To make arrangements, please call (979) 361-4102. 11-A _ 50 COMMISSIONERS' COURT REGULAR MEETING AUGUST 26, 2008 A regular meeting of the Commissioners' Court of Brazos County, Texas was held in the Brazos County Commissioners Courtroom in the Administration Building, 200 South Texas Avenue, in Bryan, Brazos County, Texas, beginning at 9:00 a.m. on Tuesday, August 26, 2008 with the following members of the Court present: Randy Sims, County Judge, Presiding; Lloyd Wassermann, Commissioner of Precinct l; Duane Peters, Commissioner of Precinct 2; Kenny Mallard, Commissioner of Precinct 3; Carey Cauley, Jr., Commissioner of Precinct 4; Karen McQueen, County Clerk. The attached sheet contains the names of the citizens and officials that were in attendance. Commissioner Cauley gave the invocation and then led the pledge of allegiance. There was no citizen input/and or concerns. Marc Hamlin, District Clerk updated the Court on the NACo Prescription Card Program. They have set a new record for July 2008 having returned $35,082.39 back to the people. The Court next considered Budget Amendment #07/08-43.1 through 43.7 that would reallocate funds for the Hotel Vol I I a Page Commissioners Court meeting August 26, 2008 2 Occupancy Tax Fund, Constable, Precinct 1, Constable, Precinct 2, HAVA-General Compliance Grant; and close out Judicial Software Fund, Expo Center Fund and transfer funds to General Fund. On motion by Commissioner Cauley, seconded by Commissioner Peters, the Court voted unanimously to approve the budget amendments as submitted. A copy each is attached. The Court proceeded to consider the change of status of employees as submitted on the attached Personnel Action Requests. On motion by Commissioner Wassermann, seconded by Commissioner Cauley, the Court voted unanimously to approve the changes as submitted. The Court next considered the following Claims as submitted by the County Treasurer for payment: 7053242 through 7053480 On motion by Commissioner Peters, seconded by Commissioner Cauley, the Court voted unanimously to approve the Claims as submitted. The next matter before the Court was consideration of the renewal of the Agreement with Texas A&M University for Pre- Employment Psychological Screenings for Peace Officers and Detention Officers. The fee for the evaluations has increased from $230.00 to $240.00 each. There is no change in the fee for re-evaluations. The term of the agreement is from October Vol IW Page 51:~ Commissioners Court meeting August 26, 2008 3 1, 2008 through September 30, 2009. On motion by Commissioner Cauley, seconded by Commissioner Peters, the Court voted unanimously to approve the renewal of contract and authorized the County Judge to execute the documents. A copy is attached. The next matter before the Court was a request for approval of Indigent Health Care funding for an inmate. The Jail Administrator explained that the inmate was shot when he was taken into custody for attempted capital murder and has had several surgeries to repair the damage to his right arm. He will require continuing care for up to six months. On motion by the County Judge, seconded by Commissioner Peters, the Court voted unanimously to approve the request from the Jail Administrator for Indigent Health Care funding. The next matter for consideration by the Court was a request submitted by the Director of the Information Technology Department seeking approval for out of state travel for Josh Patten to travel to Oak Brook, Illinois to attend Novell GroupWise training August 25-29, 2008. Travel expenses are to be pre-paid by the trainer, Certifirst. On motion by Commissioner Cauley, seconded by Commissioner Mallard, the Court voted unanimously to grant the request from the Director of the Information Technology Department and approved out of state travel for Mr. Josh Patten. Vol 1101 Page G3 Commissioners Court meeting August 26, 2008 4 The Court next considered setting a dollar amount for daily reimbursement for expenses for people who report for jury service and discharge those duties. This is pursuant to Government Code 61.001. The current amount for Brazos County is $6.00 for the first day and $40.00 per day after if selected. On motion by Commissioner Peters, seconded by Commissioner Mallard, the Court voted unanimously to adopt a daily amount of $6.00 for the first day and $40 per day after if selected. The next matter for consideration was approval of tax refund application from the following individual and/or company: a. Gilbert L. Speelman and Tracy