Request from Verizon Communications to relocate, at Brazos County's request, buried communications cable in the right of way of Old Bundick Road; 529 ft. of new buried cable will be constructed (2 ft. inside at a minimum depth of 30 inches) to the new right of way of Old Bundick Road at Little Cedar Creek to accommodate new bridge construction. Site is located in Precinct 2. 16. Payment Authorization in the amount of $400.00 to Productivity Center, Inc. to renew the online testing fee for exams administered from 3/08/2007 to 3/08/2008 to employees of the County Jail. A purchase order was not obtained in advance. 17. Acknowledgement of Terri White, Chief Deputy in the Treasurer's Office, who will celebrate 25 years as an employee of Brazos County on Friday 25 April 2008. 18. Alce arrangements, call (979) 361-4102. interpretive services must be made two business da s befor thpp l In HH1177~G._..-- COMMISSIONERS' COURT REGULAR MEETING APRIL 22, 2008 A regular meeting of the Commissioners' Court of Brazos County, Texas was held in the Brazos County Commissioners Courtroom in the Courthouse in Bryan, Brazos County, Texas, beginning at 9:00 a.m. on Tuesday, April 22, 2008 with the following members of the Court present: Randy Sims, County Judge, Presiding; Lloyd Wassermann, Commissioner of Precinct l; Duane Peters, Commissioner of Precinct 2; Kenny Mallard, Commissioner of Precinct 3; Carey Cauley, Jr., Commissioner of Precinct 4, Absent; Karen McQueen, County Clerk. The attached sheets contain the names of the citizens and officials that were in attendance. Commissioner Mallard gave the invocation and then led the pledge of allegiance. There was no citizen input/and or concerns. The Court next considered Budget Amendment #07/08-27.1 through 27.4 that would reallocate funds for the Capital Improvement fund: 272nd District Court, Court Support Costs, Road & Bridge Department. The County Judge asked if the cost of the projectors (Budget Amendment 27.1) was our share or the total cost. Commissioner Mallard explained that the Director Vol 10-1 Page a 5 l Commissioners Court meeting April 22, 2008 2 of Emergency Management was not present to answer that question and he did not know for sure, but different organizations are bringing different items to the EOC. Commissioner Peters moved to approve and Commissioner Mallard seconded the motion. After some discussion, Commissioners Peters and Mallard amended their motion and second and to table consideration of amendment 27.1 Then, on motion by Commissioner Peters, seconded by Commissioner Mallard, the Court voted unanimously to approve the budget amendments with the exception of number 27.1. A copy each amendment that was approved is attached. The Court proceeded to consider the change of status of employees as submitted on the attached Personnel Action Requests. On motion by the County Judge, seconded by Commissioner Peters, the Court voted unanimously to approve the changes as submitted. The Court next considered the following Claims as submitted by the County Treasurer for payment: 7048916 through 7049146 On motion by Commissioner Peters, seconded by Commissioner Wassermann, the Court voted unanimously to approve the Claims as submitted. Vol I U7 Page 9~0 C-) Commissioners Court meeting April 22, 2008 3 The next matter before the Court was the appointment of an individual to serve on the Brazos Valley Council of Governments Solid Waste Advisory Committee. On motion by the County Judge, seconded by Commissioner Peters the Court voted unanimously to appoint Eric Zaragoza to serve on the Brazos Valley Council of Governments Solid Waste Advisory Committee effective July 3, 2008. The Court next considered a request from the Sheriff's Office for the creation of the temporary position, Chief Administrator, to be classified as Group 33, Step 1, paid from funds currently budgeted for Chief Deputy, Class Code 1403, Position No. 1 and that no benefits be paid through the period of employment. On motion by Commissioner Peters, seconded by Commissioner Mallard, the Court voted unanimously to approve the request. The Sheriff stated that this would be the last Commissioners Court meeting in which Chief Deputy Jim Mann would be the Sergeant at Arms. He has been a great Chief Deputy and we will miss him. Clyde Collins, former Chief Deputy will fill the temporary position. The County Judge also wished Chief Mann well. The next matter before the Court was consideration of the establishment of Brazos County as the lead agency for the Brazos Valley Wide Area Communication System (BVWACS). The 112 (01 Vol 101 Page Commissioners Court meeting April 22, 2008 4 County Judge asked when do we get a contract, how does the vote work for the lead agency. Commissioner Mallard replied that it is a 2.8 million dollar grant. He continued saying that in some cases everyone has an equal vote and in others the vote is weighted. In order to receive funds, we must have a lead agency listed. He said that he was looking for an "OK" as lead if all things are agreeable. We do have an out though, Commissioner Mallard said. The County Judge stated he would like to have a little more voice/vote if we are taking on the responsibility of lead agency. As the manager, he would like to have the authority to terminate the Director. On motion by Commissioner Peters, seconded by Commissioner Wassermann, the Court voted unanimously to approve Brazos County as the lead agency for the Brazos Valley Area Wide Communication System contingent on review and approval of the membership document. The Court next considered an agreement with the College Station Police Department for overtime reimbursement for personnel assigned to the Brazos County Special Investigations Unit. On motion by Commissioner Peters, seconded by Commissioner Mallard, the Court voted unanimously to approve the agreement. CJD Grant funds will be used for reimbursements and they shall be made on a monthly basis. A copy of the Vol 1 67 Page d (-rl Commissioners Court meeting April 22, 2008 5 agreement is attached. The Court next considered an agreement with the Bryan Police