Fax: (979) 823 -6993 I 0 dO7 COMMISSIONERS' COURT SPECIAL MEETING DECEMBER 27, 2007 A special meeting of the Commissioners' Court of Brazos County, Texas was held in the Commissioners Courtroom in the Courthouse in Bryan, Brazos County, Texas, beginning at 9:00 a.m. on Thursday, December 27, 2007 with the following members of the Court present: Randy Sims, County Judge, Presiding; Lloyd Wassermann, Commissioner of Precinct 1; Duane Peters, Commissioner of Precinct 2; Kenny Mallard, Commissioner of Precinct 3, Absent; Carey Cauley, Jr., Commissioner of Precinct 4, Absent; Karen McQueen, County Clerk. The attached sheet contains the names of the citizens and officials that were in attendance. The County Judge called the meeting to order and then proceeded to consider the following Claims as submitted by the County Treasurer for payment: 7044955 through 7045212 On motion by Commissioner Peters, seconded by Commissioner Wassermann, the Court voted unanimously to approve the Claims as submitted. The County Judge stated that there were two addendums to the agenda. The first to rescind the action taken by Vol I oq Page a 6ff Commissioners Court meeting December 27, 2007 2 Commissioners' Court on the 27th of November, 2007 to appoint Greg Leeth to the Precinct 4 Emergency Services District Board. The term of the appointment is from January 2008 through December 31, 2009. He also stated that that there were several people who wanted to speak on the subject. The following spoke: a. Mr. Michael Kennedy stated that according to an Attorney General Opinion, the Court has no authority to rescind an order and remove someone from the board. Only a district judge can remove someone. The County Judge disagreed and stated that it would be checked out. b. Joe Ondrasek, Chief Precinct 4 Volunteer Fire Department stated that the current board was not adequately addressing the needs of the fire department. c. Michael Kennedy spoke on behalf of Greg Leeth The County Judge recessed the meeting until 1:00 p.m. on December 28, 2008. The County Judge reconvened the recessed meeting of December 27, 2007 at 1:00 p.m. on December 28, 2007. Commissioner Cauley was absent. On motion by the County Judge, seconded by Commissioner Peters, the Court voted unanimously to rescind the order approved on November 27, 2007 appointing Greg Leeth and Keith Cooke to serve on the Precinct 4 Emergency Services District Board. Commissioner Mallard Vol 10 Page do 9 Commissioners Court meeting December 27, 2007 3 noted that that there appeared to be some discord between the board and the fire district. Then on motion by the County Judge, seconded by Commissioner Peters, the Court voted unanimously to appoint Pat Fagan to serve on the Precinct 4 Emergency Services District Board. The County Judge read aloud that the Court will meet on December 31, 2007 at 1:00 p.m. to make the final appointment. There being no further business to come before the Court the meeting was adjourned.
