19. Adjustment to the Warehouse 14 inventory removing from inventory obsolete or
defective cartridges, declaring them surplus for auction, and deleting stock numbers
1460, 1503, 1506, 1511, 1516, 1607, 1608, 1609, 1610, 1709, 1800, 1801, 1802, 1803
and 1998 from the Pentamation Warehouse module.
20. Permission to add Shirley Kostobryz to Brazos County's list of vendors who are
exempt from competitive bidding for FY09 as per Statute 262.024(a)(4).
21. Requisition 00023426 in the amount of $37,857.48 to Wilton's Office Works for the
District Attorney's Office to purchase furniture on state contract.
22. Requisition 00023393 in the amount of $20,000.00 to Bryan Texas Utilities to cover
estimated usage of electricity for an undetermined period of time for the Brazos County
Detention Center.
23. Renewal of the current RFP 2008-023 for internet service provider for the Courthouse
Complex to Managed Network Solutions at the same cost, with new RFP number of
2009-32R.
24. Request from Verizon Communications to construct 365 feet of buried communications
cable in the new right of way of Wilcox Lane (at Brazos County's request) to
accommodate new bridge construction; cable will be buried at a minimum dept of 30
inches. Site is located in Precinct 2.
25. Wickson Creek Special Utility District's cost estimate of $8,125.00 to relocate
approximately 2,500 feet of waterline on Clear Lake Road (at Brazos County's request)
to accommodate roadway improvements. Site is located in Precinct 2.
26. Wickson Creek Special Utility District's cost estimate of $29,900.00 to relocate
approximately 9,200 feet of waterline on Wickson Lake Road (at Brazos County's
request) to accommodate roadway improvements. Site is located in Precinct 2.
27. Wickson Creek Special Utility District's cost estimate of $1,750.00 to relocate
approximately 500 feet of waterline on Wilcox Lane (at Brazos County's request) to
accommodate roadway improvements. Site is located in Precinct 2.
28. Final Plat of DST Estates, 15.00 acres, Mary Lawrence League, A-30, Brazos County,
Texas with request to allow variance of the 10 ft. utility easement (Subdivision and
Development Regulations, Article V, Section C, No. 16), lots 1 & 2, and 2 & 3. Site is
located in Precinct 2.
29. Request from Anthony L. Jones to construct an 8 inch waterline in the right of way of

PUBLIC COMMENTS
Public Comment during the Commission Meeting may be for all matters, both on and off the agenda, and be limited to
four minutes per person. Persons are invited to submit comments in writing on the agenda items and/or attend and make
comment at the Commission meeting. Members of the public are reminded that the Brazos County Commissioners
Court is a Constitutional Court, with both judicial and legislative powers, created under Article V, Section 1 and Section
18 of the Texas Constitution. As a Constitutional Court, the Brazos County Commissioners Court also possesses the
power to issue a Contempt of Court Citation under Section 81.024 of the Texas Local Government Code. Accordingly,
members of the public in attendance at any Regular, Special and/or Emergency meeting of the Court shall conduct
themselves with proper respect and decorum in speaking to, and/or addressing the Court; in participating in public
discussions before the Court; and in all actions in the presence of the Court. Those members of the public who are
inappropriately attired and/or who do not conduct themselves in an orderly and appropriate manner will be ordered to
leave the meeting. Refusal to abide by the Court's Order and/or continued disruption of the meeting may result in a
Contempt of Court Citation.
It is not the intention of the Brazos County Commissioners Court to provide a public forum for the demeaning of any
individual or group. Neither is it the intention of the Court to allow a member (or members) of the public to insult the
honesty and/or integrity of the Court, as a body, or any member or members of the Court, individually or collectively.
Accordingly, profane, insulting or threatening language directed toward the Court and/or any person in the Court's
presence and/or racial, ethnic or gender slurs or epithets will not be tolerated. Violation of these rules may result in the
following sanctions:
1. cancellation of a speaker's time;
2. removal from the Commissioners Court;
3. a Contempt Citation; and/or
4. such other and/or criminal sanctions as may be authorized
under the Constitution, Statutes and Codes of the State of Texas.
The County Commissioners Court can deliberate or take action only if a matter has been listed on an agenda properly
posted prior to the meeting. During the public comment period, speakers may address matters not listed on the published
agenda. The Open Meeting Law does not expressly prohibit responses to public comments by the Commissioners Court.
However, responses from the County Judge or Commissioners to unlisted public comment topics could become
deliberation on a matter without notice to the public. To ensure the public has notice of all matters the Commissioners
Court will consider, the County Judge and/or Commissioners may choose not to respond to public comments, except to
correct factual inaccuracies, recite existing policy in response to an inquiry or to ask that a matter be listed on a future
agenda. See Texas Open Meetings Act §551.042.
The County Administration Building is wheelchair accessible. Handicap parking spaces are available. Any request for sign