Dawn Chambers, over payment $1,077.03. On motion by Commissioner Peters, seconded by Commissioner Mallard, the Court voted unanimously to approve the tax refund application. The Court next considered ratification of an Election Order for the Incorporation of the City of Reliance. The Count Judge received a petition and application on August 18, 2008 for the incorporation of the City of Reliance asking the Judge to order an election to be held for the purpose of enabling the voters to determine whether they desire to incorporate their community. On motion by the County Judge, Vol I Page Commissioners Court meeting August 26, 2008 5 seconded by Commissioner Peters, the Court voted unanimously to ratify the Order. A copy is attached. The Court next considered a payment authorization in the amount of $288.89 to The Ground Crew for irrigation repairs at the Administration Building. On motion by the County Judge, seconded by Commissioner Peters, the Court voted unanimously to approve the payment authorization. The CUC will have a luncheon in Austin during that time. Endler, Executive Director Contract Administration c./.. word1police/sheriff08.doc Brazos County Office of the Sheriff / TAMU Psychology Agreement 3 of 4 Agreement for Advisory and Consultative Services between Brazos County Office of the Sheriff and the Psychology Clinic in the Department of Psychology at Texas A&M University This contract outlines an agreement between the Brazos County Office of the Sheriff (henceforth referred to as Brazos County Sheriff) and the clinical psychology program in the Department of Psychology at Texas A&M University (henceforth referred to as TAMU, employer's I.D.# 76- 4000531; profession/occupation: psychologist) regarding Advisory and Consultative Services between the two institutions. The TAMU address for correspondence regarding billing and scheduling appointments is Carolyn Ivison, Senior Secretary, TAMU Psychology Clinic, Department of Psychology, Texas A&M University, 4235 TAMU, College Station, TX 77843-4235 Phone: 979-845-8017 The TAMU liaison to Brazos County Sheriff for contract management is Robert Heffer, Ph.D., Director TAMU Psychology Clinic, Department of Psychology, Texas A&M University, 4235 TAMU, College Station, TX 77843-4235 Phone: 979-845-8017. Brazos County Sheriff agrees to retain TAMU for a period of 12 months beginning October 1, 2008 and continuing until September 31, 2009 to furnish psychological evaluations of Detention Officer or Deputy Sheriff candidates in accordance with regulations set forth in the Texas Commission on Law Enforcement Officers Standards and Education. Specifically, each evaluation will include: (a) a thorough clinical interview, (b) an appropriate global measure of personality/psychosocial functioning, and (c) additional specific measure(s) of behavioral style as indicated by other evaluation measures or referral questions posed. Fees and Reimbursement Brazos County Sheriff agrees to pay and TAMU agrees to accept, as full compensation, the sum of $240.00 per psychological evaluation and the sum of $110.00 per psychological re-evaluation. Re- evaluations typically are required when the respondent answers evaluation questions in a manner that invalidates the test results. Payment will be based on the timely submission of signed L-3 forms and evaluation reports for the time period during which the referral for evaluation was made. The number of evaluations will vary over the months in which this contract is in effect. L-3 Forms and Evaluation Reports TAMU, prior to receiving reimbursement under this Agreement, agrees to provide Brazos County Sheriff with a copy of psychological evaluation reports generated on persons served under this Agreement. Specifically, TAMU agrees to schedule evaluations within 14 working days after receiving written or phone request from Brazos County Sheriff to conduct such evaluations. TAMU agrees to provide verbal feedback to Brazos County Sheriff and make available, for mailing or personal pick-up, the TCLOESE L-3 (Declaration of Psychological and Emotional Health) form within 3 working days of completion of the testing. Within 14 working days of the completion of testing, TAMU agrees to make available the psychological evaluation report for mailing to, or personal pick-up by, the Brazos County Sheriff. Situations that alter these expectations will be discussed via phone or email by TAMU and Brazos County Sheriff as soon as either party becomes aware of the need to change expectations for a given