9. Request from Juvenile Services for reimbursement of hotel accommodations at
$89.00 /night for a training workshop that does not have a host hotel; training location is
the Brown - Heatly Building in Austin, TX.
10. Tax Refund Applications for the following:

b. Erasmo Jr. & Irma Alvardo e. Becky Binion

11. Capital requisition in the amount of $16,415.70 to CDW Government, Inc. for the
purchase of computers for the S.O. Administration Building.
12. Renewal of the Annual Contract with Texas Commercial Waste for portable toilet
rental at citizen collection sites, with no increase in prices. Contract term is 10/01/07
through 9/30/08.
13. Renewal of the Annual Contract with A -1 Fire & Security for inspection of smoke
detectors at detention centers, with no increase in price. Contract term is 10/01/07
through 9/30/08.
14. Renewal of the Annual Contract with Able Tire Disposal for waste tire disposal, with
no increase in prices. Contract term is 10/01/07 through 9/30/08.
15. Renewal of the Annual Contract with RP Lee Pest Control for pest control services,
with no increase in price. Contract term is 10/01/2007 through 9/30/08.
16. Permission to advertise Bid 2007 -043, Urinalysis /Drug Testing for Community
Supervision.
17. Change Order adding $9,825.00 to the contract with Madison Construction for
Builder's Risk Insurance on the remodeling of the County Administration Building.
18. Permission to hire the Brazos County Abstract Co. to conduct title research on County
property located near Jones - Butler Road. Property is located in Precinct 1.
19. Request from Verizon Communications to construct a road bore and buried cable
installations three (3) feet in the south right of way of Hopes Creek Road beginning at a
point approximately 1,425 feet west of Dowling Road extending west for a distance of
approximately 1,563 feet; cable will be placed at a depth of 36 inches. Site is located in
Precinct 1.
20. Acknowledgement of the corrected Investment Report for the quarter ending 31 March
2007 (previously acknowledged in Commissioners Court on 8 May 2007).
21. Acknowledgement of the Treasurer's Investment Report for the quarter ending 30 June
2007.

COMMISSIONERS' COURT
REGULAR MEETING
AUGUST 14, 2007
A regular meeting of the Commissioners' Court of Brazos
County, Texas was held in the Brazos County Commissioners
Courtroom in the Courthouse in Bryan, Brazos County, Texas,
beginning at 9:00 a.m. on Tuesday, August 14, 2007 with the
following members of the Court present:
Randy Sims, County Judge, Presiding;
Lloyd Wassermann, Commissioner of Precinct 1;
Duane Peters, Commissioner of Precinct 2;
Kenny Mallard, Commissioner of Precinct 3;
Carey Cauley, Jr., Commissioner of Precinct 4;
Karen McQueen, County Clerk.
The attached sheet contains the names of the citizens and
officials that were in attendance.
Commissioner Peters gave the invocation and then led the
pledge of allegiance.
Under citizen input /and or concerns, the following spoke:
Demetrios Basdekas
a) Submitted copies of his correspondence with TxDOT in
support of his claims about bridge safety. He went on
to state that he was not happy with the structure of
the bridge on Old Reliance Road and asked that a
workshop be held with representatives from TXDOT and
civil engineers from TAMU.
The Court next considered Budget Amendment #06/07 -40.1
through 40.6 that would reallocate funds for Justice of the

Peace, Precinct 2, Place 1, Juvenile Services, Exposition
Center, County Records Management Fund; and transfer funds
from Contingency to Constable, Precinct 2 and Commissioner's
Court. On motion by Commissioner Cauley, seconded by
Commissioner Peters, the Court voted unanimously to approve
the budget amendment as submitted, a copy of which is attached
hereto.
The next matter before the Court was consideration of a
request from the County Attorney seeking approval for the
reclassification of an Assistant County Attorney part time
position to a full time position with benefits. The position
is currently Class 0518, Position 1, Group 36, Step 3,
budgeted at $40,362.00 annually. No additional monies will be
needed to fund the position. On motion by Commissioner
Peters, seconded by Commissioner Cauley, the Court voted
unanimously to approve the request.
The Court proceeded to consider the change of status of
employees as submitted on the attached Personnel Action
Requests. On motion by Commissioner Wassermann, seconded by
Commissioner Cauley, the Court voted unanimously to approve
the changes as submitted.
The Court next considered the following Claims as
submitted by the County Treasurer for payment:

On motion by Commissioner Cauley, seconded by Commissioner
Peters, the Court voted unanimously to approve the Claims as
submitted.
The next matter before the Court was consideration of an
Order Dividing One Election Precinct And Combining Into
Another Election Precinct.