COMMISSIONERS' COURT
REGULAR MEETING
MARCH 17, 2009
A regular meeting of the Commissioners' Court of Brazos
County, Texas was held in the Commissioners Courtroom in the
Brazos County Administration Building, 200 South Texas Avenue,
in Bryan, Brazos County, Texas, beginning at 6:00 p.m. on
Tuesday, March 17, 2009 with the following members of the Court
present:
Randy Sims, County Judge, Presiding;
Lloyd Wassermann, Commissioner of Precinct l;
Duane Peters, Commissioner of Precinct 2;
Kenny Mallard, Commissioner of Precinct 3;
Carey Cauley, Jr., Commissioner of Precinct 4;
Karen McQueen, County Clerk, Absent.
The attached sheet contains the names of the citizens and
officials that were in attendance.
Commissioner Peters opened the meeting and presided over
agenda items 1 through 10. The Count Judge presided from
agenda item 11 through to the end. Commissioner Cauley came
in at agenda item 5.
Commissioner Wassermann gave the invocation and led the
pledge of allegiance.
There was no citizen input/and or concerns.

The first matter before the Court was a request from the
Veterans Services officer for permission to add a cell phone
allowance for his position. On motion by Commissioner
Wassermann, seconded by Commissioner Mallard, the Court voted
unanimously to approve the request for the addition of a cell
phone allowance for the Veterans Services Officer.
The Court next considered Budget Amendment #08/09-23.1
through 23.4, which would reallocate funds for the District
Attorney's Office, County Clerk Management Fund; transfer
funds from Contingency to Veterans Office; and adjust the
budget of the Law Enforcement Officers Standards and Education
Fund. On motion by Commissioner Mallard, seconded by
Commissioner Wassermann, the Court voted unanimously to
approve the budget amendment as submitted, a copy of which is
attached.
The Court proceeded to consider the change of status of
employees as submitted on the attached Personnel Action
Requests. On motion by Commissioner Wassermann, seconded by
Commissioner Mallard, the Court voted unanimously to approve
the change of status as submitted.
The Court next considered the following Claims as
submitted by the County Treasurer for payment:

On motion by Commissioner Wassermann, seconded by Commissioner
Mallard, the Court voted unanimously to approve the Claims as
submitted.
The next matter before the Court was to consider
adopting of Order #09-004 Adopting Contracting Rules for
persons indebted to Brazos County. Pursuant to Texas Local
Government Code §262.0276, a Commissioner's Court is
authorized to adopt rules permitting a county to refuse to
enter into a contract or other transaction with a person
indebted to the County. On motion by Commissioner
Wassermann, seconded by Commissioner Mallard, the Court voted
unanimously to adopt the Order #09-004 Adopting Contracting
Rules for Persons Indebted to Brazos County, to be effective
immediately. A copy of the Order is attached hereto.
The Court next considered County Order #09-002
Establishing a Burn Ban for Brazos County. Chuck Frazier,
Emergency Management Coordinator spoke about the recent rain
and the KBDI index and recommended lifting the burn ban even
though the index is not where they hoped it would be. He
asked that this item remain on the agenda each week for
consideration. Commissioner Mallard asked if the Road &
Bridge Department had done anything about signage for the
Burn Ban. Mr. Frazier answered that it was in the works. On

