Y Run COMMISSIONERS' COURT REGULAR MEETING JUNE 12, 2007 A regular meeting of the Commissioners' Court of Brazos County, Texas was held in the Brazos County Commissioners Courtroom in the Courthouse in Bryan, Brazos County, Texas, beginning at 9:00 a.m. on Tuesday, June 12, 2007 with the following members of the Court present: Randy Sims, County Judge, Presiding; Lloyd Wassermann, Commissioner of Precinct 1; Duane Peters, Commissioner of Precinct 2; Kenny Mallard, Commissioner of Precinct 3; Carey Cauley, Jr., Commissioner of Precinct 4; Karen McQueen, County Clerk. The attached sheet contains the names of the citizens and officials that were in attendance. Commissioner Mallard gave the invocation and led the pledge of allegiance. Under citizen input /and or concerns, the following spoke: Donald Lampo, representing the Precinct 2 Volunteer Fire Department presented the annual audit report to the Commissioners Court The Court next considered Budget Amendment #06/07 -31.1 through 31.4 that would reallocate funds for the Exposition Center, General Permanent Improvement Fund, County Records Management and Preservation (2); transfer funds Contingency to 2005 Certificates of Obligation, from General fund to Building Vol a 5 Page Commissioners Court meeting June 12, 2007 2 renovations. On motion by Commissioner Cauley, seconded by Commissioner Peters, the Court voted unanimously to approve the budget amendment as submitted, a copy of which is attached hereto. The Court proceeded to consider the change of status of employees as submitted on the attached Personnel Action Requests. On motion by Commissioner Peters, seconded by Commissioner Wassermann, the Court voted unanimously to approve the changes as submitted. The Court next considered the following Claims as submitted by the County Treasurer for payment: 7031993 through 7032218 On motion by Commissioner Peters, seconded by Commissioner Cauley, the Court voted unanimously to approve the Claims as submitted. The next matter before the Court was the appointment of an individual to serve on the Local Workforce Development Board representing Economic Development. On motion by Commissioner Mallard, seconded by Commissioner Cauley, the Court voted unanimously to appoint Todd McDaniel to a term beginning July 15, 2007 through June 30, 2010. The Court next considered a request from the Jail Administrator for an additional 60 days of unpaid leave for a Vol q 5 Page t9,5 Commissioners Court meeting June 12, 2007 3 detention officer who will exhaust her protected leave under the Family Medical Leave Act as of June 14, 2007. On motion by Commissioner Peters, seconded by Commissioner Cauley, the Court voted unanimously to approve the request. The next matter for consideration by the Court was a request submitted by the Sheriff's Office seeking approval for out of state travel for Investigator Kenny Elliott to travel to various locations in Florida to follow up fresh leads on a cold homicide case. His departure date will be Thursday, June 14, 2007. His return date will be determined by the time that is needed to follow -up on any developing leads. On motion by Commissioner Peters, seconded by Commissioner Cauley, the Court voted unanimously to grant the request from the Sheriff's Office and approved payment of out of state travel expense for Investigator Kenny Elliott. The next matter for consideration by the Court was a request submitted by 272nd District Court Judge, Rick Davis seeking approval for out of state travel for himself to attend a Judicial Education Seminar June 21 -22, 2007 in Washington D.C. On motion by Commissioner Cauley, seconded by Commissioner Wassermann, the Court voted unanimously to grant the request from the 272nd District Judge and approved payment of out of state travel expense for Judge Davis. The next matter before the Court was consideration of requisition #00014239 to Wilton's Office Works in the amount of $720.30 to Wilton's Office Works for the purchase of Lecterns for the Exposition Center. On motion by Commissioner Cauley, seconded by Commissioner Peters, the Court voted unanimously to approve the requisition. On motion by Commissioner Wassermann, seconded by Commissioner Peters, the Court voted unanimously to accept the City of Bryan's cost estimate of $38,341.00 for relocation of 1,600 feet of 3 -inch PVC waterline on Hopes Creek Road. A. a banking association, organized under the laws of the United States and authorized by law to do banking business in Brazos County, Texas, and now conducting such business in said Brazos County, Texas, hereinafter called "BANK ". DEPOSITOR, through action of Its Commissioners Court, hereby designates BANK as a depository for the period beginning June 1, 2007, through May 31, 2011, for a term of four (4) years. This contract is to cover all accounts owned by the County and all funds held in trust by the DEPOSITOR and placed on deposit with BANK. At the end of this four -year contract, BANK agrees to a 90 -day extension if necessary to provide time for contract negotiations and a transition period. BANK's application for Depository Contract, including Request for Proposal, all exhibits, attachments, and addenda thereto, is incorporated and made part of this contract for all purposes; however, to the extent that any provision therein conflicts with any provision herein, this Depository Contract will control.