referral. C./.. word1po/ice/sheritfO8.doc lP 76 Brazos County Office of the Sheriff / TAMU Psychology Agreement 4 of 4 Financial Statements for Services Rendered TAMU will provide Brazos County Sheriff a financial statement by the 10th day of each month for services rendered during the previous month. Brazos County Sheriff agrees to pay TAMU for services by the 8th working day of the month following receipt of the financial statement. This contract may be subject to termination with 30-days notice for lack of timely reimbursement. Early Termination This Agreement may be canceled upon 30 days written notice by either party. In the event this Agreement is canceled, TAMU will be paid only for the time that services were actually performed and when required evaluation reports are presented to Brazos County Sheriff within three weeks of the cancellation of this Agreement. Professional Liability and Credentials Professional liability insurance provided to faculty supervisors and graduate students in clinical psychology through the Department of Psychology will cover services provided through this Agreement. TAMU agrees to provide the Brazos County Sheriff, if requested, with a copy of current professional credentials and professional liability insurance applicable to acts, omissions, or negligence in the course of performing services under this Agreement. TAMU will not be held liable for information communicated in evaluation reports that may result in a decision to dismiss or fail to hire an applicant. TAMU will not be held liable for misconduct, poor job performance, or poor judgments made by officers following an evaluation TAMU completes. Additional Professional Issues Students and faculty supervisors appointed by TAMU agree to comply with policies established by the TAMU Psychology Clinic regarding code of ethics, confidentiality, and other issues relevant to provision of consultative clinical services. This contract in no way obligates Brazos County Sheriff to rely exclusively on TAMU for the services described in this contract. Other Direct Costs Regarding other direct costs, Brazos County Sheriff will pay the amount per completed evaluation specified in the preceding section entitled "Fees and Reimbursement." Other direct costs will be used by the TAMU Psychology Department for supplies, photo-reproduction, books, journals, training tapes, software, equipment, professional dues, travel expenses, educational development, and other directly related costs. Renewals Pending authorization from both Brazos County Sheriff and TAMU, this agreement may be renegotiated for a specified period beginning October 1, 2009. Renewals of this agreement may include an annual increase for services rendered. C.y... word/po/ice/sherif &doc ELECTION ORDER FOR THE INCORPORATION OF THE CITY OF RELIANCE WHEREAS on the 18th day of August, 2008, a Petition and Application for the Incorporation of the City of Reliance was filed with the County Judge of Brazos County, Texas, praying that this Judge order an election to be held within the boundaries of that certain tract or parcel of land within the County and described on Exhibit "A" attached hereto and incorporated herein by this reference of the purpose of enabling the voters thereof, to determine whether they desire to incorporate their community as a Type C General-Law Municipality to be knows as the "City of Reliance"; and WHEREAS on this the 18th day of August, 2008, such Petition and Application was heard by the County Judge; and WHEREAS upon receipt of satisfactory proof this Judge finds that the Petition and Application contains signatures of at least 10% of the qualified voters who are residents of the community commonly known as "Reliance"; and WHEREAS upon receipt of satisfactory proof this Judge finds that the community described in the Petition and Application contains at least 201 but less than 4,999 inhabitants as required by Section 8.001 (2) of the Texas Local Government Code; and WHEREAS upon receipt of satisfactory proof this Judge finds that the community is a collection of inhabited houses in close proximity for which there is a compact center of population around which an unincorporated town has developed; and WHEREAS upon receipt of satisfactory proof this Judge finds that the community is capable of receiving reasonable municipal services; and WHEREAS this Judge finds that the community is located entirely in Brazos County, Texas; and I ►a -~a WHEREAS this Judge finds that such Petition and Application should be granted.