City of Bryan
approved
Ordinance #1701 annexing 74
acres
of land located
in Voting
Precinct 67. The new boundary lines of the City of Bryan do
not follow the existing election precinct lines created by
Brazos County. Section 42.007 states that "A Commissioners
Court may not establish a county election precinct containing
territory inside a city with a population of $10,000 or more
and unincorporated territory outside the city ". Election
Precinct 67 will be divided and be combined with Election
Precinct 70A. Election Precinct 70A will be extended to
follow the new City of Bryan city limit lines and vote at the
current polling location. On motion by Commissioner Peters,
seconded by Commissioner Cauley, the Court voted unanimously
to adopt the Order Dividing One Election Precinct and
Combining Into Another Election Precinct and to make
submission to the Assistant Attorney General, Civil Rights
Division, Voting Section, Department of Justice, Washington

D.C. requesting the pre- clearance of this Order pursuant to
Section 5 of the Federal Voting Rights Act. A copy is
attached.
The next matter before the Court was consideration of the
appointment of a representative of the Court to serve on the
Board of Directors for the Brazos County Health Facilities
Corporation. On motion by Commissioner Cauley, seconded by
Commissioner Peters, the Court voted unanimously to appoint
Commissioner Lloyd Wassermann to the Brazos County Health
Facilities Corporation Board.
The next matter for consideration by the Court was a
request submitted by the Director of Juvenile Services seeking
approval for out of state travel for Lance Bledsoe and Paul
Morales who will be traveling to Austin, Texas to attend the
Annual Parole Workshop hosted by the Texas Youth Commission,
September 24 through the 26, 2007. Included is a request for
payment of hotel expenses that exceed the $85.00 per night
that county policy allows. On motion by the County Judge,
seconded by Commissioner Cauley, the Court voted unanimously
to grant the request from the Director of Juvenile Services
and approved payment of hotel fees for Lace Bledsoe and Paul
Morales.
The next matter for consideration was approval of tax

refund applications from the following individuals and /or
companies:
a. Harold & Patricia D. Bartell, over payment $18.00
b. Erasmo Jr. & Irma Alvardo, over payment $112.86
c. Amos L. White, over payment $33.98
d. Dane Madson, over payment $18.47
e. Becky Binion, over payment $242.10
On motion by Commissioner Peters, seconded by Commissioner
Mallard, the Court voted unanimously to approve the tax refund
applications as submitted.
The Court next considered requisition #00015045 to CDW
Government, Inc. in the amount of $16,415.70 for the purchase
of computers for the Sheriff's Administration Building. On
motion by Commissioner Peters, seconded by Commissioner
Cauley, the Court voted unanimously to approve the
requisition.
The next matter before the Court was consideration of the
renewal of the Annual Contract for Portable Toilet Rental with
Texas Commercial Waste. These toilets are at the Citizen
Collection sites. Texas Commercial Waste has agreed to
provide services for another year with no increase in prices.
On motion by Commissioner Peters, seconded by Commissioner
Cauley, the Court voted unanimously to exercise the option for
renewal of the annual contract with Texas Commercial Waste. A
copy is attached.

The Court next considered renewal of the Annual Contract
with A -1 Fire & Security Equipment Company for inspection of
smoke detectors at the detention centers. The term of the
contract is from October 1, 2007 through September 30, 2008.
A -1 Fire & Security Equipment Company has agreed to provide
inspections for another year with no increase in price. On
motion by Commissioner Cauley, seconded by Commissioner
Peters, the Court voted unanimously to renew the Annual
Contract with A -1 Fire & Security. A copy is attached.
The next matter before the Court was consideration of the
renewal of the current contract with Able Tire Disposal for an
additional year beginning October 1, 2007 through September
30, 2008. Able Tire Disposal has agreed to provide waste tire
disposal services for another year with no increase in price.
On motion by Commissioner Wassermann, seconded by Commissioner
Peters, the Court voted unanimously to exercise the option to
renew the contract with Able Tire Disposal. A copy is
attached.
The Court proceeded to consider another renewal of the
current contract, this one with R. P. Lee Pest Control. The
contract period is from October 1, 2007 through September 30,
2008. R.P. Lee has agreed to provide services for another
year with no increase in price. On motion by Commissioner

