THE COMMISSIONERS COURT OF BRAZOS COUNTY WILL MEET IN REGULAR
SESSION ON 13 NOVEMBER 2007 AT 9:00 A.M. IN THE COMMISSIONERS

10. Reappointment of Ken Medders, Jr. as Brazos County's representative on the Board of
Directors for the Brazos County Appraisal District. Term of appointment is 1/01/2008
through 12/31/2009.
11. Revised County contribution of $487.70 for retirees with more than eight (8) years of
service. The contribution amount that was previously approved on 10/16/2007
incorrectly included the County paid life insurance coverage amount, which retirees do
not receive.
12. 2007 Sub - recipient Agreement with the Governor's Division of Emergency
Management for the Homeland Security Grant Program (Award #07 -SR 48041 -01).
13. Adjustment to the Information Technology Department's electronic inventory of printer
cartridges as follows to reflect the actual inventory in warehouse 14:
a. Stock #1426 should be increased by one to reflect the presence of an additional
cartridge;
b. Stock #1401 and #1709 should each be decreased by one to reflect the absence of
two cartridges.
14. Request from Texas A &M University and the Board of Directors for Brazos Valley
Worldfest for permission to use the County parting lot at the corner of Washington and
26th Streets on Saturday 17 November from 10:00 a.m. to 5:00 p.m. so that event
performers can load and unload near the festival site.
15. Permission to award Bid 2008 -006, Heavy Machinery Rental, as follows based on
overall best price:
Primary Vendor: Mustang Rental Services
Secondary Vendor: Redtail Equipment Rental
16. Permission to award Bid 2008 -007, Rental of Equipment with Operator, as follows
based on best price:
Primary Vendor: BCS Dozer

County, Texas. Site is located in Precinct 2.
20. Request from GSI Oil & Gas, Inc. to construct three (3) road bores for poly -gas
pipeline installations in the right of way of Ferrill Creek Road, Dilly Shaw Tap Road
and Fickey Road. Site is located in Precinct 2.
21. Reimbursement of $75.00 to Richard Vance for parking fees incurred while attending
the TACERA Conference in San Antonio, Texas.
22. Tax Refund Application for Betty J. Suggitt.
23. Payment authorization in the amount of $83.25 to Wilton's Office Works for office
supplies purchased by County Court at Law #1 with FY07 funds.
24. Payment authorization in the amount of $611.50 to Hart InterCivic for equipment repair
for the County Clerk's office. The purchase order was closed before the final invoice
was paid.
25. Payment authorization in the amount of $238.00 to Bryan Broadcasting Corp. for
advertising of the Expo Complex's open house. The purchase order was closed before
the final invoice was paid.
26. Announcement of interest items and possible future agenda topics.

COMMISSIONERS' COURT
REGULAR MEETING
NOVEMBER 13, 2007
A regular meeting of the Commissioners' Court of Brazos
County, Texas was held in the Brazos County Commissioners
Courtroom in the Courthouse in Bryan, Brazos County, Texas,
beginning at 9:00 a.m. on Tuesday, November 13, 2007 with the
following members of the Court present:
Randy Sims, County Judge, Presiding;
Lloyd Wassermann, Commissioner of Precinct 1;
Duane Peters, Commissioner of Precinct 2;
Kenny Mallard, Commissioner of Precinct 3;
Carey Cauley, Jr., Commissioner of Precinct 4;
Karen McQueen, County Clerk.
The attached sheet contains the names of the citizens and
officials that were in attendance.
Commissioner Peters gave the invocation and then led the
pledge of allegiance.
Under citizen input /and or concerns, the following spoke:
Sheriff Chris Kirk
a) There were 481 inmates this morning. It is looking
good.
The Court next considered Budget Amendment #06/07 -53.1
that would reallocate funds for the Exposition Center Fund.
On motion by Commissioner Peters, seconded by Commissioner
Wassermann, the Court voted unanimously to approve the budget

amendment as submitted, a copy of which is attached hereto.
The Court next considered Budget Amendment #07/08 -6.4
that would reallocate funds for Constable, Precinct 4, Capital
Projects- Commissioners' Court, Information Technology
Department, and District Attorney's Office. On motion by
Commissioner Peters, seconded by Commissioner Cauley, the
Court voted unanimously to approve the budget amendment as
submitted, a copy of which is attached hereto.
The Court proceeded to consider the change of status of
employees as submitted on the attached Personnel Action
Requests. On motion by Commissioner Wassermann, seconded by
Commissioner Peters, the Court voted unanimously to approve
the changes as submitted.
The Court next considered the following Claims as
submitted by the County Treasurer for payment:

On motion by Commissioner Peters, seconded by Commissioner
Mallard, the Court voted unanimously to approve the Claims as
submitted.
The County Judge read aloud a Proclamation #07 -037
designating November 13, 2007 as "National Adoption Day ". The
Court joins with the courts and adoption organizations across
the country celebrating adoption that offers children the

chance to live with stable and loving families and urging all
citizens to join in the national effort to raise awareness
about the importance of adoption. On motion by the County
Judge, seconded by Commissioner Cauley, the Court moved to
proclaim November 13, 2007 as "National Adoption Day"
throughout Brazos County.
The next matter before the Court was consideration of
Resolution #07 -018 authorizing the submission of a grant
request to the Criminal Justice Division, Office of the
Governor, for grant funds to fund the Brazos County, Texas
Program known as the "Brazos County Special Investigation Unit
(BCSIU). The Sheriff said that this is similar to the CLEAR
Team but it will be changed to this. They will be bringing
other entities together. The interim commander will be James
Woodward. There is no cash match but personnel costs will be
supported by the other agencies. On motion by Commissioner
Cauley, seconded by Commissioner Peters, the Court voted
unanimously to adopt Resolution #07 -018 authorizing the
submission of a grant request to the Criminal Justice
Division, Office of the Governor, for grant funds to fund the
Brazos County, Texas Program known as the "Brazos County
Special Investigation Unit (BCSIU) and to authorize the County
Judge to accept such grant funds should they be tendered.

The next matter before the Court was consideration of a
request from the Research Valley Partnership for a cash
incentive in the amount of $10,000.00 for J &M Management. J &M
Management has complied with the performance agreement and has
in fact exceeded their payroll and investment requirements.
On motion by Commissioner Mallard, seconded by Commissioner
Cauley, the Court voted unanimously to approve the request for
$10,000.00.
The Court next considered the reappointment of an
individual to serve as Brazos County's representative on the
Board of Directors for the Brazos County Appraisal District.
On motion by Commissioner Peters, seconded by Commissioner
Cauley, the Court voted unanimously to appoint Ken Medders,
Jr. to serve as Brazos County's representative on the Board of
Directors for the Brazos County Appraisal District. The term
of appointment is from January 1, 2008 through December 31,

The next matter before the Court was consideration of a
revised contribution amount for retires with more than eight
(8) years of service. The contribution amount previously
approved on October 16, 2007 incorrectly included $5.80 for
the County paid life insurance coverage. Retirees do not get
the County paid life insurance coverage. Therefore the

correct amount equals $478.70. On motion by Commissioner
Peters, seconded by Commissioner Mallard, the Court voted
unanimously to revise the contribution amount to $478.70 for
retires with more than eight (8) years of service.
The Court next considered a 2007 Sub - Recipient Agreement
with the governor's Division of Emergency Management for the
Homeland Security Grant Program. The total award amount is
$188,800.00. Chuck Frasier, Director of Emergency Management
reported that the money would be used for radios for the
Sheriff's office, $15,000.00 to each of the fire departments,
and equipment for the new Emergency Operations Center (EOC).
Although both Mr. Frasier and Chief Deputy Mann would have
like to have seen a north tower, they had to go with the will
of the group. On motion by Commissioner Peters, seconded by
Commissioner Mallard, the Court voted unanimously to
authorized the County Judge to execute the document on behalf
of Brazos County. A copy is attached.
The next matter before the Court was consideration of an
adjustment to the Information Technology Department's

The Court next considered a request from Texas A &M

World Fest can load and unload near the festival site. Kim
Fox, program coordinator for the event said they are
anticipating 3,000 to 5,000 people to attend. On motion by
Commissioner Cauley, seconded by Commissioner Peters, the
Court voted unanimously to approve the request.
The Court next considered awarding Bid No. 2008 -006,
Heavy Machinery Rental. Becky Stephens, Assistant Purchasing
Agent, made the following recommendations:

On motion by Commissioner Wassermann, seconded by Commissioner
Peters, the Court voted unanimously to accept the
recommendation of the Assistant Purchasing Agent and award the

Rental of Equipment with Operator. Becky Stephens, Assistant
Purchasing Agent, made the following recommendations:

On motion by Commissioner Peters, seconded by Commissioner
Mallard, the Court voted unanimously to accept the

On motion by Commissioner Wassermann, seconded by Commissioner
Peters, the Court voted unanimously to authorize the
Purchasing Agent to advertise for the previously mentioned
bids.
The Court next considered approval of the Final Plat of
Fry Addition, Lot 1, Block 1 in Precinct 2. Richard Vance,
County Engineer, stated that he had reviewed the plat and all
appeared to be in order. On motion by Commissioner Peters,
seconded by Commissioner Wassermann, the Court voted
unanimously to approve the final plat of the Fry Addition, Lot
1, Block 1 as submitted.
The Court next considered the request from GSI Oil & Gas,
Inc. to construct three (3) road bores for poly - gas - pipeline
installations in the right -of -way of Ferrill Creek Road, Dilly
Shaw Tap Road and Fickey Road. Included with the request is
company check #15306 in the amount of $1,500.00 for the
permit. The site is located in Precinct 2. The County

