Court, or County employees, individually or collectively. Accordingly, profane, insulting or threatening language directed toward the Court and/or any person in the Court's presence and/or racial, ethnic or gender slurs or epithets will not be tolerated. Violation of these rules may result in the following sanctions: I. cancellation of a speakers time; 2. removal from the Commissioners Court; 3. a Contempt Citation; and/or 4. such other and/or criminal sanctions as may be authorized under the Constitution, Statutes and Codes of the State of Texas. The County Commissioners Court can deliberate or take action only if a matter has been listed on an agenda properly posted prior to the meeting. During the public comment period, speakers may address matters not listed on the published agenda. The Open Meeting Law does not expressly prohibit responses to public comments by the Commissioners Court. However, responses from the County Judge or Commissioners to unlisted public comment topics could become deliberation on a matter without notice to the public. To ensure the public has notice of all matters the Commissioners Court will consider, the County Judge and/or Commissioners may choose not to respond to public comments, except to correct factual inaccuracies, recite existing policy in response to an inquiry or to ask that a matter be listed on a future agenda. See Texas Open Meetings Act §551.042. The County Administration Building is wheelchair accessible. Handicap parking spaces are available. Any request for sign interpretive services must be made two working days before the meeting. To make arrangements, please call (979) 361-4102. i0L 101 PtlaE I (DO COMMISSIONERS' COURT REGULAR MEETING MAY 26, 2009 A regular meeting of the Commissioners' Court of Brazos County, Texas was held in the Brazos County Commissioners Courtroom in the Administration Building, 200 South Texas Avenue, in Bryan, Brazos County, Texas, beginning at 9:00 a.m. on Tuesday, May 26, 2009 with the following members of the Court present: Randy Sims, County Judge, Absent; Lloyd Wassermann, Commissioner of Precinct 1; Duane Peters, Commissioner of Precinct 2, Presiding; Kenny Mallard, Commissioner of Precinct 3; Carey Cauley, Jr., Commissioner of Precinct 4, Deceased; Karen McQueen, County Clerk, Absent. The attached sheet contains the names of the citizens and officials that were in attendance. Commissioner Peters gave the invocation and then led the pledge of allegiance. There was no citizen input/and or concerns. The first matter before the Court was a request from the Juvenile Services Department requesting the transfer of $2,307.20 to use the funds to employ a temporary cook through Manpower, a temporary service agency. On motion by Commissioner Wassermann, seconded by Commissioner Mallard, the Vol a Page to I Commissioners Court meeting May 26, 2009 2 Court voted unanimously to approve the request. The Court next considered Budget Amendment #08/09-33.1 through 33.8 that would reallocate funds for Juvenile Services, General Permanent Improvement Fund, Justice of the Peace Technology Fund, 361st District Court, Law Library Fund, Magistrate; and transfer funds from Contingency to Justice of the Peace, Precinct 3, Court Support Costs. On motion by Commissioner Mallard, seconded by Commissioner Wassermann, the Court voted unanimously to approve the budget amendment as submitted. A copy each amendment is attached. The Court proceeded to consider the change of status of employees as submitted on the attached Personnel Action Requests. On motion by Commissioner Wassermann, seconded by Commissioner Mallard, the Court voted unanimously to approve the changes as submitted. The Court next considered the following Claims as submitted by the County Treasurer for payment: 7062243 through 7062515 On motion by Commissioner Mallard, seconded by Commissioner Wassermann, the Court voted unanimously to approve the Claims as submitted. The next matter before the Court was the appointment of an individual to serve on the Board of Directors for the Vol Id-1 Page 10 Commissioners Court meeting May 26, 2009 3 Brazos Valley Groundwater Conservation District representing Brazos County. On motion by Commissioner Mallard, seconded by Commissioner Wassermann the Court voted unanimously to appoint Mr. Steve Beachy to serve on the Board of Directors of the Brazos Valley Groundwater Conservation District effective July 1, 2009 through December 31, 2011. Commissioner Peters suggested that some of the meetings be held here rather than always in Robertson County. The next matter before the Court was consideration of a request from the Sheriff's Office for permission to apply for the 2010 Edward Byrne Memorial Justice Assistance Formula Grant for the purchase of specific equipment. This is a 100 percent grant with no County funds required. On motion by Commissioner Wassermann, seconded by Commissioner Mallard, the Court voted unanimously to approve the request submitted by the Sheriff's Office for permission to apply for the 2010 Edward Byrne Memorial Justice Assistance Formula Grant for the purchase of specific equipment and to accept such funds as may be awarded. A copy of the grant application is attached. The Court next considered a request from the County Clerk to transfer $1,252.00 from the County Clerk's DDEA fund to the HAVA Education Grant Fund. On motion by Commissioner Mallard, Vol 191 Page 1( 3 Commissioners Court meeting May 26, 2009 4 seconded by Commissioner Wassermann, the Court voted unanimously to approve the request. The next matter before the Court was the designation of the Brazos Center as a Medical Special Needs Shelter during coastal hurricane evacuations. This action will qualify Brazos County to receive State and Federal medical resources in the event of activation as a MSN site. The Expo Center was designated originally but the Brazos Center was ultimately chosen. On motion by Commissioner Peters, seconded by Commissioner Wassermann, the Court voted unanimously to designate the Brazos Center as a medical Special Needs Shelter during coastal hurricane evacuations. The next matter for consideration by the Court was a request submitted by the County Clerk seeking approval for out of state travel for Elections Clerk Jaime Hines to travel to Spokane, Washington to attend the IACREOT Conference July 7- 11, 2009. Travel costs will be paid from the HAVA Education Grant. On motion Commissioner Wassermann, seconded by Commissioner Mallard, the Court voted unanimously to grant the request from the County Clerk and approved payment of out of state travel expense for Ms. Jaime Hines. The next matter for consideration by the Court was a request submitted by the Tom Quarles, Director of Special Vol j a i Page 1(94 Commissioners Court meeting May 26, 2009 5 Event Facilities seeking approval for out of state travel for Megan Kasperbauer, Expo Marketing Coordinator to travel to Colorado Springs, Colorado to attend the "Event and Arena Marketing Conference" June 10-13, 2009. On motion by Commissioner Peters, seconded by Commissioner Mallard, the Court voted unanimously to grant the request from the Director of Event Facilities and approved payment of out of state travel expense for Ms. Megan Kasperbauer. The next matter for consideration was approval of tax refund applications from the following individuals and/or companies: a. OPTU Technologies, over payment $12.21 b. Jennifer M. Holley, over payment $40.93 c. Emmanuel & Marilou Velante, over payment $73.21 On motion by Commissioner Peters, seconded by Commissioner Wassermann, the Court voted unanimously to approve the tax refund applications. The Court next considered approval of the Public Official Bond of Irma Cauley. On motion by Commissioner Peters, seconded by Commissioner Wassermann, the Court voted unanimously to approve the bond. It is to become effective June 1, 2009 and end December 31, 2009. The next matter before the Court was awarding RFP 2009- 40, Lawn Maintenance Service. Pat Howard, Purchasing Agent, Vol 1 D-1 Page 16-G Commissioners Court meeting May 26, 2009 6 recommended awarding the RFP to Green Teams, Inc. On motion by Commissioner Mallard, seconded by Commissioner Wassermann, the Court voted unanimously to accept the recommendation of the Purchasing Agent and award the RFP to Green Teams, Inc. A copy of the bid tabulation is attached. The Court next considered acceptance of Wickson Creek Special Utility District's cost estimate of $2,000.00 for relocation of approximately 500 feet of 3 inch waterline on Oak Lake Road to accommodate bridge construction in Precinct 2. On motion by Commissioner Peters, seconded by Commissioner Mallard, the Court voted unanimously to accept Wickson Creek Special Utility District's cost estimate of $2,000.00 for relocation of a waterline on Oak Lake Road. The Court next considered the request from Verizon Communications to construct buried cable installations in the south right-of-way of Dilly Shaw Tap Road beginning at its intersection with FM 2776 and extending west for a distance of 853 feet. The site is located in Precinct 2. The County Engineer stated that all appeared to be in order and recommended approval. On motion by Commissioner Peters, seconded by Commissioner Wassermann, the Court voted unanimously to approve the request from Verizon Communications Vol i a l Page I to ( Commissioners Court meeting May 26, 2009 7 and authorized the installation. A copy of the request is attached hereto. The Court next considered acceptance of a Dedication Deed from Anthony Lee Jones of 1.114 acres on Reveille Road in Precinct 1. Commissioner Wassermann moved to accept the Dedication Deed. Commissioner Mallard seconded the motion. Court Council, Tina Snelling County Attorney-Civil Division asked if there was discussion on this matter. If not, then it should be acknowledged rather than accepted. Commissioner Mallard then moved to amend the original motion to state the Court acknowledged receipt of the Dedication Deed from Anthony Lee Jones. Commissioner Peters seconded the motion and it carried unanimously. The next matter before the Court was acceptance of a Utility Easement from Anthony L. Jones to Brazos County, Texas of two (2) electrical easements in Aggie Acres. The site is located in Precinct 1. on motion by Commissioner Wassermann, seconded by Commissioner Mallard, the Court voted unanimously to acknowledge receipt of the Utility Easement from Anthony L. Jones. The Court acknowledged receipt of the Investment Report for the quarter ending March 31, 2009. The City will be doing some road widening and may need some right-of- way. Debbie Lockledge a) Services for Commissioner Cauley will be held on Friday, May 29, 2009 at 1:00 p.m. at the First Methodist Church. Visitation will be held at People's Mortuary on Thursday, May 28, 2009 from 6:00 p.m. until 8:00 P.M. Under citizen input and/or concerns, the following spoke: Chief Deputy Sheriff Clyde Collins a) There were 542 inmates in jail, 68 are out of County, 78 have monitors. Under Agency/Board/Committee reports