Cauley, seconded by Commissioner Peters, the Court voted
unanimously to exercise the option to renew the contract with
R.P. Lee Pest Control. A copy is attached.
The next matter for consideration was approval for the
Purchasing Agent to advertise for proposal 2007 -043,
Urinalysis /Drug Testing. On motion by Commissioner Peters,
seconded by Commissioner Wassermann, the Court voted
unanimously to authorize the Purchasing Agent to advertise for
proposals for Urinalysis /Drug Testing.
The Court next considered approval of a Change Order in
the amount of $9,825.00 to the Madison Construction contract
for Builder's Risk Insurance on the remodeling of the County
Administration Building. This insurance only covers the new
work done on the building. This increases the project total
to $3,977,880.00. On motion by the County Judge, seconded by
Commissioner Peters, the Court voted unanimously to approve
the change order.
The next matter before the Court was consideration of the
hiring of Brazos County Abstract Company to conduct a title
research on County property located near Jones - Butler Road in
Precinct 1. There is a question as to whether Brazos County
has legal ownership. On motion by Commissioner Wassermann,
seconded by Commissioner Peters, the Court voted unanimously

to approve the hiring of Brazos County Abstract Company to
conduct the title search.
The Court next considered the request from Verizon
Communications to construct a road bore and buried cable
installation in the right -of -way of Hopes Creek Road beginning
at a point approximately 1425 feet west of Dowling Road
extending west for a distance of approximately 1563 feet and
place the cable at a depth of 36 inches. The site is located
in Precinct 1. The County Engineer stated that all appeared
to be in order and recommended approval. On motion by
Commissioner Wassermann, seconded by Commissioner Peters, the
Court voted unanimously to approve the request from Verizon
Communications and authorized the installation. A copy of the
request is attached hereto.
The Court acknowledged receipt of and ordered filed as
submitted the corrected Investment Report for the quarter
ending June 30, 2007. A copy is attached to and made a part of
these minutes.

a) Said that the process involved in bidding
out our health insurance coverage that we
share with the cities is moving forward.
County Judge
a) There will be a workshop at 10:00 a.m. today
concerning juror payments and also a
presentation on the proposed jail expansion.
b) At 2:00 p.m. there will be a workshop on a
request for compulsory direct deposit of
payroll checks.
Under citizen input and /or concerns, the following
spoke:
Sheriff
a) There were 535 inmates in jail over the
weekend. The good news is that the figure
was under 546. Home monitoring is working
well. There are currently 44 people wearing
the monitors. They are in the process of
being set up for the monitors.
There were no Agency /Board /Committee reports by Court
members.

ORDER DIVIDING ONE ELECTION PRECINCT AND
COMBINING INTO ANOTHER ELECTION PRECINCT
WHEREAS, the City of Bryan .approved Ordinance # 1701 annexing 74 acres of
land located in Voting Precinct 67; and
WHEREAS, the new boundary lines of the City of Bryan do not follow the
existing election precinct lines created by Brazos County; and
WHEREAS, Section 42.007 states "A commissioners court may not establish a
county election precinct containing territory inside a city with a population of 10,000 or
more and unincorporated territory outside the city "; and
WHEREAS, the Commissioner's Court is desirous of complying with the City of
Bryan city limit lines, and the Election Code; and
WHEREAS, compliance with the Texas Election Code requires the division of
one (1) voting precinct and combining the annexed portion into another voting precinct;
and
WHEREAS, Section 42.008 (1) of the Texas Election Code provides for
combining election precincts;
NOW THEREFOR BE IT RESOLVED BY THE COMMISSIONERS COURT
OF BRAZOS COUNTY, TEXAS, that
Pursuant to Section 42.007 of the Texas Election Code that Election Precinct 67
be divided to follow the City of Bryan city limit lines in Brazos County, Texas, to wit:
1. Election Precinct 67 be divided and be combined with Election Precinct 70A;
2. Election Precinct 70A be extended to follow the new City of Bryan city limit
lines and vote at the current polling location;
3. That submission be made to the Assistant Attorney General, Civil Rights
Division, Voting Section, Department of Justice, Washington D.C. requesting
the preclearance of this Order pursuant to Section 5 of the Federal Voting
Rights Act

RENEWAL ACCEPTANCE
By signing herewith, I acknowledge and agree to extend Annual
Contract for Smoke Detector Inspectons, in accordance with all terms
and conditions previously agreed to and accepted, and with no increase

ITEM: Request from Verizon Communications to construct a road bore and buried cable
installations 3 feet in the south right of wa o� f Hopes Creek Road beginning at a point
approximated 1,425 feet west of Dowling Road extending west for a distance of approximately
1,563 feet; cable will be placed at a depth of 36 inches. Site is located in Precinct 1.