Engineer stated that all appeared to be in order and
recommended approval. On motion by Commissioner Peters,
seconded by Commissioner Cauley, the Court voted unanimously
to approve the request from GSI Oil & Gas, Inc. and authorized
the installation. A copy of the request is attached hereto.
The next matter before the Court was consideration of a
request for a $75.00 reimbursement to Richard Vance for
parking fees incurred while attending the TACERA Conference in
San Antonio, Texas. On motion by the County Judge, seconded
by Commissioner Peters, the Court voted unanimously to
authorize the reimbursement of $75.00 to Richard Vance, County
Engineer.
The next matter for consideration was approval of tax
refund applications from the following individual and /or
company:
a. Betty J. Suggitt, over payment $ 1,607.09
On motion by Commissioner Peters, seconded by Commissioner
Cauley, the Court voted unanimously to approve the tax refund
application.
The Court next considered a payment authorization in the
amount of $83.25 to Wilton's Office Works for office supplies
purchased by County Court at Law #1 with FY 07 funds. On
motion by Commissioner Peters, seconded by Commissioner Cauley

the Court voted unanimously to authorize the correction from
FY07 funds to FY 08 funds and approved the payment
authorization.
The next matter before the Court was consideration of a
payment authorization to Hart InterCivic in the amount of
$611.50 for equipment repair for the County Clerk's office.
The purchase order was closed before the final invoice was
paid. On motion by Commissioner Cauley, seconded by
Commissioner Peters, the Court voted unanimously to approve
the payment authorization.
The Court next considered a payment authorization in the
amount of $238.00 to Bryan Broadcasting Corporation for
advertising of the Expo Complex's open house. The purchase
order was closed before the final invoice was paid. On motion
by the County Judge, seconded by Commissioner Cauley, the
Court voted unanimously to approve the payment authorization.
Under announcement of interest items and possible future
agenda topics the following spoke:

a) Tomorrow will be the annual hamburger lunch
starting at 11:00 at the Exposition Center.
Chuck Frazier
a) The KBID mean is at 593. It is starting to
get a little dry. There has been no

increase in the number of calls to the fire
department yet.
County Judge
a) Asked that the burn ban be placed on the
agenda from now on just in case it needs to
be addressed.
Bob Malaise, Research Valley Partnership
a) Said he would like to mention that J &M
Management was GRI. They have developed
technology where the chromosomes are separated
from the semen. They are looking at a major
expansion that will double the size of the
facility, and venturing into other areas other
than the beef industry.
There was no citizen input and /or concerns.
Under Agency /Board /Committee reports by Court members,
the following spoke:
Commissioner Mallard
a) He attended a meeting in which they got an
update on the State Legislature. He learned
there is ordinance making power in the County.
They discussed development out in the County.
The also asked about cities requiring 20 acre
lots in the ETD's There was not much comment
on that topic since the representatives do
represent the cities and the county but they
were surprised by that. He suggested that our
in house counsel check to see if this can
indeed be done.
Commissioner Wassermann
a) He is on a subcommittee charged with
revising ordinances for animal control. The
cities and the County meet again this week.
Something should be coming forth from them
soon.

A RESOLUTION BY THE COMMISSIONERS COURT OF BRAZOS COUNTY, TEXAS
AUTHORIZING THE SUBMISSION OF A GRANT REQUEST TO THE CRIMINAL JUSTICE
DIVISION OF THE GOVERNOR'S OFFICE FOR FUNDING A BRAZOS COUNTY, TEXAS
PROGRAM KNOWN AS THE "BRAZOS COUNTY SPECIAL INVESTIGATION UNIT (BCSIU)."
WHEREAS, the Commissioners Court of Brazos County, Texas has the moral obligation to the citizens
and taxpayers of Brazos County to ensure that the criminal justice system operates in the most efficient and
coordinated manner possible; and
WHEREAS, the Commissioners Court feels that the creation of the Brazos County Special Investigation
Unit (BCSIU) will materially enhance the administration of justice in Brazos County, Texas; and
WHEREAS, the opportunity exists to fund vital parts of this program through the Office of the Governor
of the State of Texas, Criminal Justice Division; and
WHEREAS, the Commissioners Court agrees that in the event of a loss or misuse of the Criminal Justice
Division funds, the Brazos County Commissioners Court assures that the funds will be returned to the Criminal
Justice Division in full.
NOW, THEREFORE, BE IT RESOLVED by the Commissioners Court of Brazos County, Texas, at its
meeting on the 13`h day of November, 2007 that:
1. The Commissioners Court approves submission of the grant application to the Office of the Governor,
Criminal Justice Division, for grant monies to fund the Brazos County Special Investigation Unit
(BCSIU) from 1 October 2007 through 30 September 2008.
2. The County Judge of Brazos County, acting on behalf of Brazos County, is authorized to apply for,
accept, reject, alter, or terminate the grant.
3. This resolution becomes effective upon its ad ion.