Department for overtime reimbursement for personnel assigned to the Brazos County Special Investigations Unit. On motion by Commissioner Wassermann, seconded by Commissioner Peters, the Court voted unanimously to approve the agreement. CJD Grant funds will be used for reimbursements and they shall be made on a monthly basis. A copy is attached. The Court next considered an agreement with the Texas A&M University Police Department for overtime reimbursement for personnel assigned to the Brazos County Special Investigations Unit. On motion by Commissioner Mallard, seconded by Commissioner Peters, the Court voted unanimously to approve the agreement. CJD Grant funds will be used for reimbursements and they shall be made on a monthly basis. A copy is attached. The Court next considered approval of the minutes of the Commissioners' Court meetings held in December 2007 on the following dates: Regular Meetings - 4tn, lltn, 18tn, Public Hearing - llth Special Meetings - 27tH, 31St On motion by Commissioner Peters, seconded by Commissioner Mallard, the Court voted unanimously to approve Vol 107 Page 903. Commissioners Court meeting April 22, 2008 the minutes as submitted. 6 The next matter for consideration by the Court was a request submitted by the Metropolitan Planning Organization for approval for out of state travel for Bart Benthul to travel to Portland, Oregon to attend the Fifth Oreqon Symposium on Integrated Land Use and Transport Models, June 19-21, 2008 at Portland State University and Innovations in Travel Modeling 2008 Conference June 22 -24, 2008. On motion by the County Judge, seconded by Commissioner Peters, the Court voted unanimously to grant the request from the Metropolitan Planning Organization and approved payment of out of state travel expenses for Mr. Bart Benthul. The Court next considered awarding RFP No. 2008-032, Audio Visual System for Commissioners Court. Charles Wendt, Assistant Purchasing Agent, along with Brazos County's Consultant, Steve Hodge recommended acceptance of the bid submitted by Schoolhouse Audio-Visual. On motion by Commissioner Peters, seconded by Commissioner Mallard, the Court voted unanimously to accept the recommendation of the Purchasing Agent and award the contract to Schoolhouse Audio- Visual. A copy of the bid tabulation is attached. The Court next considered the request from Verizon Communications to relocate (at the request of Brazos County) Vol 10? Page a Commissioners Court meeting April 22, 2008 7 buried communications cable in the right-of-way of Old Bundick Road. 529 feet for new buried cable will be constructed 2 feet inside at a minimum depth of 30 inches to the new right- of-way of Old Bundick Road at Little Cedar Creek to accommodate new bridge construction. The site is located in Precinct 2. The County Engineer stated that all appeared to be in order and recommended approval. On motion by Commissioner Peters, seconded by Commissioner Wassermann, the Court voted unanimously to approve the request from Verizon Communications and authorized the relocation. A copy of the request is attached hereto. The next matter before the Court was consideration of a payment authorization in the amount of $400.00 to Productivity Center, Inc. for TCLEDDS online testing exam and renewal fee for exams administered from March 8, 2007 through March 8, 2008. There were a total of 125 jailer exams and 2 Peace Officer exams. On motion by Commissioner Peters, seconded by Commissioner Mallard, the Court voted unanimously to approve the payment authorization. The Court next acknowledged Terri White, Chief Deputy in the Treasurer's Office who will celebrate 25 years as an employee of Brazos County on Friday, April 25, 2008. Vol I Page C2 65. Commissioners Court meeting April 22, 2008 8 Under announcement of interest items and possible future agenda topics the following spoke: Commissioner Mallard a) There will be a CUC meeting tomorrow at noon. b) He, the County Judge, and the Director of Information Technology Department attended the LIRA meeting concerning software from TAC. Under citizen input and/or concerns, the following spoke: Sheriff Chris Kirk a) There were 557 inmates in jail. 90 are on electronic monitoring. Commissioner Mallard asked what was the average time for monitors. The Sheriff replied that it was the same as when they were on work/release. Gary Arnold, Road & Bridge Department a) He introduced Megan Parsons as the new GIS person for the department. There were no Agency/Board/Committee reports by Court members. There being no further business to come before the Court, the meeting was adjourned. Sincerely, V 6` Brenda Vajdak , Supervisor - Network Engineer BV:ec Attachment VERIZON COMMUNICATION To The Commissioner's Court of Brazos County ATTENTION COUNTY JUDGE: Notice of Line Installation April 7, 2008 Formal notice is hereby given that VERIZON COMMUNICATIONS will construct a communication line within the right-of-way of a County Road in Brazos, County, Texas as follows: Verizon Communications will place approximately 529' along, parallel to and 2' inside the new County R.O.W. on Old Bundick Road at Little Cedar Creek. This cable will replace the cable on the old R.O.W. so the curve can be straightened out and a new bridge built across Little Cedar Creek. We will bore under Little Cedar Creek. The cable will be a minimum of 30" deep. The location and description of this line and associated appurtenances is more fully shown by two (2) copies of drawings attached to this notice. The line will be constructed and maintained on the County Road right-of-way in accordance with governing laws. Notwithstanding any other provision contained herein, it is expressly understood that the tender of this notice by the Verizon Southwest Incorporated does not constitute a waiver, surrender, abandonment or impairment of any property rights, franchise, easement, license, authority, permission, privilege or right now granted by law or may be granted in the future and any provision or provisions so construed shall be null and void. Construction of this line will begin on or after May 15, 2008.
