THE COMMISSIONERS COURT OF BRAZOS COUNTY WILL MEET IN REGULAR
SESSION ON 19 FEBRUARY 2008 AT 6:00 P.M. IN ASSEMBLY ROOM 3 OF THE
BRAZOS CENTER, 3232 BRIARCREST DRIVE, BRYAN, TEXAS.
1. Invocation and Pledge of Allegiance - Commissioner Cauley.
2. Call for citizen's input and/or concerns.
3. Presentation by the District Clerk updating the Court on the NACo Prescription
Discount Card Program.
Consider and take action on agenda items 4 -16:
4. Budget Amendment 07/08-18.1 thru 18.5.
5. Reclassification of the following position at the Expo Center Complex:
Facility Operations Assistant (full-time with benefits), Class 0831, Position 3, Group
12, Step 2 to two additional temporary part-time Buildings and Grounds Attendants,
Class 0832, Positions 5 & 6, Group 9, Step 2 (Event Workers, maximum 20
hours/week, no benefits.

10. Cooperative Working Agreements between Brazos County and Texas A&M

carrying out the objectives described in the grant application.
11. Proposal submitted by Jamail & Smith Construction to provide electricity and plumbing
to the portable buildings that were moved to the Juvenile Justice Center.
12. Permission to award secondary vendor status to Knife River for base material on Bid
#2008-009.

blanket purchase order was for FY07; a new blanket purchase order was not completed
with the start of FY08.
15. Payment Authorization in the amount of $304,233.93 to Rosser International for design
development, construction documents and travel related to the Brazos County
Detention Center expansion. The original blanket purchase order was for FY07; a new
blanket purchase order was not completed with the start of FY08.
16. Consider and possible action regarding the current Burn Ban, as established by Brazos
County Order #08-003.
17. Acknowledgement of the 2007 Racial Profiling Report for the Precinct 2 Constable's
Office.

COMMISSIONERS' COURT
REGULAR MEETING
FEBRUARY 19, 2008
A regular meeting of the Commissioners' Court of Brazos
County, Texas was held in the Brazos Center 3232 Briarcrest
Drive, in Bryan, Brazos County, Texas, beginning at 6:00 p.m.
on Tuesday, February 19, 2008 with the following members of the
Court present:
Randy Sims, County Judge, Presiding;
Lloyd Wassermann, Commissioner of Precinct 1;
Duane Peters, Commissioner of Precinct 2;
Kenny Mallard, Commissioner of Precinct 3;
Carey Cauley, Jr., Commissioner of Precinct 4,
Absent;
Karen McQueen, County Clerk.
The attached sheet contains the names of the citizens and
officials that were in attendance.
The County Judge gave the invocation and led the pledge
of allegiance.
There was no citizen input/and or concerns.
The first matter before the Court was a presentation by
Marc Hamlin, District Clerk updating the Court on the use of
the NaCO Prescription cards. He said they had reached over
1,000 people in the first two months.
The County Judge asked to consider item number 11 at this
time. Consider a proposal by Jamail & Smith Construction to

provide electricity and plumbing to the two buildings
relocated at the Juvenile Justice Center. The total charge is
$29,205.54. On motion by the County Judge, seconded by
Commissioner Peters, the Court voted unanimously to approve
the proposal. A copy is attached.
The Court next considered Budget Amendment #07/08-18.1
through 18.5, which would reallocate funds for Constable,
Precinct 2, Non-Departmental, Sheriff Office-Jail; and
transfer funds from Contingency to the Juvenile Services-
Academy, Capital Projects-Commissioners Court. On motion by
Commissioner Peters, seconded by Commissioner Wassermann, the
Court voted unanimously to approve the budget amendment as
submitted, a copy of which is attached.
The next matter before the Court was consideration of a
request from Tom Quarles, Director of Special Event
Facilities asking for the reclassification of the following
positions for the Expo Complex:
Change one (1) Facility Operations Assistant position
(full time with benefits), Class 0831, Position 03,
Group 12, Step 2, to two additional Temporary/Part Time
Buildings and Grounds Attendants (Event Workers, Maximum
20 hours per week, no benefits) Class 0832, Positions
05-06, group 9, Step 2. (Event Workers, maximum 20
hours/week, no benefits.)
On motion by Commissioner Peters, seconded by Commissioner
Mallard, the Court voted unanimously to approve the request.

