Any request for sign interpretive services must be made two business days before the meeting To make arrangements, call (979) 361 -4102. 103 3 COMMISSIONERS' COURT REGULAR MEETING OCTOBER 30, 2007 A regular mee oners' Court of Brazos County, Texas was '' County Commissioners A Courtroom in the C, Brazos County, Texas, beginning at 9:00 a ber 30, 2007 with the following members of the Court present: Randy Sims, County Judge, Presiding; Lloyd Wassermann, Commissioner of Precinct 1; Duane Peters, Commissioner of Precinct 2; Kenny Mallard, Commissioner of Precinct 3; Carey Cauley, Jr., Commissioner of Precinct 4, Absent; Karen McQueen, County Clerk. The attached sheet contains the names of the citizens and officials that were in attendance. Commissioner Mallard gave the invocation and then led the pledge of allegiance. There was no citizen input /and or concerns. The first matter before the Court was the payment of $1,140.00 to SuddenLink from the JP Technology Fund for internet service on a computer located at the Department of Public Safety Bryan Office. On motion by Commissioner Peters, seconded by Commissioner Wassermann, the Court voted unanimously to approve the payment of $1,140.00 to SuddenLink. Vol 103 Page t-- Commissioners Court meeting October 30, 2007 2 The Court next considered a request from the Sheriff's Office to move $4,810.00 from Contingency to the 2006 -2007 Jail Administration Budget to fund the last billing cycle for utilities at the Detention Center. On motion by the County Judge, seconded by Commissioner Mallard, the Court voted unanimously to approve the request. The next matter before the Court was consideration of a request from the Sheriff's Office to allow an employee to start at pay group 16 -4 so that he may move into a new position at his current hourly rate. On motion by Commissioner Peters, seconded by Commissioner Mallard, the Court voted unanimously to approve the request. The Court next considered Budget Amendment #06/07 -51.1 through 51.6 that would reallocate funds for Jury Services, Courthouse Security Fund, Justice of the Peace, Precinct 1; and transfer funds from Contingency to CO Issue 2005, Jail Administration; and correct an error found in the budget amendment No. 06/07 -50.6. On motion by Commissioner Peters, seconded by Commissioner Mallard, the Court voted unanimously to approve the budget amendment as submitted, a copy of which is attached hereto. The Court next considered Budget Amendment #07/08 -4.1 through 4.8 that would reallocate funds for 361St District Vol lob Page j'' Commissioners Court meeting October 30, 2007 3 Court; and transfer funds from Contingency to numerous departments to provided funding for the 2 percent increase in health insurance premiums paid for by the County (4), HAVA- General Compliance and JP Technology Fund (2) ; and to carry forward the balance of FY 2007 TxDOT Interlocal Agreement to FY 2008. On motion by Commissioner Wassermann, seconded by Commissioner Peters, the Court voted unanimously to approve the budget amendment as submitted, a copy of which is attached hereto. The Court proceeded to consider the change of status of employees as submitted on the attached Personnel Action Requests. On motion by Commissioner Peters, seconded by Commissioner Wassermann, the Court voted unanimously to approve the changes as submitted. The Court next considered the following Claims as submitted by the County Treasurer for payment: 7042952 through 7043241 On motion by Commissioner Peters, seconded by the County Judge, the Court voted unanimously to approve the Claims as submitted. The next matter before the Court was the appointment of the Central Counting Staff for the November 6, 2007 General Election. Judge Democratic Cray Crouse Tabulation Supervisor Tracy Price Assistant Tabulator The Court next considered the revised list of Judges and Alternate Judges for the November 6, 2007 General Election. On motion by Commissioner Wassermann, seconded by Commissioner Peters, the Court voted unanimously to appoint the individuals named on the attached list as presiding judges and alternate judges for the November 6, 2007 election at each voting precinct. The County Judge read aloud Proclamation #07 -036 celebrating 25 years of Brazos County Crime Stoppers. The Court urges all citizens to applaud this effective crime prevention program in the Brazos Valley. Judge Tommy Munoz addressed the Court and thanked the Sheriff for his vision Vol t03 Page Commissioners Court meeting October 30, 2007 5 with Crime Stoppers being one step ahead of every one else. The Sheriff said that he could not take credit as it was Sheriff Bobby Yeager who was in office when the program started. Russ McDonald came up with the idea. On motion by Commissioner Peters, seconded by Commissioner Mallard the Court moved to join in, in celebrating 25 years of Brazos County Crime Stoppers. The County Judge then presented the signed Proclamation to Sheriff Chris Kirk, representing Crime Stoppers. The next matter before the Court was to consider retaining the County's Stop Loss Insurance through Med Ex /AIG Life. On motion by Commissioner Mallard, seconded by Commissioner Peters, the Court voted unanimously to retain the County's Stop Loss Insurance through Med Ex /AIG Life. A copy of