motion by Commissioner Mallard, seconded by Commissioner
Wassermann, the Court voted unanimously to lift the Burn Ban
established by Brazos County Order #09-002.
The next matter before the Court was consideration of an
amendment to the Personnel Policy Manual with the addition of
Section 2.03.8, Floating Holiday. On motion by Commissioner
Peters, seconded by Commissioner Mallard, the Court voted
unanimously to approve the addition of Section 2.03.8 to the
Personnel Policy Manual. A copy is attached.
The Court next considered the appointment of individuals
to serve on the Local Workforce Development Board, Board of
Directors. On motion by Commissioner Peters, seconded by
Commissioner Mallard, the Court voted unanimously to appoint
Tashia Dickerson representing the Private Sector and Janell
Ramirez representing Post Secondary Education. The term of
both appointments is from March 30, 2009 through June 30,
2012.
The Court next considered a request from Constable
Precinct 2, Donald Lampo, to appoint Jeffery L. Harris, as
non-paid Deputy Constable. On motion by Commissioner Peters,
seconded by Commissioner Wassermann, the Court voted
unanimously to approve the request from Constable Lampo to
appoint Jeffery L. Peters as non-paid Deputy Constable

subject to appointment being within the allotted number of
deputies.
The next matter before the Court was consideration of
the appointment of an individual to serve on the Board of
Directors of the Brazos Animal Shelter. On motion by
Commissioner Wassermann, seconded by Commissioner Peters, the
Court voted unanimously to appoint Dr. Laura Bay-Williams to
serve on the Board of Directors. The appointment is
effective immediately and expires on October 1, 2010.
The Court proceeded to consider a Commodities Contract
with the United States Department of Agriculture for the
2009-2010 academic year for the Brazos County Juvenile
Services Department. On motion by Commissioner Peters,
seconded by Commissioner Mallard, the Court voted unanimously
to approve the Commodities Contract. A copy is attached.
The next matter before the Court was consideration of
the transfer by Brazos County of the following lots to the
Build Initiative:
a. Oliver, Block 3, Lot 3 located at 911 Acheson St.
b. Yeager, Block 1, Lots 1 & 2 located at 103 Moss St.
c. Austin, Block 1, part of Lot 4 located at 1009 MLK

On motion by Commissioner Peters, seconded by Commissioner
Cauley, the Court voted unanimously to approve the tax refund
applications.
The next matter for consideration by the Court was a
request submitted by Commissioner Mallard seeking approval
for out of state travel for himself. Commissioner Mallard
would be traveling to Washington D.C. with the Chamber of
Commerce May 11-14, 2009. On motion by the County Judge,

seconded by Commissioner Peters, the Court voted unanimously
to grant the request from Commissioner Mallard and approved
payment of out of state travel expense for Commissioner Kenny
Mallard.
On motion by Commissioner Peters, seconded by
Commissioner Cauley, the Court voted unanimously to receive,
approve and order filed as submitted the Treasurer's report
for January 2009. A copy of which is attached to and made a
part of these minutes.
The Court next considered approval of the minutes of the
Commissioners' Court meetings held in December 2008, and
January and February 2009 on the following dates:
Regular Meetings December - 2nd, 9th, 16th, 23rd 30th
Regular Meetings January - 6th, 13th, 20, 27th
Regular Meetings February - 3rd, 10th, 17th, 24th
Special Meeting January - 15th
Workshop Session January - 29th
On motion by Commissioner Peters, seconded by Commissioner
Wassermann, the Court voted unanimously to approve the
minutes as submitted.
The next matter before the Court was an adjustment to