PRESENTATION:
REQUIREMENTS:
1) No work will be permitted between front slope and /or back slope.
2) All installation(s) shall be constructed in designated utility easements, if applicable. If no utility
easement exists, the installation(s) shall be 1) within 3 -5' of and parallel to the right -of -way line
and /or 2) in the case of a road bore, perpendicular to the right -of -way line.
3) If clearing of brush, trees and other obstruction is necessary, it shall be the Applicant's responsibility to
do so and to remove all cleared brush, trees etc. from county right -of -way.
4) Ditch line shall be compacted to 90% standard density ASTM -Test Method No. D -698; test shall be
conducted by an independent geotechnical testing firm; copies of all test results shall be furnished to
the office of the Brazos County Engineer.
5) Construction shall be in strict conformance to the latest Texas Manual of Uniform Traffic Control
Devices for Streets and Highways, published by the Texas Department of Transportation, and all other
State and Federal laws governing utility construction.

Formal notice is hereby given that VERIZON COMMUNICATIONS will construct
a communication line within the right -of -way of a County Road in Brazos County,
Texas as follows:
On Hopes Creek Road approximately 1425' west of Dowling Road
a buried cable will be placed 3' in the south R.O.W. extending west
for a distance of approximately 1563'. The cable will then turn and
go under Hopes Creek Road to a splice point. The cable will be
placed at a depth of 36.
The location and description of this line and associated appurtenances is
more fully shown by four (4) copies of drawings attached to this notice. The line
will be constructed and maintained on the County Road right -of -way in
accordance with governing laws.
Notwithstanding any other provision contained herein, it is expressly
understood that the tender of this notice by the Verizon Southwest Incorporated
does not constitute a waiver, surrender, abandonment or impairment of any
property rights, franchise, easement, license, authority, permission, privilege or
right now granted by law or may be granted in the future and any provision or
provisions so construed shall be null and void.
Construction of this line will begin on or after August 22, 2007.

This report is made in accordance with provisions of Gov.Code 2256, The Public Funds Investment Act, which
requires quarterly reporting of investment transactions to the Commissioners' Court.
The Brazos County Investment portfolio earned an average yield of 5.2818% on the quarterly average
balance of $5,647,651.14 invested with TexPool for the period ending 03/31/2007. Investment interest
deposited during the quarter was $73,235.12. Actual ending balance for March 2007 was $5,672,168.51.
The average Earnings Credit Rate on checking account interest for the quarter ending 03/31/2007 was
5.50% netting $842,354.74 on an average depository balance of $62,154,500.32.
Investment Strategy
There are no investment opportunities currently available to Brazos County that would exceed the rate being
earned on the funds on deposit with Citibank. Additionally, the depository contract provides a rate that
adjusts as rates increase (3 -month Treasury rate + 55 basis points) which continues to produces a
competitive rate with the least amount of risk of loss of principal (110% collateralized) as well as the least
amount of maturity risk (daily liquidity).
Because of the interest rate and collateral provided by the current depository contract as well as the
protection from maturity and liquidity risks associated with other products, the Brazos County investment
strategy remains unchanged with a concentration of County funds in the Brazos County depository. Brazos
County maintains a minimal balance invested with Texpool in order to maintain an active Texpool account.
Summary of Portfolio Changes
The deposit of interest is the only portfolio change to balances at this time and the Weighted Average Maturity
of investments remains at 1 day due to the liquidity of funds invested with TexPool and on deposit at Citibank of
Texas.

during the quarter was $44,166.87. Actual ending balance for June 2007 was $2,216,335.38.
The average Earnings Credit Rate on checking account interest for the quarter ending 06/30/2007 was
5.33% netting $785,550.81 on an average depository balance of $59,096,080.88.
Investment Strategy
Through May 2007, the investment opportunities available to Brazos County that would exceed the rate being
earned on the CITIBank accounts had maturity dates that presented a maturity risk with little, if any,
justifying reward. The depository contract adopted in May 2007 provides a rate that adjusts as rates
increase (3 -month Treasury rate + 35 basis points) with the least amount of risk of loss of principal (110%
collateralized) as well as the least amount of maturity risk (daily liquidity). However, since this rate is less
than that in the previous contract, it will be necessary to monitor and compare the rates of other investment
instruments as possible options for the future.