The Court proceeded to consider the change of status of
employees as submitted on the attached Personnel Action
Requests. On motion by Commissioner Peters, seconded by
Commissioner Wassermann, the Court voted unanimously to
approve the change of status as submitted.
The Court next considered the following Claims as
submitted by the County Treasurer for payment:

On motion by Commissioner Mallard, seconded by Commissioner
Peters, the Court voted unanimously to approve the Claims as
submitted.
The next matter before the Court was consideration of a
Tax Refund Application in the amount of $992.58 for Juan A. &
Patricia Romero due to payment in error. On motion by
Commissioner Peters, seconded by Commissioner Wassermann, the
Court voted unanimously to approve the refund.
The next matter for consideration was approval of tax
refund applications from the following individuals and/or
companies:
a) Gilbert G. Barron, over payment $500.24
b) Larry S. & Jonathan Aaron J. Cash, over payment $25.10
c) Monica Y. & Willie Houston, over payment $910.10
d) Brenda Gay Kirkpatrick, over payment $200.83
e) Edward R. & Penny C. Scott, over payment $2,030.16
f) Jamie Shaw, over payment $74.64
g) Mitchell C. & Cherly L. Smith, over payment $176.46
h) Ivan & Griselda Magallon, over payment $100.00

On motion by Commissioner Peters, seconded by Commissioner
Mallard, the Court voted unanimously to approve the tax refund
applications.
The Court next considered a Cooperative Working Agreement
between Brazos County, Texas A&M University, City of Bryan, and
City of College Station certifying that the objectives of the
Brazos County Special Investigations Unit grant application
have been reviewed and that it is mutually agreed to cooperate
to whatever extent is necessary in carrying out the objectives
described in the grant application. On motion by Commissioner
Peters, seconded by Commissioner Mallard, the Court voted
unanimously to approve the Cooperative Working Agreement. A
copy is attached.
The next matter before the Court was consideration of a
request from the Purchasing Department for permission to
designate a secondary vendor for Bid 2008-009, Flexible Base.
Due to the inability of the primary vendor to meet the
specifications of the bid, the vendor was disqualified and the
secondary vendor became the primary. Now a new secondary
needs to be named. The recommendation of the Assistant
Purchasing Agent is that Knife River be named as secondary
vendor. On motion by the County Judge, seconded by

Commissioner Wassermann, the Court voted unanimously to
approve the request from the Purchasing Department and name
Knife River as secondary vendor for Bid 2008-009, Flexible
Base. A copy of the bid tabulation is attached.
The Court next considered approval of the Final Plat of
the Indian Lakes Phase Three (3), 45.357 Acres in Precinct 1.
Richard Vance, County Engineer, stated that he had reviewed
the plat and all appeared to be in order. On motion by
Commissioner Wassermann, seconded by Commissioner Peters, the
Court voted unanimously to approve the final plat of the
Indian Lakes Phase Three (3), 45.357 Acres as submitted.
The next matter before the Court was consideration of a
payment authorization in the amount of $2,250 to Jones and
Carter for topographic survey on the Brazos County Detention
Center expansion. The new blanket purchase order was not
completed when this work was done. On motion by Commissioner
Peters, seconded by the County Judge, the Court voted
unanimously to approve the payment authorization.
The Court considered another payment authorization in the
amount of $304,233.93 to Rosser International for the design
development, construction documents, and travel related to the
Brazos County Detention Center expansion. On motion by

Commissioner Peters, seconded by Commissioner Mallard, the

Mallard, the Court voted unanimously to table consideration.
The Court acknowledged receipt of the 2007 Racial
Profiling Report for the Precinct 2 Constable's Office.
There were no announcements of interest items and
possible future agenda topics.
There was no citizen input and/or concerns.
Under Agency/Board/Committee reports by Court members,
the following spoke:

Court, the meeting was adjourned.

The portable buildings that were moved from the Administration Building location to the
Juvenile Justice Center are currently without plumbing and electricity. Please approve
work on the attached quote to provide electricity and plumbing for these buildings. If
approved, the budget amendments to fund this project follow in the agenda.

Subject: Buyboard Proposal, County of Brazos 2 Building Relocation and Road
work.
Jamail Construction is pleased to offer the attached change proposal to extend the
domestic sanitary waste system from an existing service tap to the new relocated
building site pursuant to the Buyboard Standard Hours Contract Agreement and
attached proposal by Crenshaw Building Moving.
This proposal includes the following scope of work:
• Earth work consisting of but not limited to trenching, backfilling,
compaction and final grading of existing site.
• Install a new domestic waste system connected from an existing
service tap to the new relocated building site.
• All work shall be installed per all governing code requirements and
current trade practices.
Exclusions:
1. Sales Tax, Permits / Fees.
2. Primary electrical service and any new transformer work including
transformer pad.
3. Seeding or sod work after place of new domestic waste system.
4. Exterior building painting.
The amount of our change proposal is $28,632.88 and is calculated as follows:
