COMMISSIONERS' COURT WORKSHOP SESSION MARCH 24, 2009 The Commissioners' Court of Brazos County, Texas met in a Workshop Session in the Commissioners' Courtroom in the Courthouse in Bryan, Brazos County, Texas, beginning at 10:00 a.m. on Tuesday, March 24, 2009 with the following members of the Court present: Randy Sims, County Judge, Presiding; Lloyd Wassermann, Commissioner of Precinct 1; Duane Peters, Commissioner of Precinct 2; Kenny Mallard, Commissioner of Precinct 3; Carey Cauley, Jr., Commissioner of Precinct 4; Karen McQueen, County Clerk. Attached is a list of the citizens and officials in attendance. The Commissioner's Court met to discuss the development of rules and regulations for brick/stone mailboxes. The Court first watched a TxDOT mailbox video. Both Richard Vance, County Engineer and Gary Arnold, Director of Planning and Traffic for the Road & Bridge Department discussed their concerns with the Court. They then fielded questions from the Court members. At one point the question of the County's liability was raised whereupon, Kay Magness, County Attorney, Civil Division explained the County's liability concerning road obstructions. She suggested that whatever is ultimately Vol (q Page X09 Commissioners Court workshop March 24, 2009 2 decided, it be included on the plat so that should there be a lawsuit, the County will have a stronger case. After further discussing, it was suggested that the Court simply adopt TxDOT standards on mailboxes. Commissioner Mallard stated that the Court needed to hear from an expert. Also needed to know how to legally defend the County because he was sure there will be lawsuits regardless of what the Court decides. Tina Snelling, County Attorney, Civil Division, again explained the liability and legality of the situation. Commissioner Mallard stated he would like to know if there were any lawsuits on this issue in other counties. Commissioner Peters wanted information on low speed crashes. Gary Arnold, Director of Planning and Traffic suggested having another workshop in two (2) weeks.