Machines over 100 horsepower rented for one day may incur additional frt charge.Rain Days -As a general rule, rail days are charged at normal rate. Rain charges may be waived on a
case by case basis. Please contact vendor as these situations arise. Transportation & Delivery Charges - Freight is billed at $5 per round trip mile plus a $150 loading charge.
Response Time for Emergencies -Sales and service staff are available 24 hrslday, 7 days /week. E. Liquidated Damages - Equipment Support Services will NOT assume liquidated damages. The
County is responsible in full for all costs incurred when renting equipment from a vendor other than Equipment Support Services.

Section B -IOE- $150.00 as way on non - permit loads & $200.00 /ea way on permit loads.Pg 4 -Sect D: 3. County is accountable for vandalism. 5a. OT Rates -OT is considered after 8hrs on a one
one day rent -After 40 hrs on a one week rent-After 176 hours after a one month rent. We consider a month on 30 days and prorated after 30 days. 5b. One day is the minimum rental period for all of the equipment. 5c. If
notified a.m. of the day rented -rain days are taken into consideration for extended rental days to the rent. Sd. Transportation Charges: If Mustang Rental Services delivers, the following will apply on transportation

required to supply us with a Certificate of Insurance to cover our equipment with vandalism, theft and fire. Mustang Rental Services charges a 1.5% environmental fee on all rental equipment.

DATE OF COURT MEETING: November 13, 2007
ITEM: Request from GSI Oil & Gas, Inc. to construct three (3) road bores for a poly -gas pipeline
installations in the right of way of Ferrill Creek Road, Dilly Shaw Tap Road and Fickey Road.
Company Check No 15306 in the amount of $1,500.00 for the permit accompanies this request.
Site is located in Precinct 2. (Deposit to Account No. 01- 460650.)
SOURCE OF FUNDS: N/A
REQUIREMENTS:
1) No work will be permitted between front slope and/or back slope.
2) All installation(s) shall be constructed in designated utility easements, if applicable. If no utility
easement exists, the installation(s) shall be 1) within 3 -5' of and parallel to the right -of -way line
and/or 2) in the case of a road bore, perpendicular to the right -of -way line.
3) If clearing of brush, trees and other obstruction is necessary, it shall be the Applicant's
responsibility to do so and to remove all cleared brush, trees etc. from county right -of -way.
4) Ditch line shall be compacted to 90% standard density ASTM -Test Method No. D -698; test shall
be conducted by an independent geotechnical testing firm; copies of all test results shall be furnished
to the office of the Brazos County Engineer.
5) Construction shall be in strict conformance to the latest Texas Manual of Uniform Traffic Control
Devices for Streets and Highways, published by the Texas Department of Transportation, and all other
State and Federal laws governing utility construction.

Formal notice is hereby given that (applicant) GS1 oil & Gas, Inc. proposes to
place a (type) poly-gas pipeline within the right - of-way of (road)and cr
the above referred in Brazos County, Texas as follows:

The location or description of the proposed installation is more fully shown by one
copies of the drawings attached to this notice.
1 understand and agree:
1. The County Engineer must be notified prior to the beginning of construction in order that a
designated Inspector may inspect the actual installation.
2. That all damage to the roadways and rights -of -way will be repaired to their original condition
to the satisfaction of the County Engineer.
3. That Brazos County reserves the right to require Applicant to relocate or lower any such line
at no cost to Brazos County, should same become necessary due to widening or lowering, or
other alteration of the roadway or right -of -way.
4. That Brazos County will in no way be responsible for any damage which may occur to any
existing utility lines in the right -of -way.
5. That The line will be constructed and maintained on the County right -of -way in accordance with the
Utility Accommodation Policy which was adopted by the Texas Department of Transportation on May
29, 1989.
6. That the line or lines will be constructed no less than forty -eight inches (48 ") lower than the lowest part
of the drainage or bar ditch and the drainage is to be considered at least two feel (2) below the center
of the roathvay.
7. That all roads shall be bored in accordance with the Utility Accommodation Policy of the Texas
Department of Transportation dated 1989.
8. That all sites will be barricaded during the construction period.
9. That the normal charge is $500.00 per crossing and /or $130.00 per rod when paralleling the roadway
established by the Commissioners Court on December 21, 2004.
10. Ditch line shall be compacted to 90% standard density ASTM -Test Method No. D -698; lest shall be
conducted by an independent geotechnical testing firm; copies of all test results shall be furnished to
the office of the Brazos County Engineer.