Commissioner Peters, seconded by Commissioner Cauley, the
Court voted unanimously to approve the adjustment to the
Warehouse 14 inventory.
The Court next considered an Exemption from Competitive
Bidding Requirements of Local Government Code, Section
262.024(a)(4). The Purchasing Department is requesting that
Shirley Kostohryz be added to the list of exempt bidders. On
motion by Commissioner Mallard, seconded by Commissioner
Cauley, the Court voted unanimously to approve the Exemption
of Competitive Bidding Requirements and authorized the
addition of Shirley Kostohryz to the list of exempt vendors.
The next matter before the Court was consideration of
requisition #00023426 to Wilton's Office Supply in the amount
of $37,857.48 for the purchase of furniture for the District
Attorney's Office. On motion by Commissioner Peters,
seconded by Commissioner Mallard, the Court voted unanimously
to approve the requisition.
The Court next considered requisition #00023393 To BTU
in the amount of $20,000.00 to cover estimated usage of
electricity for an undetermined period of time at the Brazos
County Detention Center. On motion by Commissioner Peters,

seconded by Commissioner Cauley, the Court voted unanimously
to approve the requisition.
The next matter before the Court was consideration of
the renewal of the current RFP 2008-023 for internet service
provider for the Courthouse Complex to Managed Network
Solutions, with a new RFP number of 2009-32R. There will be
no change in cost. On motion by Commissioner Peters,
seconded by Commissioner Cauley, the Court voted unanimously
to approve the renewal of the current RFP with Managed
Network Solutions.
The Court next considered the request from Verizon
Communications to construct 365 feet of buried communications
cable in the new right-of-way of Wilcox Lane. The site is
located in Precinct 2. The County Engineer stated that all
appeared to be in order and recommended approval. On motion
by Commissioner Peters, seconded by Commissioner Wassermann,
the Court voted unanimously to approve the request from
Verizon Communications and authorized the installation. A
copy of the request is attached hereto.
The Court next considered acceptance of Wickson Creek
Special Utility District's cost estimate of $8,125.00 for

The Court next considered acceptance of Wickson Creek
Special Utility District's cost estimate of $1,750.00 to
relocate approximately 500 feet of water line on Wilcox Lane
in Precinct 2. On motion by Commissioner Peters, seconded by
Commissioner Cauley, the Court voted unanimously to accept
Wickson Creek Special Utility District's cost estimate of
$1,750.00 for relocation of a water line on Wilcox Lane.
The Court next considered approval of the Final Plat of
DST Estates, 15.00 Acres along with a request to allow

variance of the 10 foot utility easement between Lots 1 & 2
and 2 & 3 in Precinct 2. Richard Vance, County Engineer,
stated that the developer has platted a 20 foot Public
Utility Easement, rather than the required 16 foot PUE along
the subdivision boundary lines. On motion by Commissioner
Peters, seconded by Commissioner Cauley, the Court voted
unanimously to approve the final plat of DST Estates as
submitted and to grant the variance.
The Court next considered the request from Anthony L.
Jones to construct an 8" water line in the right-of-way of
Walnut Road to provide service to Aggie Acres Subdivision.
The site is located in Precinct 1. The County Engineer
stated that all appeared to be in order and recommended
approval. On motion by Commissioner Wassermann, seconded by
Commissioner Cauley, the Court voted unanimously to approve
the request from Anthony L. Jones and authorized the
installation. A copy of the request is attached hereto.
The Court next considered acceptance of a Special
Warranty Deed for right-of-way on Wilcox Lane in Precinct 2.
On motion by Commissioner Peters, seconded by Commissioner
Cauley, the Court voted unanimously to authorize the County
Judge to accept on behalf of Brazos County a Special Warranty

Deed from the Wilcox Family Revocable Living Trust for
improvements to Wilcox Lane.
The Court next considered acceptance of a Special
Warranty Deed for right-of-way on Wilcox Lane in Precinct 2.
On motion by Commissioner Peters, seconded by the County
Judge, the Court voted unanimously to authorize the County
Judge to accept on behalf of Brazos County a Special Warranty
Deed from Paul C. Patranella, Sr. Estate for improvements to
Wilcox Lane.
The next matter before the Court was consideration of a
payment authorization in the amount of $1,041.50 to James R.
Lock for expert testimony in a trial. No purchase order was
issued. On motion by the County Judge, seconded by
Commissioner Peters, the Court voted unanimously to approve
the payment authorization.
The Court considered a second payment authorization in
the amount of $75.00 to Barker Productions to copy a video
tape and enhancing it for a trial. No purchase was issued.
On motion by Commissioner Peters, seconded by Commissioner
Cauley, the Court voted unanimously to approve the payment
authorization.