the application of insurance coverage and the new rates is attached. The Court next considered two year renewal term of the District Clerk's Depository Contract with First National Bank. The renewal term is not to extend beyond May 31, 2009. On motion by Commissioner Peters, seconded by Commissioner Wassermann, the Court voted unanimously to renew the District Clerk's Depository Contract with First National Bank for a two (2) year term. A copy of the depository contract is attached. Vol t 03 Page T Commissioners Court meeting October 30, 2007 6 The next matter before the Court was approval of a Contractual Agreement between Brazos County and the Boys and Girls Clubs of the Brazos Valley to provide opportunities for youth to grow as productive citizens of our communities. The cost to Brazos County will be $50,000.00. The term of the contract is for one year commencing on the date of execution and terminating September 30, 2008. On motion by Commissioner Peters, seconded by Commissioner Mallard, the Court voted unanimously to enter into contractual agreement with the Boys and Girls Clubs of the Brazos Valley and authorized the County Judge to execute the documents. A copy of the contractual agreement is attached. The Court next considered the proposed vehicle use policy for the Brazos County Exposition Complex, Events Facilities Department that would establish guidelines for the use and assignment of all county vehicles by employees of the department. On motion by Commissioner Peters, seconded by Commissioner Wassermann, the Court voted unanimously to approve the proposed policy. A copy is attached. On motion by Commissioner Peters, seconded by Commissioner Mallard, the Court voted unanimously to receive, approve and order filed as submitted the Treasurer's report Vol ( 03 Page % Commissioners Court meeting October 30, 2007 7 for September 2007. A copy is attached to and made a part of these minutes. The next matter for consideration was approval of tax refund applications from the following individuals and /or companies: a. Antonio & Grisel Gallegos, over payment $1,095.40 b. Wanda Jackson Watson, over payment $350.00 On motion by Commissioner Wassermann, seconded by Commissioner Peters, the Court voted unanimously to approve the tax refund applications. The Court next considered awarding Bid No. 2008 -005, Road Signs and Sign Posts. Becky Stephens, Assistant Purchasing Agent made the following recommendation" Primary Vendor: Vulcan, Inc. Secondary Vendor: Custom Products On motion by Commissioner Wassermann, seconded by Commissioner Peters, the Court voted unanimously to accept the recommendation of the Assistant Purchasing Agent and award the contract as noted above. A copy of the bid tabulation is attached. The next matter before the Court was consideration of Bid 2008 -009, Flexible Base /Screenings /Sand. A copy of the bid tabulation is attached. The next matter before the Court was consideration of Amendment No. 8 to the Hunt Construction Contract for Construction Manger Services between Brazos County and Hunt Construction. The formally establishes Hunt's guaranteed Maximum Price for the work at $24,919,930.00 for the Exposition Center and the Sheriff Administration Building. On motion by Commissioner Peters, seconded by Commissioner Vol 103 Page !/ Commissioners Court meeting October 30, 2007 9 Mallard, the Court voted unanimously to approve Amendment No. 8. A copy is attached. The Court next considered the request from Verizon Communications to construct 2 road bores in the right -of -way of Dakota Ridge Drive in the Indian Lakes Subdivision. The site is located in Precinct 1. The County Engineer stated that all appeared to be in order and recommended approval. On motion by Commissioner Wassermann, seconded by Commissioner Peters, the Court voted unanimously to approve the request from Verizon and authorized the installation. A copy of the request is attached hereto. The Court next considered approval of the Final Plat of Indian Lakes Subdivision Phase VI, Lot 2 -R2 Block 13 being an Amending Plat of Indian Lakes Phase VI, Lot 2 -R1 and Lot 3 -R1, Block 13, 4.834 Acres located in Precinct 1. Richard Vance, County Engineer, stated that he had reviewed the plat and all appeared to be in order. On motion by Commissioner Wassermann, seconded by Commissioner Peters, the Court voted unanimously to approve the Final Plat of Indian Lakes Subdivision Phase VI, Lot 2 -R2 Block 13 being an Amending Plat of Indian Lakes Phase VI, Lot 2 -R1 and Lot 3 -R1, Block 13, 4.834 Acres as submitted. Under Agency /Board /Committee reports by Court members, the following spoke: Commissioner Mallard a) He reported on the high speed rail trip last week in which they went to Frankfurt, Germany and Madrid, Spain. On non - controlled access highways, cables placed on the pavement shall be arranged so they do not create a hazardous condition or rumble strip effect. All cables shall be securely anchored to the roadway with materials that will not damage and/or puncture the pavement. Nails spikes and similar materials used for anchors shall be placed beyond the pavement edge. 6. Adequate signs, barricades, flagmen, etc. shall be maintained as necessary to protect the traveling public. Compliance with the Texas Manual on Uniform Traffic Control Devices is mandatory. 7. The operations shall not interfere with the flow of traffic. All equipment should be parked and/or operated on one side of the roadway only, as far from the shoulder as practical and shall not be parked in the clear zone as defined by the Highway Design Manual. 8. Operations will not be allowed when the ground conditions are such that work within the right of way would cause rutting and/or tracking of mud onto the roadway surface. 9. The geophysical survey company shall restore the right of way to its original condition, free of any damage, including ruts or any injury to vegetation. Any costs incurred by the Department for necessary restoration work will be billed to the company at cost. 10. Any actions that create any liability or affect the rights of the holders of any property and/or mineral ownerships involved are solely the concern and responsibility of the company. 11. I �_ BRAZOS COUNTY EXPO COMPLEX EVENTS FACILITIES DEPARTMENT VEHICLE USE POLICY EFFECTIVE NEW DATE / OCTOBER 30, 2007 Policy/Description: This policy establishes guidelines for the use and assignment of all county vehicles by employees of the department. The objectives of the policy are to provide cost effective transportation to employees for carrying out the functions of the department to maintain the vehicle fleet in good working order and to provide 24 hour capability to respond in emergency situations. Procedures: 1. TYPES OF TRANSPORTATION SERVICES: The department may provide an employee with means of transportation to perform his or her job duties. Such means include mileage reimbursement and use of county vehicles. Provisions of transportations by the county shall not be used as a condition of employment with the county. 2. USE OF COUNTY VEHICLE: County vehicles and equipment are property of the county and may be used by department employees only in the course of their job duties unless otherwise provided for in this policy. Any employee who uses a county vehicle must have a valid Texas driver's license and must have signed a "Drivers License Check" form (See Attachment "A "). Authorized drivers are covered by the county's casualty and liability insurance policy. The driver is responsible for the safe operation of the vehicle and for obeying state and local traffic regulations. Employees who drive county vehicles or use their own personal vehicle to routinely conduct official county business shall notify their supervisor at the beginning of the business day of any suspension or cancellation of the vehicle operator's license. Employees shall not drive county vehicles under the influence of illegal drugs or alcohol or while under the influence of lawfully prescribed or over the counter substances, if these substances impair the employee's ability to drive. The driver is responsible for payment of all fines, penalties and court costs associated with violations of traffic regulations. 3. VEHICLE ASSIGNMENT: All EXPO vehicles are assigned to the employees whose position and job responsibilities require routine and continuous access to a vehicle. It will be the responsibility of the Department Head or his official designee for the care, maintenance, and security of all vehicles. APPROVED 4. TAKE HOME POLICY: Only the department head has the authority to give an employee authorization to take a county vehicle home. This authorization will only be granted to an employee who is performing stand by duty and is subject to being called out on county business overnight or on weekends. County employees authorized to take county vehicles home may use them minimally for personal errands while en route from home to work. De minimus use may include personal errands but may not include stops which may impinge the reputation of the county and the department. Take home vehicles may not be utilized for off duty employment or on weekends for personal use. 5. VEHICLE MAINTANCE: Users of county vehicles are responsible for maintaining sufficient fluid levels in the vehicles, including gas, oil, brake fluid, water and tire air pressure. These items should be checked each time the vehicle is filled with gas. 6. PASSENGERS: Persons not employed by Brazos County are permitted to ride in county vehicles as passengers if necessary to conduct county business or provide courtesy rides in cases of road side emergencies. Non - county employees are covered by the county's casualty and liability insurance policy under these circumstances. At no time will a person not employed by Brazos County be authorized to operate a county vehicle. 7. TRANSPORTATION OF EMPLOYEES IN TRUCK BED: Transporting employees in a truck bed to a job site is prohibited. Once at the work site, transporting not more than two (2) employees seated in the floor of the bed is permitted for a short distance at a low speed, provided that there is no equipment in the bed of the truck. 8. SAFETY: All department employees who drive county vehicles or their own personal vehicles to conduct business are expected to drive safely and observe all vehicle traffic laws to prevent vehicle accidents. County employees who drive county vehicles will be rated based on a point system comparing their motor vehicle record (MVR) and the Risk Assessment Table, shown below.