by Court members, the following spoke: Commissioner Mallard a) RVP hosted a gathering of elected officials this morning to discuss the Next Generation Industrial Park with Congressman Chet Edwards. He is helping with a grant concerning the rail line. b) The High Speed Rail Bill 1570 passed unanimously on May 21, 2009. Through purchases of equipment and technology we hope to improve the capabilities in these areas. #1 report scanning backlog - to provide for digital search & retrieval, the Brazos County Sheriff's Office must manually scan the offense, supplemental reports and other paper evidence in to a legacy software system because of incompatibility of the CAD System and the County's software system. Currently we are using a flatbed scanner that is shared with other units in our office. There is a back-log that amounts to about 1 years of reports. By adding a desk top scanner and adding the scanner to the software license agreement we should be able to reduce this back-log. #2 improved photo ID for sex offender registration - the Brazos County Sheriff s Office through a Cooperative Agreement with Bryan Police Department and College Station Police Department handles all of the required registration of sex offenders for the whole county. The sex offenders are compelled by law to register and submit to photographing annually or at any time that they change their appearance. The intention of the project is to provide a camera and software system that will allow for quality digital photos to be taken and have a system that stores and retrieves the photos in a format that is capable of being shared with the partner agencies, prepared in Alert bulletins and posting on the appropriate websites. 43 expanded crime scene and forensic investigation capabilities - to provide a laptop computer with portable printer which will be used by Brazos County Sheriff's Investigators at crime scenes to enhance capabilities to log evidence, download crime scene photos, and write & print reports notices, probable cause statements, search warrants and other documents. The laptop would also have capabilities for connecting to sites for searching GPS maps and aerial & satellite photographs. Also propose to provide a Forensic Optical Comparator with Optical Enhancement which will allow for the side by side comparison of known and suspect fingerprint impressions with latent prints. This piece of equipment will be added to the Sheriff s Office forensic lab which will expand the Office's capabilities to analyze latent prints and potentially enhance solvability. Supporting Data: 41 Brazos County Sheriff s Office responds to approximately 11,000 calls for service each generates reports, supplement reports and other paperwork used to follow-up and track deputies activities. These efforts generate30,000 of pages of reports that are scanned and converted to digital images so they can be stored for tracking and retrieval. The Sheriff's Office has two full-time clerks who handle the scanning task on one shared scanner along with other duties. This has resulted in a backlog of scanning. 42 - Brazos County currently has 211 sex offenders required to register. Each offender is photographed in a manner that would allow for identification including photos of relevant characteristics. #3 In 2008 the Brazos County Sheriff's Office investigated 5 Forcible Rapes, 61 Aggravated Assaults, 175 Burglaries 265 cases of Larceny and 27 Motor Vehicle Thefts. For 2009 Brazos County has been dealing with a significant increase in the reports of Burglary of Habitations with 81 having been reported since January 15`. Critical to the successful clearance of these crimes is a thorough crime scene investigation with available technology. Criminal Justice and Law Enforcement Issues is the first of the three primary issues addressed in the Community Plan. The issue listed as the highest priority is Priority 1: Law enforcement agencies are not able to keep up with the demand on their services. In order to leverage the current resources there needs to be an increase in personnel equipment and trainin to the local law enforcement with priority given to these actions when funding comes available. The Brazos County Investment portfolio earned an average yield of 0.7336% on the quarterly average balance of $2,332,904.14 invested with TexPool for the period ending 03/31/2009. Investment interest deposited during the quarter was $4,229.06. Actual ending balance for March 2009 was $2, 334,067.60 The average Earnings Credit Rate on checking account interest for the quarter ending 03/31/2009 was 0.5033% netting $135,098.04 on an average depository balance of $109,348,500.37 Total year-to-date interest earned $366,192.09 Investment Strategy Taking into consideration the current uncertain market conditions, the Brazos County Investment Strategy will remain biased toward safety of County funds first and foremost. As economists are anticipating a possible increase in the Fed rate, purchasing securities that would lock in historically low yields for a longer term would represent a maturity risk. It seems prudent, therefore, to protect County funds by keeping the majority of available funds in the County's depository where all funds are 110% collateralized. The County' also maintains an investment account with Texpool which, though not collateralized, does provide the safety of an overnight market. At this time, the County's investment strategy remains unchanged with a concentration of County funds in the Brazos County Depository.