The Court acknowledged receipt of the Texas A&M
University Police Department's 2008 Racial Profiling
Statistics Report.
Under announcement of interest items and possible future
agenda topics the following spoke:
Chuck Frazier, Emergency Management Coordinator
a) Said that he received an e-mail from Chris
Meyer stating that Reed Arena will no longer
be available as a medical needs shelter.
Mr. Frazier noted that we need to think
about this now. He thinks the Brazos Center

center. Commissioner Mallard suggested an

the e-mail Mr. Frazier received, Chris Meyer
stated that the MSC is being renovated and
pushing other groups into Reed Arena. He
went on to say that this will probably be a
problem for at least 3 years. A&M Staff and
resources, etc. will remain available.

ORDER ADOPTING CONTRACTING RULES FOR PERSONS INDEBTED
TO BRAZOS COUNTY
WHEREAS, pursuant to Texas Local Government Code, § 262.0276, a commissioners court is authorized
to adopt rules permitting a county to refuse to enter into a contract or other transaction with a person indebted to
the county;
WHEREAS, the Commissioners Court of Brazos County finds it is in the best interest of Brazos County
to adopt such rules;
NOW THEREFORE, BE IT ORDERED the following rules be adopted regarding Brazos County and
persons interested in doing business with Brazos County:
1. Brazos County may refuse to enter into a contract or other transaction with a person with a past due
debt to Brazos County, including delinquent ad valorem taxes, even if the person is the lowest bidder or
successful proposer; and
2. For purposes of this Order, a debt is past due if it is not received in the County Treasurer's Office by the
due date in a written agreement or notice, and ad valorem taxes are past due if not received in the County Tax
Assessor/Collector's Office by February 1 st following the January 1 st on which the ad valorem taxes are due.
3. For purposes of this Order, a person includes an individual, sole proprietorship, corporation, nonprofit
corporation, partnership, joint venture, limited liability company, and any other entity that proposes or otherwise
seeks to enter into a contract or other transaction with Brazos County requiring approval by the Commissioners
Court.
IT IS FURTHER ORDERED THAT this Order shall be effective upon approval.

Addition of Section 2.03.8 - Floating Holiday:
Commissioners Court may approve a Floating Holiday when approving the County
Holidays. Commissioners Court determines whether or not to allow for a floating
holiday each year. A floating holiday is a personal day available to full-time and part-
time employees, excluding temporary employees of Brazos County, upon completion of
six (6) months of employment. The Floating Holiday may be taken with approval from
their Department Head. The number of hours or duration of the Floating Holiday is to be
equal to the hours that would have been worked by the employee on a regular work day.
Floating Holiday must be taken by the last day of the pay period that includes days in the
previous calendar year and the new calendar year.
Employees may use their Floating Holiday for the new calendar year on the first day of
the full pay period of the new calendar year. It will be the Department Head's
responsibility to insure that the six-month probationary period is enforced and that each
eligible employee is allowed only one Floating Holiday.
This policy supersedes all policies and directories on Floating Holidays.

The Texas Department of Agriculture (TDA), hereinafter referred to as the Distribution Agency (DA) and
Brazos County Juvenile Services , hereinafter referred to as the Recipient
Agency (RA) entered in an agreement effective July 1, 2009, for the purpose of receiving United States
Department of Agriculture donated commodities for use in the National School Lunch Program.
1.
In order to test the feasibility of using the Department of Defense, Defense Supply Center Philadelphia
(DSCP), to purchase and deliver the best quality of fresh fruits and vegetables (fresh product) to shipping
points designated by RAs, both parties mutually agree to amend this agreement by adding the following
requirements for participation in the Fresh Fruits and Vegetables Project:
ORDERING SYSTEM
a. The RA shall place orders for fresh product directly with Department of Defense, Defense Supply
Center Philadelphia by using a Web Based online ordering system called FFAVORS WEB Ordering
at https://www.ffavorsweb.dscD.dla.mil. This web site includes a complete catalog of items available;
b. When ordering fresh product, the RA shall include the quantity and requested delivery date (consistent
with lead times established by the Defense Supply Office (DSO);
c. When ordering fresh product, the RA shall identify any unique ordering requirements (e.g. count, size
or grade) for DSO to ensure that accurate quality and quantity of fresh product is purchased; and
d. Notwithstanding normal ordering schedules and lead times, the RA may contact DSCP Customer
Service Representative to order from DSCP in cases of an emergency.
II.
SHIPMENT AND DELIVERY
a. When the fresh product is shipped to the RA, the RA shall be responsible for off-loading the fresh
product from the tailgate within a reasonable time. Often times the vendor will do this for you, but it
may not be required for them to do so;
b. Unless otherwise directed by DSCP, the RA shall exchange any pallets received from prior shipments
or from pallets on hand;
c. If the shipment has not arrived within one hour of the scheduled delivery time, the RA shall notify the
DSCP Customer Service Representative and take any corrective action requested by DSCP;
d. Prior to accepting any shipment, the RA shall count and verify the shipment and annotate any
overages or shortages on the vendor's ticket or government bill of lading;
e. Prior to accepting any shipment, the RA shall inspect the fresh product and call the DSCP if there is
any non-conformance, such as product quality or product damaged during shipment, to determine
disposition of the product. DSCP shall evaluate any non-conforming fresh product, utilizing
Customer Service Representatives, DSCP Product Specialists or FNS or AMS representatives, and
advise the RA as to whether to accept or reject the product and what actions to take if the fresh
product that has been accepted is later determined to be non-conforming;

f. Acceptance of a shipment shall be made by signing and dating the delivery ticket or government bill
of lading;
g. Using the FFAVORS WEB Ordering system, the RA shall enter any quantity discrepancies
discovered prior to acceptance or any rejected product within 24 hours of delivery, if any;
i. Within 24 hours of delivery, the RA shall notify DSCP Customer Service Representative of any
quality or condition defect of the fresh product discovered after acceptance of the fresh product; and
j. The RA shall complete any evaluation form that solicits information on the quality, condition,
timeliness, delivery and cost of the fresh produce and quality of DSCP service.
Title to the fresh product shall pass to the RA upon acceptance of the fresh product at the time and place
of delivery.
III.
All terms and conditions of the original agreement not in conflict with this amendment, are continued in
full force and effect.
This amendment is effective upon signature by both parties.

I.
In order to test the feasibility of using NSLP Section 4 and 11 funds to purchase fresh fruits and
vegetables through the Department of Defense (DOD), Defense Supply Center Philadelphia (DSCP), both
parties mutually agree to amend this agreement. The DSCP will purchase and deliver fresh produce to
shipping points designated by RAs. The agreement will be amended to include the following
requirements for participating in the Section 4 and 11 portion of the Fresh Fruit and Vegetable Project:

ORDERING SYSTEM
a. When orders are placed with the DSCP, the RA will identify if the order is to be paid for by the RA
with NSLP Section 4 and 11 funds.
b. Orders will only be placed for items in accordance with the Berry amendment (10 U.S.C. 2241 note).
The Berry amendment provides that DOD may purchase only domestic food products unless DOD
makes a formal finding that the product cannot be acquired as and when needed in a satisfactory
quality and sufficient quantity at U.S. market prices. In addition, the DPSC shall ensure that
purchases of fresh product are in accordance with the Buy American requirements of Section 3 (h) of
Pub. L.100-237 (U.S.C. 612c note) and 7 C.F.R. 250.23.
SHIPMENT AND DELIVERY
a. The RA will check all deliveries against invoices to ensure proper receipt of fresh products.
BILLINGS
a. The RA shall pay DPSC for all fresh product ordered and delivered. The amount owed shall be the
actual case price plus a DPSC surcharge. The surcharge includes all DPSC expenses related to orders,
acquisition, vendor invoicing, customer assistance, transportation and cold storage costs.
b. All billings are to be paid by the RA to the address specified by the DPSC within 30 days using
Section 4 and I I funds from the NSLP reimbursements received by the RA.
III.
All terms and conditions of the original agreement as amended not in conflict with this amendment, are
continued in full force and effect.
This amendment is effective upon signature by both parties.

ITEM: Request from Verizon Communications to construct 365 feet (at Brazos County's request)
of buried communications cable in the new right of way of Wilcox Lane to accommodate new
bridge construction; cable will be buried at a minimum depth of 30 inches. Site is located in
Precinct 2.
SOURCE OF FUNDS: N/A
PRESENTATION:
REQUIREMENTS:
1) No work will be permitted between front slope and/or back slope.
2) All installation(s) shall be constructed in designated utility easements, if applicable. If no utility
easement exists, the installation(s) shall be 1) within 3-5' of and parallel to the right-of-way line
and/or 2) in the case of a road bore, perpendicular to the right-of-way line.
3) If clearing of brush, trees and other obstruction is necessary, it shall be the Applicant's responsibility to
do so and to remove all cleared brush, trees etc, from county right-of-way.
4) Ditch line shall be compacted to 90% standard density ASTM-Test Method No. D-698; test shall be
conducted by an independent geotechnical testing firm; copies of all test results shall be furnished to
the office of the Brazos County Engineer.
5) Construction shall be in strict conformance to the latest Texas Manual of Uniform Traffic Control
Devices for Streets and Hi hg ways, published by the Texas Department of Transportation, and all other
State and Federal laws governing utility construction.

ATTENTION COUNTY JUDGE:
Formal notice is hereby given that GTE SOUTHWEST INC. d/b/a VERIZON
SOUTHWEST will construct a communication line within the right-of-way of a
County Road in Brazos County, Texas as follows:
Verizon will place 365 feet of buried communications cable 3 feet in the new
right-of-way established on Wilcox Lane at the location of a new bridge being
constructed across Little Wickson Creek. The cable is 0.56 inches in diameter
and will be buried at a minimum depth of 30 inches.
The location and description of this line and associated appurtenances is
more fully shown by four (4) copies of drawings attached to this notice. The line
will be constructed and maintained on the County Road right-of-way in
accordance with governing laws.
Notwithstanding any other provision contained herein, it is expressly
understood that the tender of this notice by the Verizon Southwest Incorporated
does not constitute a waiver, surrender, abandonment or impairment of any
property rights, franchise, easement, license, authority, permission, privilege or
right now granted by law or may be granted in the future and any provision or
provisions so construed shall be null and void.
Construction of this line will begin on or after MARCH 23, 2009.

The location or description of the proposed installation is more fully shown by 3 copies of the
drawings attached to this notice.
I understand and agree that:
1. The County Engineer must be notified 72 hours prior to the beginning of construction in
order that he, or his designated inspector, may inspect the actual installation;
2. All damage to the roadways and rights-of-way will be repaired to their original condition
to the satisfaction of the County Engineer;
3. Brazos County reserves the right to require Applicant to relocate or lower any such line
at no cost to Brazos County, should same become necessary due to widening or
lowering, or other alteration of the roadway or right-o[-way;
4. Brazos County will in no way be responsible for any damage which might occur to any
existing utility lines in the right-of-way:
5. The line will be constructed and maintained on the County right-of-way in accordance
with the Utility Accommodation Policy which was adopted by the Texas Department of
Transportation on May 29, 1989;
6. The line or lines will be constructed no less than twenty-four inches (24") lower than the
lowest part of the drainage or bar ditch and the drainage is to be considered at least two
feet (2') below the center of the roadway;
7. All sites will be barricaded during the construction period.
Construction of this line will begin on or after the 18 day of March , 2009.
